A. Universal Tag Program - consideration/authorization to establish an
Ordinance to participate in a countywide "Universal Tag Program" and hold
the required public hearings.
B. Terra Mar Village Utility Improvements - staff recommending approval of
Notice to Award Bid to McMahan Construction as low qualified bidder for
$710,036, and approval of Change Order #1 (due to bid exceeding budgeted
amount for project), reducing the contract amount to $437,500.
C. Transportation Impact Fee Study - staff recommending approval of the
proposal from B & H Consultants, Inc. to prepare a Transportation Impact
Fee Study for a total not to exceed $44,075; authorize the Mayor/City
Manager to execute the documents; and to permit other governmental entities
to piggyback on the contract for their transportation analysis needs.
D. Discussion Item - determine Council's interest in entering into an exclusive
solid waste franchise agreement for commercial solid waste pickup.

Richard Stonecipher of Stonecipher Enterprises, owner of Earthquake Magoons, located at 132 W. Park
Avenue is requesting a Special Activities permit for a Biketoberfest Annual Oyster Roast with outdoor
music to be held March 5, 2004.
BACKGROUND
The event is scheduled for March 5, 2004, with the hours of operation being from 12:00p.m. to 12:00 a.m.,
outdoor entertainment will be provided from 1 :00 p.m. to 9:00 p.m.
The applicant will be responsible for any law enforcement and other expenses the City incurs during this
event. Property owners within 500- feet have been notified of the public hearing.
STAFF RECOMMENDATION
( \ The Technical Review Committee has reviewed the application and recommends approval of the special
'-' activities permit to allow Earthquake Magoon's to have a Bike Week Annual Oyster Roast with outdoor
music to be held March 5, 2004, based on the condition that the applicant fully complies with Section 21-
37 (Special Activity Requirements) of the Land Development Code and Ordinance 2002-0-04 (Noise
Ordinance).

THE FOLLOWING PERMIT CONDITIONS ARE. APPLICABLE TO EARTHQUAKE
MAGOON'S FOR March 5, 2004,
SPECIAL ACTIVITY PERMIT REQUIREMENTS
1. A Special Activitv Permit has been issued for Earthquake Magoon's Bike Week Oyster Roast
with Outdoor Music, to be held March 5, 2004. Outdoor music from 1 :00 p.rn. until 9:00 p.m. (1
day at $200.00 per day. Fee of $200.00 paid).
2. All conditions of the City's Code of Ordinances (nuisances, noise, health, sanitation and
miscellaneous offenses, unless otherwise provided for, shall be applicable during the activity.)
3. Proposed use will not result in unsafe ingress and/or egress for pedestrians or vehicles, and shall
comply with parking requirements for that use.
4.
A description of adequate provisions for parking will be supplied in advance to the Planning
Department for staff review. Applicant must obtain written permission from all property owners
granting authorization to use their property for this event, including use for parking facilities.
Applicant will supply adequate manpower for parking vehicles during the event.

5. Applicant will provide the City Clerk with a bond or an insurance policy to protect City from
liability in form and substance acceptable to City an in the amount of $200,000.00.
6. Sanitary facilities must be adequate for expected attendance and remain on site for the duration of
the event. (Including potable water, if necessary)
7. The City shall provide scheduled and unscheduled inspections prior to and/or during the special
activity by police, fire, code compliance, building and/or city administration representatives to
monitor and ensure compliance with all applicable City, County and State codes. Special activity
. permits that include outdoor entertainment may require a code compliance officer to remain on
site during the activity. The cost of said officer shall be reimbursed to the City by the
sponsor/promoter. Appropriate State agencies are responsible for the inspection of amusement
rides and public food preparation facilities.
8. The proposed use will substantially comply with the appropriate Life Safety Code and Building
Code requirements. Plans must be approved by Fire and Police Departments to provide
emergency services.
9.
No signage for advertising the event shall be placed on publicly owned rights-of-way. Any signs
used for the event must be permitted and inspected by the Building Department. All signs shall

be removed within 1 day at the end of the event.

