03-26-1996 CITY OF EDGEWATER CONSTRUCTION REGULATION BOARD REGULAR MEETING MARCH 26, 1996 7:00 P.M. Chairman Bob Howard called to order the Regular Meeting of the Construction Regulation Board (CRB) on Tuesday, March 26, 1996, at 7:00 p.m. in the Community Development Conference Room. ROLL CALL: Members present were Chairman Bob Howard, Michael Bosse, Les Ogram, Woody Tindall, Nancy Swiney, and Lester Yarnell. Gary Madole was recorded absent. Also present were Robert A. Dunn, Building Official, and Krista Storey, City Attorney. APPROVAL OF MINUTES: Mr. Ogram moved to approve the minutes of September 26, 1995. Seconded by Mr. Tindall. Motion CARRIED 6-0. UNFINISHED BUSINESS: None at this time. NEW BUSINESS: 1) Review of Standard Unsafe Building Abatement Code 1985 Edition: Chairman Howard said he thought the meeting was a briefing for the Board and asked Mr. Dunn if he would go over the Code. Mr. Dunn said the complete Code was sent to each Board member for their review so they would be familiar with the Code, the appeal process and why staff had declared some properties unsafe. He said there would be a couple of cases coming up, and dates would be set for those hearings before the meeting adjourned. Chairman Howard noted the arrival of Krista Storey. Mr. Dunn began with explaining that buildings or structures can be declared unsafe according to Chapter 1, Section 101.6 Maintenance, of the Code, which states the owner, or his designated agent, is responsible for maintaining their buildings or structures within the City of Edgewater. He asked the Board if they had any questions. Ms. Storey answered questions Mr. Bosse had on Section 102.1 Enforcement Officer and Chairman Howard had on Section 105.1 Appointment. Mr. Dunn then addressed Chapter 2 Definitions, and the terms that have been used when declaring a building unsafe. He explained the notification process begins with calling the property owner before their property is posted unsafe. He then briefly explained the rest of the notification process, how properties are posted unsafe, and the owners options once the property has been posted unsafe. The Board discussed the time frame involved. Construction Regulation Board March 26, 1996 Page -02- 2) Review of the Appeal Process: Mr. Dunn handed out and explained a copy of the CRB Hearing Request application that is submitted for appeals. Mr. Dunn said the appeal process is taken from the City of Edgewater Land Development Code and is basically the same as the Standard Building Code with a few modifications since the Board serves both the Building Official and Fire Chief. Chairman Howard asked the Board if there were any questions on the appeal process. Ms. Swiney asked under what circumstances would they be in a position to step aside in the decision making process as far as business relationships with a person involved in an appeal. Ms. Storey said they are required under state law to participate in any decision unless they have a defined conflict of interest which amounts to a financial interest. Ms. Storey said anyone with questions about conflicts should contact her. Mr. Dunn said someone had appealed his decision declaring their building unsafe and a hearing date needed to be set. After discussion, Mr. Bosse made a motion to set a meeting for April 30, 1996. Seconded by Mr. Tindall. Motion CARRIED 6-0. Mr. Dunn said the meeting would be in the Community Center. Ms. Storey talked to the Board about their role during a hearing. She explained Mr. Dunn would present his case, the Board would have the opportunity to ask questions, then the appellant would present their case. She said the issue at hand would be for the Board to determine if the building is unsafe as defined in the Code. Ms. Swiney asked if procedures were not followed properly would be an issue in making a determination. Ms. Storey said yes, and then explained her role to the Board. Chairman Howard asked how they could make a proper decision without seeing the property in question. Ms. Storey said that had been discussed by herself and Mr. Dunn, and they suggested starting the hearing at the site at 7:00 p.m. then return to the Community Center to continue the hearing. Ms. Storey finished explaining the appeal process and the role of the Board. ADJOURNMENT: There being no further business to come before the Board, a motion to adjourn was made and seconded.
