CONSTRUCTION REGULATION BOARD
REGULAR MEETING
MARCH 11, 1997
7:00 P.M.
CALL TO ORDER:
Chairman Les Ogram called to order the regular meeting of the
Construction Regulation Board (CRB) on Tuesday, March 11, 1997 at 7:00
p.m. in the Community Development Conference Room.
ROLL CALL:
Members present were Chairman Les Ogram, Michael Bosse, Woody Tindall
and Sid Corhern. Bob Howard, Nancy Swiney and Gary Madole were recorded
absent. Also present were Robert A. Dunn, Building Official; and Tonya
Elliott, Board Coordinator.
APPROVAL OF MINUTES:
Chairman Ogram asked for a motion to approve the minutes of January
28, 1997. Mr. Bosse so moved. Seconded by Mr. Tindall. Motion
CARRIED 4-0.
UNFINISHED BUSINESS:
None at this time.
NEW BUSINESS:
Report of Construction Industry Study Committee
1) Review the :
Chairman Ogram asked Mr. Dunn if he had any comments to make. Mr.
Dunn said that Mr. Howard was unable to attend the meeting and wanted
to relay his thoughts on the Study. Mr. Howard feels further study
is needed before a recommendation to adopt the Study is made to Council.
Chairman Ogram asked Mr. Bosse for his comments. Mr. Bosse said he
basically agrees with Mr. Howard, that there is a lot of good in the
Study but it needs to be looked at more carefully.
Mr. Dunn briefly explained the current process of licensing state
certified contractors and locally registered contractors and how the
Study will effect those contractors. Mr. Corhern suggested since the
Study was only 6 pages, and the Mayor has request a report from the
Board, that they discuss the Study section by section.
Chairman Ogram agreed and gave the members a few minutes to read over
the first section, Licensing and Examination Process and Procedure,
which establishes single-tier licensing. Mr. Corhern asked how
complaints would be handled under single-tier licensing. Mr. Dunn
said that had not been established yet. There was a discussion on
the clarification of the term "Occupational License" being replaced
with "Occupational Certificate" or some other reference under
single-tier licensing. Mr. Dunn said he wanted to make sure the Board
understood that under single-tier licensing, there would no longer
be locally registered contractors, only state certified contractors.
There was a lengthy discussion on the

effect single-tier licensing would have on the consumer; the different
types of contractors (i.e., general, residential, building, etc.) and;
license and education requirements. Mr. Corhern said based on their
discussion he foresees a long term negative effect with single-tier
licensing. All the Board members agreed.
Chairman Ogram gave everyone a few minutes to read over the next section,
Regulatory Board Structure and Authority, which recommends the merger
of the Construction Industry Licensing Board (CILB) and the Electrical
Construction Licensing Board (ECLB). Mr. Corhern said he feels the
intent is to cut down on the number of bureaucratic boards. Mr. Dunn
handed out a memorandum he had received from Arnaldo L. Abreu, Chairman,
ECLB opposing the merger. There was discussion on the negative impact
the merger of the CILB and ECLB could have on specialized contractors.
The members agreed they don't see any benefit in merging the CILB
and ECLB.
Regulatory and Disciplinary Jurisdiction and Functions, which
establishes a uniform disciplinary model, was the next item discussed.
Mr. Dunn said the City has already filed for accreditation with the
existing Board (CRB). After discussion on who reviews complaints
against contractors and the role of the CRB, the members agreed they
didn't see any problems with this section.
Construction Industry Recovery Fund, which changes Board-ordered
restitution to civil judgement as the only basis for accessing the
Fund, was the next section discussed. Mr. Dunn explained the Fund
was established with disciplinary money received from actions taken
against contractors. The Fund helps the consumer recover money lost
when a contractor does something that doesn't meet code. After
discussion, the Board agreed the Construction Industry Recovery Fund
should stay under a Board-ordered restitution and not civil judgement.
Journeyman Licensure, which established reciprocity, was discussed
next. Mr. Dunn explained that this procedure is already being followed
county wide. The members agreed they didn't see any problems with
this section.
Unlicensed Activity, which increases the penalty for unlicensed
activity, was the last section discussed. There was questions on how
these penalties would apply to a handyman. After clarification from
Mr. Dunn, the members agreed they didn't see any problems with this
section.

Mr. Corhern asked what the Mayor was requesting from the Board.
Chairman Ogram said he wanted the Board to review and make any
recommendations or actions they felt necessary by the third Monday
in March Council meeting. Mr. Corhern said they should not recommended
the study be supported in total and explain why. Chairman Ogram said
he was looking for a volunteer to go before Council with the
recommendation. Mr. Corhern made a motion that Mr. Howard make the
recommendations to Council. Seconded by Mr. Bosse. After some further
discussion on single-tier licensing, the members agreed they didn't
see a problem with that section. They then recapped the Study, and
decided the only sections they disagreed with were: Regulatory Board
Structure and Authority, the ECLB and CILB should not be merged; and
Construction Industry Recovery Fund, keep the Fund as Board-order
restitution not civil judgement. The motion that Mr. Corhern made
that Mr. Howard make these recommendations to Council was brought back
to the table. Seconded again by Mr. Bosse. Motion CARRIED 4-0.
ADJOURN:
There being no other business to come before the Board the meeting
adjourned at 8:30 p.m.