The proposed use is limited to a specific period of time listed on the Special Activity Application,
not to exceed (10) days.
11. The proposed use shall not be permitted to operate on the same parcel owned by the same
property owner more than two (2) times per calendar year. A letter of authorization from property
owner must be supplied to the City.
12. The proposed use will operate only during the specific daily time period requested on application,
or granted by the city.
13. The proposed activity will direct on-site lighting away from adjacent parcels and roadways.
14. It shall be the responsibility of the applicant of the special activity permit to ensure the structural
integrity of all temporary structures erected for special activities. The structures are to be safe,
structurally sound and of adequate capacity to service the number of persons proposed to use the
structure and must be removed with five (5) days of completion of the special activity. The
Building Official and Fire Marshal shall verify such compliance is obtained.
No electrical cords to be placed across driveways or driving lanes.
No open flames permitted.
Fire extinguishers (minimum size 2a40bc) must have valid inspection tags and must be on site at
all times and be readily available. The quantity of fire extinguishers to be determined by the Fire
Department.
Access roadways must be maintained at a minimum width of 20 feet.
Overnight parking or camping is prohibited.
For events taking place in grass lots or fields, the vegetation must be cut prior to set up.
Individual vendors must register with the City Clerk and food vendors must have proper state
inspections. {Department of Business and Professional Regulations will do inspections (800-375-
6975), fees may be required by the State)
22. Applicant is responsible for leaving property clear of all trash, garbage and litter.
23. Any person or entity who shall conduct, operate or maintain a special activity and fails to obtain a
special activity permit shall be ordered to cease and desist and be punished by a fine of three
times the cost of the application fee as well as all associated City fees. No further special
activities shall be authorized until all penalties are current. A repeat offender shall not be eligible
for a special activity permit for a one-year period. A repeat offender is defined as a
sponsor/promoter who violates any of the conditions of the special activity permit more than one
time in a six-month period.
24. Must provide adequate parking for those in attendance.

26. No parking is permitted in FDOT Right-of-Way or in visibility triangle - see attached diagram.

A Special Activity requesting road closures will provide "road closure signs" and barricades.
28. A special activity with heavy/congested vehicular and/or pedestrian traffic will provide
"congested area ahead" signs along with and additional generated light system that will illuminate
the area of crossing/congestion.
29. The City shall monitor noise levels to determine if a public nuisance exists. The permit holder
shall comply with the City's determination. Special Activity permit is subject of revocation if
owners fail to comply with noise abatement. The noise level Ordinance 2002-0-04 will be
upheld
ADDITIONAL CONDITIONS PER FIRE MARSHAL/POLICE DEPARTMENT:

Special Activities permit for Bike Week Activities with outdoor music to be held from

BACKGROUND
The event is scheduled for March 4 through March 6, 2004, with the hours of operation being
from 1 :00 p.m. to 2:00 a.m., outdoor entertainment will be provided from 1 :00 p.m. to 9:00
p.m.

BACKGROUND
The event is scheduled for February 27 through March 7, 2004, with the hours of operation being from
9:00 a.m. to 3:00 a.m., outdoor entertainment will be provided from 1:00 p.m. to 9:00 p.m.
The applicant is requesting Boston Road be closed from 106 Boston Road to U.S. Hwy 1 on February 29,
2004 from 3:00 p.m. to 9:00 p.m., March 3,2004 from 3:00 p.m. to 9:00p.m., March 4,2004 from 3:09.:
p.m. to 9:00p.m, March 5, 2004 from 1 :00 p.m. to 9:00p.m., and March 6, 2004 from 3 :00 p.m. to 9:00p.m.

SPECIAL ACTIVITY PERMIT REQUIREMENTS
1. A Special Activitv Permit has been issued for The No-Name Saloon for Bike Week Activities
and Outdoor Music, activity to be held February 27 through March 7,2004. Outdoor music from
I :00 p.m. until 9:00 p.m. (10 days at $200.00 per day. Fee of $2.000.00 paid).
2. All conditions of the City's Code of Ordinances (nuisances, noise, health, sanitation and
miscellaneous offenses, unless otherwise provided for, shall be applicable during the activity.)
3. Proposed use will not result in unsafe ingress and/or egress for pedestrians or vehicles, and shall
comply with parking requirements for that"use.

