ORDINANCE NO. 2003-0-20
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
EDGEW ATER, FLORIDA; AUTHORIZING: THE ISSUANCE
OF A GENERAL OBLIGATION BOND FOR THE CITY TO
FINANCE THE "DECADE OF EXCELLENCE" CAPITAL
IMPROVEMENT PROJECTS TO YIELD A CONSTRUCTION
FUND IN AN AMOUNT NOT TO EXCEED SEVEN MILLION,
FOUR HUNDRED TWENTY THOUSAND (7,420,000)
DOLLARS; PROJECTS TO INCLUDE (1) NEW CITY
HALL/RENOVATION OF EXISTING CITY HALL SITE, (2)
NEW FIRE STATION/POLICE AND FIRE
ADMINISTRATIVE BUILDING, AND (3) NEW ANIMAL
ADOPTION/RESCUE/EDUCA TIONAL FACILITY;
PROVIDING FOR AND CALLING AN ELECTION OF THE
QUALIFIED ELECTORS RESIDING WITHIN THE CITY TO
BE HELD ON NOVEMBER 4, 2003, TO CONSIDER THE
ISSUANCE OF THE GENERAL OBLIGATION BOND;
PROVIDING FOR CONFLICTING PROVISIONS,
SEVERABILITY AND APPLICABILITY; PROVIDING AN
EFFECTIVE DATE AND ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. The City of Edgewater has hereby studied/researched the need for various capital
improvements which shall be called "Decade of Excellence" Capital Projects to benefit the citizens
of Edgewater;
2. The "Decade of Excellence" Capital Projects shall include: (1) new City
Hall/renovation of existing City Hall site, (2) new Fire Station/Police and Fire Administration
Building, and (3) New Animal Adoption/Rescue/Educational Facility;
3. The City feels that an election should be called for November 4,2003 for the citizens
to vote for the consideration of a general obligation bond to fund the "Decade of Excellence" Capital

Projects.
NOW, THEREFORE, BE IT ENACTED by the City Council of the City of
Edgewater, Florida:
PART A.
Authority for this Ordinance.
This Ordinance is adopted pursuant to the Charter and the Code of Ordinances of the City
of Edgewater, Florida, and the general laws of the State of Florida.
PART B.
Authorization for "Decade of Excellence" Capital Projects.
The City hereby agrees that the "Decade of Excellence" Capital Projects shall include the
following: (1) New City Hall/Renovation of Existing City Hall Site, (2) New Fire Station/Police and
Fire Administrative Building, and (3) New Animal Adoption/Rescue/Educational Facility located
on AirPark Road as further described in Exhibit "A".
PART C.
Authorizationfor Bonds.
(A) Subject and pursuant to the provisions hereof, a general obligation bond ("the
Bond") of the City of Edgewater, Florida ("the City"), are hereby authorized to be
issued in an aggregate principal amount to yield a construction fund not to exceed
Seven Million Four Hundred Twenty Thousand Dollars ($7,420,000) to finance the
costs of the "Decade of Excellence" Capital Projects hereinafter described in Part B
of this Ordinance. The funds received from the issuance of the Bond will be used for
such purposes and for the benefit of the citizens of the City. The Bond shall be
payable from ad valorem taxes levied with a limitation of 1.0 mill on all taxable
property situated within the City. None of the Bond shall be issued for a term of

longer than twenty-five (25) years from the date of issuance.
PARTD.
Election Called.
An election ("the Election") of the qualified electors residing in the City is hereby called to
be held on November 4,2003, to determine whether or not:
(A) the issuance of the Bond in an aggregate amount to yield a construction fund not to
exceed Seven Million Four Hundred Twenty Thousand Dollars ($7,420,000) shall
be approved by such qualified electors to finance the "Decade of Excellence" Capital
Projects;
(B) The afore-described projects shall each also include other purposes appurtenant or
incidental thereto;
(C) All qualified electors residing in the City shall be entitled and permitted to vote in the
Election;
(D) The polls will be open at the voting places from 7:00 a.m., Eastern Time, until 7:00
p.m., Eastern Time, on the same day.
PART E.
Polling Places.
The Inspectors and Clerks for the polling places for the Election shall be appointed by
subsequent resolution of the City Council. The places of voting in such election shall be as follows:

a construction fund not to exceed $7,420,000.00, maturing within
twenty-five (25) years, payable from ad valorem taxes levied with a
limitation of 1 mill on all taxable property in the City, to finance the
"Decade of Excellence" Capital Proj ects which include: (1) New City
Hall/Renovation of Existing City Hall Site; (2) New Fire
Station/Police and Fire Administration Building; and (3) New Animal
Adoption/Rescue/Educational Facility?
Instructions to Voters:
Indicate by completely filling in the oval opposite "FOR BOND" if
you are in favor of the issuance of said bond.
o For Bond
Indicate by completely filling in the oval opposite "AGAINST
BOND" if you are not in favor of the issuance of said bond.

