The permit request is for 25 years and would continue to allow driving on a segment of V olusia County public beaches. The New Smyrna City Commission is strongly in favor of allowing vehicles to remain on the beach for reasons explained in the letter. Mayor Vandergrifft has asked that our City pass a resolution supporting the continuation of beach driving on the beaches of Vol usia County. Attached is Resolution 2004-R- 07 showing our support in keeping beach driving on the beaches of Vol usia County. The City Commission of the City of New Smyrna Beach is strongly in favor of allowing vehicles to remain on the beach. The City believes that it is in the general public's interest and welfare to preserve the level of beach access that currently exists in New Smyrna Beach and throughout Volusia County. Removing vehicles from the beach will deprive the majority of local and county residents and taxpayers from adequately accessing the public beach and waterways. Families, fishermen, surfers and other beach-goors will be restricted to such a small portion of the beach that the remainder will essentially become a private beach for the benefit of a few. Handicapped individuals will no longer be able to traverse the soft sand with the same ease 0 in order to enjoy the beach enviromnent and handicapped parking spaces near beach ramps are inadequate to meet their needs. Should vehicles be prohibited from driving on the beach, and since few parking lots exist that could accommodate the displaced cars, residents of beachside neighborhoods will experience a heavy increase in traffic volume and a proliferation of vehicles parking in right-of-ways and yards. Visitors from other areas of the County will not have enough parking places to provide them with the same access rights they currently enjoy. These occurrences will detract from the charm of the community, hurt the quality of life of New Smyrna Beach citizens, and ultimately decrease the overall value of the surrounding properties. It is for these reasons and others that the City Commission of New Smyrna Beach urges you to ensure the majority of countywide residents maintain their ability to access the public beach. Help preserve the charm of our seaside community by supporting Volusia County's application for a i5-year Incidental Take Permit and by passing a Resolution supporting continued beach driving on our public beaches. BACKGROUND: On September 10,2003, the generator portion of the auxiliary power unit at the P ABS failed. The unit is 26 years old and neither the model nor the KW rating is currently manufactured and parts are not available. The most economical unit available that will meet the performance requirements and is compatible with the old unill enclosure space is a 200 KW Olympian Diesel Generator available by piggybacking a St. Augustine Airport Authority bid. I have also attached a report of all recorded noise readings and known complaints received by the Code Compliance Division during this period. Code staff did issue one citation to No Name Saloon Uregarding noise restrictions. The staff also contacted all known complaints that did not remain anonymous to assure them that their complaints have been acknowledged. Overall, neither the fire division nor the code division experienced any major incidents that completely overwhelmed available resources. A special activities permit was issued to No Name Saloon for February 27~March 7. Code Compliance Officers are on duty for the duration of the outside entertainment portion of the special events from 1 :00 p.m. until 9:30 p.m. and noise readings are taken every hour. In the first three days of Bike Week {February 2ih, 28th and 29th} fifteen noise complaints from various Edgewater residence have been lodge against No Name Saloon. During the hours of 1 :00 p.m. to 9:30 p.m. the Code Officer on duty had gone out and taken readings when complaints were received and contacted the management of No Name Saloon when the noise level readings are not in compliance. On these occasions Tonya or Mad Dog would advise the Code Compliance Officer on duty the music would be turned down. Noise level readings were taken after each contact and were in compliance. After the hours of9:30 p.m. Edgewater Police Department had responded to No Name Saloon in reference to noise complaints and has had to make contact with the management of No Name Saloon reference to noise complaints.