A description of adequate provisions for parking will be supplied in advance to the Planning
Department for staff review. Applicant must obtain written permission from all property owners
granting authorization to use their property for this event, including use for parking facilities.
Applicant will supply adequate manpower for parking vehicles during the event.

5. Applicant will provide the City Clerk with a bond or an insurance policy to protect City from
liability in form and substance acceptable to City an in the amount of $200,000.00.
6. Sanitary facilities must be adequate for expected attendance and remain on site for the duration of
the event. (Including potable water, if necessary)
7. The City shall provide scheduled and unscheduled inspections prior to and/or during the special
activity by police, fire, code compliance, building and/or city administration representatives to
monitor and ensure compliance with all applicable City, County and State codes. Special activity
permits that include outdoor entertainment may require a code compliance officer to remain on
site during the activity. The cost of said officer shall be reimbursed to the City by the
sponsor/promoter. Appropriate State agencies are responsible for the inspection of amusement
rides and public food preparation facilities.

Code requirements. Plans must be approved by Fire and Police Departments to provide
emergency servIces.

Background: The current owner of this property is Volusia County. The County and Edgewater Harbor,
LLC, has agreed for the City to initiate annexation proceedings prior to closing of the subject property. 0
The property is the former site of Pre-Stress Concrete and is contiguous to the recent annexation of the
Hacienda Del Rio highway frontage parcel. A "conceptual plan" was provided at the Special Council
meeting on November 10,2003.
The Planning and Zoning Board voted to send a favorable recommendation to City Council for the annexation
at the regular meeting of March 12,2003.
Land Use Compatibility: The proposed use will provide a suitable transition and buffer between the
residential and industrial uses.
Adequate Public Facilities: This site is within the City retail water and sewer service area and has access to
US Highway 1. A preliminary concurrency assessment shows no adverse effects on the City's Level of Service
standards. A detailed concurrency analysis shall precede construction approval.
Natural Environment: Prior to any development, a detailed environmental assessment must be provided.
The developer must also obtain all required State, County, and City permits prior to any construction.
Other Matters: A Comprehensive Plan Land Use Amendment and Rezoning will occur at a later date.
STAFF RECOMMENDATION:
Staff recommends approval of Ordinance No. 2004-0-06 for the annexation of 60:!: acres of property

THE ANNEXATION AGREEMENT; AMENDING THE
DESCRIPTION OF CITY OF EDGEW ATER CORPORATE
LIMITS; PROVIDING FOR FILING WITH THE CLERK OF
THE CIRCUIT COURT, VOLUSIACOUNTY, THE VOLUSIA
COUNTY PROPERTY APPRAISER AND THE

WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. On May 5,2003, the City of Edge water adopted Ordinance #2003-0-07 annexing the
60 acres located at 4115 South U. S. Highway #1. The effective date of the ordinance was to be
upon the date of closing and recording of documents reflecting the County of V olusia deeded the
property to Seashore Marina, LLC.
2. Due to the County of V olusia and Seashore Marina, LLC not completing the closing
on the property, the property was never annexed into the City.
3. On November 6,2003, the County of V olusia and City of Edge water entered into an
Agreement to Sell and Purchase the 60 acre parcel. On

City entered into an Assignment of Agreement to Sell and Purchase the subject property with

Edgewater Harbor, LLC.
4. The County and Edgewater Harbor, LLC has agreed for the City to initiate annexation
proceedings prior to closing of the subject property.
5. The contract purchaser has voluntarily petitioned the City of Edgewater for
annexation pursuant to Section 171.044, Florida Statutes.
6. The property is contiguous to the City's boundaries and the conditions for annexation
and the economics thereof are satisfactory.
7. The boundaries of voting District 4 of the City of Edgewater are hereby designated
to include the property described herein.
8. During the Planning and Zoning Board meeting on March 12, 2003, the Board
recommended by a vote of 7 to 0 that the property be annexed into the City.
NOW, THEREFORE, BE IT ENACTED by the People ofthe City of Edge water, Florida:
PART A.
ANNEXATION OF CERTAIN REAL PROPERTY INTO THE CITY OF
EDGEW ATER, FLORIDA.
1.
Pursuant to Section 171.044, Florida Statutes, that certain real property described in
Exhibit "A" and depicted in the map identified as Exhibit "B", which are attached hereto and
incorporated by reference, is hereby annexed into and made part of the City of Edge water, Florida,
and shall be subject to the jurisdiction, obligations, benefits and privileges of the municipality and
to the terms ofthat certain Annexation Agreement with Edgewater Harbor, LLC, which is attached
hereto and incorporated by reference as Exhibit "C".
2. The boundaries ofthe City of Edge water are hereby redefined to include the property