PARTF.
Absentee Voting.
Optical Scan Paper ballots shall be used at the Election for absentee voting. The form of
ballot to be used in the Election for absentee voters shall be in substantially the form provided in Part
E of this Ordinance.
PART G.
Printing of Ballots.
The City Clerk is authorized and directed to have printed on plain white ballot stock paper,
a sufficient number of the aforesaid ballots for use of absentee electors entitled to cast such ballots
in the Election, and shall also have printed sample ballots and deliver them to the Inspectors and
Clerks on or before the date and time for the opening of the polls for the Election for the voting

places at which voting machines, or other voting devices, are to be used; and further is authorized
and directed to make appropriate arrangements for use of such voting machines, or other voting
devices, at the polling places specified herein and to have printed on plain white ballot stock paper
and delivered in accordance with law the official ballots for use in such voting machines or other
voting devices.
PART H.
Election Procedure.
The Election shall be held and conducted in the manner prescribed by law for holding general
elections in the City. The Inspectors and Clerks at each polling place shall prepare and file returns
of the Election and shall deliver the same to the City Canvasing Board. Such returns shall show the
number of qualified electors who voted at the Election on each of the Propositions and the number
of votes cast respectively for and against approval of each of the Propositions. The returns shall be
canvassed by the City Canvasing Board as soon as practicable following the Election.
PART I.
Election Results.
If a majority of the votes cast at the Election in respect to a Proposition shall be "yes" votes
or "F or Bond," the Proposition shall be approved; and then the particular bond, the issuance of which
shall be thereby approved, shall be issued as hereafter provided by the City.
PART J.
Notice of Bond Election.
Notice of the Election, substantially in the form attached as Exhibit A to this Ordinance shall
be published in The Observer, a newspaper published and of general circulation in the City. This
Ordinance shall be published in full as part of such notice of the Election, together with an
appropriate caption in such form as the City Clerk shall determine. The first publication shall be not

less than thirty (30) days prior to the date of the Election, exclusive of the day of publication and the
day of the Election. The publication shall be made once in the fifth week and once in the third week
prior to the week in which the Election is to be held.
PART K.
Conflicting Provisions.
All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance,
are hereby superseded by this ordinance to the extent of such conflict.
PART L.
Severability and Applicability.
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or
circumstances, such holding shall not affect its applicability to any other person, property, or
circumstance.
PARTM.
Effective Date. This Ordinance shall take effect immediately upon its
adoption.

IN THE CITY OF EDGEW A TER, FLORIDA
NOTICE IS HEREBY GIVEN THAT A GENERAL OBLIGATION BOND ELECTION
WILL BE HELD ON THE 4TH DAY OF NOVEMBER, 2003, IN THE CITY OF
EDGEW A TER, FLORIDA, for the purpose of determining whether or not:
(A) A general obligation bond for the City of Edgewater shall be issued in an aggregate
amount to yield a construction fund not to exceed Seven Million Four Hundred Twenty Thousand
Dollars ($7,420,000) to finance the "Decade of Excellence" Capital Improvements with project to
include (1) New City Hall/Renovation of Existing City Hall Site; (2) New Fire Station/Police and
Fire Administrative Building and (3) New Animal Adoption/Rescue/Educational Facility.
Said General Obligation Bond shall bear interest at an average interest cost rate assumed to
be six percent (6%) per annum over a period not to exceed twenty-five (25) years from the date of
issuance of the bond and shall be payable from ad valorem taxes levied on all taxable property in the
City, all as more specifically described in Ordinance No. 2003-0-20 adopted by the City Council on
September 8,2003.
At an assumed interest cost rate of six percent (6%) per annum and level amortization over
a twenty-five (25) year period, the effects of bond issuance pursuant to a favorable vote on the above
Proposition on millage and real property taxes. The maximum millage increase shall be capped at
1. 0 mill.
The places of voting in the General Obligation Bond Election shall be those places
set forth in said Ordinance No. 2003-0-20. The polls will be open at said places of voting on
November 4,2003, from 7:00 a.m. until 7:00 p.m., Eastern Time, all as provided in said Ordinance
No. 2003-0-20, and published in full below as part of this Notice.