V olusia County Clerk of the Circuit Court, the V olusia County Property Appraiser, the V olusia
County Manager, the Mapping Division of the V olusia County Growth Management Department,
and the Department of State.
PART B.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance,
are hereby superseded by this ordinance to the extent of such conflict.
PART C.
SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or declared to be unconstitutional,
inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or
circumstances, such holding shall not affect its applicability to any other person, property, or
circumstance.

Recommendation of Bid Award,
Bid #03-ES-O 1 Terra Mar Village Utility System Improvements
BACKGROUND:
When the Terra Mar Utility System was purchased by the City of
Edgewater, it was with the understanding certain improvements would be
undertaken to bring the system into compliance with City standards.
These initial improvements are to be paid by the existing property
owners/residents of Terra Mar through a monthly charge on their utility
bills. Improvements include repairs to sewer lines, abandonment and
demolition of the existing water treatment and wastewater treatment
plants, main lift station upgrade, new force main, and water system
improvements for fire protection.
STAFF RECOMMENDATION:
The lowest proposal for Bid #03-ES-Ol was from McMahan
Construction in the amount of $710,036. Due to the bid
exceeding the budget amount for the project, Change Order No. 1
for a contract reduction of $272,536 is recommended which
would bring the revised contract amount to $437,500. Staff
recommends award of bid and approval of change order no. 1.
The deleted items will not cause a significant reduction in the
level of service to the residents.
ACTION REOUESTED:
A motion to award bid #03-ES-Ol to McMahan Construction as low
qualified bidder for the amount of$710, 036, and to approve change order
no. 1 to the contract reducing the contract amount by $272,536, resulting
in an approved project cost for the Terra Mar Village Utility System
Improvement Project of $437,500.

We have reviewed the bids receivedby the City of Edgewater on December 9, 2003. .
The lowest proposal received was from McMahan Construction in the amount of
$710;036. They are well qualified for thistype of work and we recommend award.
The total bid amount exceeded the project budget. Representatives of the City and
Quentin Hampton Associates met with the Contractor in an effort to reduce the project 0
scope and cost. It was determined that three items should be deleted from the scope
as follows:
1. Red Bass Pump Station
2. Rehabilitation of 6" gravity sewer.
3. Water service meter replacement.
. Deletion of those items would reduce the Contract amount by $272,536. Thus, the
Contract amount after Change Order. No. 1 would be $437 ,500. If you have any

Proposal for Transportation Impact Fee Study
B & H Consultants, Inc.
BACKGROUND:
In order for the City Council to levy a fair and equitable Transportation
Impact Fee to address expansion of the City road system, it is necessary to
conduct a detailed study by experts in Transportation analysis. B & H
Consultants, Inc. in cooperation with Leftwich Consulting Engineers, Inc.,
proposes to prepare for the City of Edge water, a Transportation Impact
Fee schedule, an associated draft enacting ordinance, and documentation
of proposed mechanisms for the determination of alternative
transportation impact fees and transportation impact fee credits. B & H
Consultants, Inc. has performed rate analysis for the City and has been
successful in securing several grants so they are familiar with existing
infrastructure, budget, and accounting concerns within the City.
STAFF RECOMMENDATION:
Staff recommends approval of the proposal from B & H
Consultants, Inc. to prepare a Transportation Impact Fee Study
as outlined in the attached proposal for a not to exceed amount of
$44,075.00. Staff also recommends this contract be made
available to other governmental entities to piggyback for their
individual transportation analysis needs.
ACTION REQUESTED:
A motion to accept the proposal by B & H Consultants, Inc. to perform a
Transportation Impact Fee Study for the City of Edgewater at a not to
exceed cost of $44,075.00 and to authorize the Mayor or City Manager to
execute the necessary contract documents on behalf of the City and to
allow other governmental entities to piggyback on the contract for their
transportation analysis needs.

Impact Fee Study for the City of Edgewater.

Engineers, Inc., a traffic and transportation specialty firm located in Orlando. B&H Consultants,
Inc. will be the lead consultant on this project, and James W. Shira, P.E. will be the project

The attached Scope of Services provides a detailed description of the services to be provided, and
we anticipate that the tasks listed in the Scope of Services can be completed within six months of
notice to proceed, barring complications beyond our control.
The attached Estimate of Fee by Task describes the approximate distribution of costs over the
various tasks involved in the study. This Estimate is exclusive of reimbursable expenses such as
copying, postage, additional traffic counts, and other typical reimbursable expenses.
As noted on the Estimate, the total fee for this project is $44,075.00 (exclusive of reimbursable
costs) and includes the work of both B&H Consultants, Inc. and Leftwich Consulting Engineers,
Inc.

transportation impact fees and transportation impact fee credits. This work will be
accomplished as a series of tasks as described below.
Task 1. Data Collection
· The development of a proposed traffic impact fee for the City of Edgewater will 0
require that the Consultant examine existing traffic-related data from several
existing City, County and FDOT sources.
· Consultant will contact and/or meet, as appropriate, with City, County and FDOT
personnel to determine the availability and applicability of existing traffic counts,
socioeconomic data, traffic analysis zone (T AZ) boundaries, existing and
projected land uses, and other data relative to the development of a traffic impact
fee.
· Consultant will hold discussions with City, County and FDOT representatives
regarding current and proposed road improvement projects that might affect the
Edgewater Transportation Impact Fee calculation.

· Consultant will collect current and projected socioeconomic and land use data
from Volusia County and the City of Edgewater to be used in the traffic modeling
process.
· Consultant will examine traffic count data received from Volusia County to
determine whether any road segments specifically referred to in the City of
Edgewater Comprehensive Plan are missing from the V olusia County data set. If
any such missing road segments are identified, Consultant will arrange for
additional traffic counts to be performed on those segments. The cost of any such
additional traffic counts will be considered a cost reimbursable to Consultant.
Task 2. Initial Analvsis
· Consultant will prepare a map showing existing Volusia County traffic analysis
zones (T AZ's) in the Edgewater area, and will meet with City staff to review this
map.
· Based on information supplied by the City, Consultant will determine if existing
or proposed developments warrant revision of the socioeconomic data within the
V olusia County T AZ' s. If such revision is warranted, Consultant will make the
appropriate revisions to the V olusia County T AZ' s to create the necessary
Edgewater-specific T AZ' s.
· Using existing V olusia County traffic counts, any additional traffic counts as
described in Task 1 and existing Volusia County socioeconomic data, Consultant
will prepare a base year traffic model.
· Consultant will modify the base year model to add road segments that are
included in the transportation element of the Edgewater Comprehensive Plan but
that are not included in the Vol usia County data.

· Based on this revised data, the model will be validated within acceptable FDOT
modeling standards, based on two-way daily volumes. Consultant will provide a
tabulation of base year traffic volumes for each road segment modeled.

Task 3. Analvsis of Future Conditions
· Consultant will prepare three future year models. Models will be run for the years
2015, 2020 and 2025. For the development of each of the future year models,
Consultant will use future year socioeconomic data available from Volusia
County.
· For each road segment, traffic volumes will be presented in tabular format for
each of the three future years. A summary table showing the deficiencies in each
future year will be provided.
· Consultant will use the data resulting from these models to determine the need for 0
construction of future roadway improvements over the course of the study period.
Task 4. Development of Cost Estimates for Improvements
· For each of the projected required improvements, Consultant will review existing
cost data from City, Volusia County and FDOT sources to derive an estimate of
the cost of those improvements. The estimate of construction costs will include
the costs of right-of-way acquisition, design and permitting and construction.
· A comparison of the resulting estimated costs with the cost of completed projects
in the Volusia County area will be prepared to confirm the reasonableness of the
estimated costs.
· Based on this effort, a unit cost will be developed for use in the determination of
an appropriate transportation impact fee for the City.

Task 50 Determination of Recommended Transportation Impact Fee
. Using data from the analysis of required future year improvements and the
proposed unit cost of construction of those improvements, Consultant will
develop a table of recommended transportation impact fees for various types of
development.
. The various development types will include residential, commercial and
industrial, and will be classified in accordance with categories recognized by the
Institute of Transportation Engineers.
· Categories currently used by Volusia County will be used as a basis, and
additional categories will be added as needed based on discussion with City staff.
Task 60 Alternative Transportation Impact Fee Studies
· Consultant will prepare a recommended methodology for use by developers
wishing to present alternative impact fee studies to the City for consideration.
This methodology will be designed to provide developers with a means by which
alternative impact fees may be calculated based on site-specific or project-specific
conditions.
Task 70 Transportation Impact Fee Credits
· Consultant will prepare a recommended methodology for the calculation of
transportation impact fee credits. Factors to be considered in the credit
methodology will include the contribution of land or funds, as well as the
construction of on-site and/or off-site improvements by a developer.
Task 8. Enactine Ordinance
· Consultant will prepare a draft of a proposed enacting ordinance for review by the
City's legal counsel. This draft ordinance will reference exhibits and tables which
will provide data regarding proposed transportation impact fees for the various
categories of development referred to in Task 5 above.
Task 9. Final Report
· Consultant will prepare ten copies of a final report incorporating the data and
analysis of the preceding Tasks and will deliver the report to City staff.
Consultant will be available for one meeting with the City Council to explain the
results of the transportation impact fee study and the contents of the final report.
Additional copies of the final report will be made available as requested, as a
reimbursable expense.

Commercial Solid Waste Pickup
History
The City of Edgewater currently has no control over commercial (dumpster) solid waste service.
There are approximately eleven (11) commercial providers that operate within the City. Due to the
number of providers, the City does not have consistent commercial monthly rates, lacks uniform
service, has increased traffic on our local roads, has no control concerning future service and does
not receive any revenue from haulers operating in the City.
Most governmental entities offer an exclusive franchise to a single solid waste service provider.
This is the same principal as our existing recycling service. The City would contract with one (1)
commercial solid waste provider for a fixed rate. The City would bill the commercial customer as
part of the water/sewer bill (same as residential recycling). The City receives monthly revenue from
the commercial customer, pays the private commercial hauler and retains a franchise fee. The
retained franchise fee is commonly used to offset the cost of maintenance associated with the service
such as resurfacing oflocal roads due to truck traffic or beautification efforts for improved property
values.
There are approximately 1,000 commercial solid waste accounts within the City. Over 90% of the
existing accounts are serviced by Waste Management and the remaining accounts are divided among
ten (10) other private haulers. City staff currently provides solid waste services to small commercial
accounts (those without dumpsters) and are treated as residential accounts.
Legal Issues
Chapter 166 of the Florida Statutes defines "Municipal Home Rule" and enables cities to
provide/render municipal services. Further, Chapter 166.021(6) provides that a city "may require
that any person within a municipality demonstrate the existence of some arrangement or contract by
which such person will dispose of solid waste in a manner consistent with ordinances of the county
or municipality or state or federal law." Thus by statute, cities are authorized to provide or contract
for solid waste services.
A franchise agreement is a contract with a city by which the franchise grantee is licensed to conduct
a business within a particular area. Generally, a city can contract with one or more businesses for
the collection and removal of solid waste and may approve an exclusive privilege to a franchise
grantee for a specific time. The authority for a city to grant exclusive franchise for solid waste
removal (residential and commercial) has be,en reviewed and upheld by the Florida Court System.
The procedures to establish an exclusive franchise agreement include:
1. Conduct a public hearing with at least 45 days written notice of the hearing
to all private companies that provide service within the jurisdiction.
2.
Take procedures to implement measures necessary to provide the solid waste

Provide three (3) years notice to private haulers before the service of the
private hauler are displaced.
Summary
The City must conduct a public hearing after 45-days notice to all private haulers. All private
haulers must be given a three-year notice of displacement. The City can enter into a franchise
agreement with one or more private haulers to provide commercial solid waste service.
Direction Requested
Determine if City Council is interested in entering into an exclusive solid waste franchise agreement
for commercial solid waste service.
