Background
The property owners are requesting the rezoning with the intent to create two (2) single family building lots with a
minimum width of 80 feet in lieu of the 100 feet required lot width required for the R-l zoning district.

City Council voted 5-0 to approve the first reading for the rezoning at their regular meeting on September 13,
2004.

Land Use Compatibility
The surrounding usage is vacant and single family residential. This rezoning would not adversely affect the land
use compatibility in the vicinity. 0
Adequate Public Facilities
City water and sewer is available to this property. The proposed property has frontage on Alamanda Drive and
would have access if the requested planting buffer abandonment is granted.
Consistency with Comprehensive Plan
There are no concurrency issues with the proposed rezoning and minor lot split. The proposed rezoning and
subsequent lot split will remain consistent with the density requirements for the Low Density Residential Future
Land Use designation.
Other Matters
Requests for abandonment of the six-foot planting buffer and for a minor lot split will be considered at a later date.
At their regular meeting held on August I 1, 2004, the Planning and Zoning Board voted 5-0 to send a favorable
recommendation to City Council for the rezoning request with the listed conditions.
STAFF RECOMMENDATION
Staff recommends approval of Ordinance No. 2004-0-27, to amend the Official Zoning Map from R-1 (Single
Family Residential) to R-2 (Single Family Residential) for .55:i: acres of property located at 2751 Alamanda

PROVIDING FOR CONFLICTING PROVISIONS,
SEVERABILITY AND APPLICABILITY; PROVIDING FOR
AN EFFECTIVE DATE, RECORDING AND ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. Judson 1. Woods, Jr., P.A. (Agent) has submitted an application on behalf of Larry
D. and Nancy H. Carson who are the owners of certain real property located at 2751 Alamanda

Land Use Compatibility: The proposed use of residential is compatible with the surrounding existing
usage.
Adequate Public Facilities: There is access to Old Mission Road, Massey Road, and Morrell Rd. via
Gateway Dr. Currently this property has access to City water and/or sewer service, due to the Western
Reserve utility expansion currently being installed in order to serve the Coral Trace Subdivision. Once
that is completed, there will be an eight-inch force main at Massey Road and Gateway Drive, which can
be utilized to serve this property, contingent upon clearance by the Department of Environmental
Protection. The closest water line will be at the intersection of Massey Road and Gateway Drive,
contingent upon being cleared for service by the Department of Health.
Natural Environment: Soil types on this property include Tuscawilla Fine Sand, Chobee Fine Sandy
Loam, and Wabasso Fine Sand. On-site vegetation includes Temperate Hammocks, Mixed Wetland
Hardwoods, and Wet Prairie.
Consistency with Comprehensive Plan: Annexation of this property is consistent with the City of
Edgewater Comprehensive Plan Future Land Use Element's Projected Land Use Needs - Future

ANNEXATION OF CERTAIN REAL PROPERTY INTO THE
CITY OF EDGEW A TER, FLORIDA.
1. Pursuant to Section 171.044, Florida Statutes, that certain real property described in
Exhibit "A" and depicted in the map identified as Exhibit "B", which are attached hereto and
incorporated by reference, is hereby annexed into and made part ofthe City of Edgewater, Florida,
and shall be subject to the jurisdiction, obligations, benefits and privileges ofthe municipality.
2. The boundaries ofthe City of Edge water are hereby redefined to include the property
described herein and depicted in the map identified as Exhibit "B".
3.
Pursuant to Section 2.01 of the Charter of the City of Edge water, Florida, that certain
document entitled "Description of City of Edgewater Corporate Limits" shall be amended
accordingly.
4. Within seven (7) days after adoption, copies of this ordinance shall be filed with the
Volusia County Clerk of the Circuit Court, the Volusia County Property Appraiser, the Volusia
County Manager, the Mapping Division of the Volusia County Growth Management Department,
and the Department of State.

EFFECTIVE DATE.
This ordinance shall take effect upon adoption and recording of deeds transferring property

WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
WHEREAS, the City acknowledges that an Amended Personnel Policy and Procedure
Manual was adopted pursuant to Resolution No. 99-R-19 on November 15, 1999. Modifications to
the Policy were adopted pursuant to Resolution No. 2000-R-18 on December 4,2000; by Resolution
No. 200l-R-06 on April 16, 2001; and by Resolution No. 2002-R-23 on November 5, 2003.
WHEREAS, upon review ofthe current manual, the Fire/Rescue Management Committee,
Personnel Director and the City Manager recommend modifications to Section VII (Classification
and Compensation) and Section X (Education and Training); and
WHEREAS, the City Council and Staff have reviewed and determined the need to modify
certain sections in an effort to bring consistency to the policies and procedures to establish a special
project stipend and an incentive program for the Fire/Rescue personnel.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Edgewater, Florida:

2. Pay increases are not automatic, but may be achieved through performance
evaluations, promotion, reclassification, or pay range adjustment. In the event an
employee, through education and/or training, increases his value to the City, the
Department Director and the Personnel Director may make a recommendation for an 0
increase in that employee's salary, and upon approval of the City Manager, the employee's
salary may be adjusted.
3. The City Manager shall have final authority to place approved position within the
Classification Plan.
E. Changes to the Classification Plan must recommended by the City Manager and be approved by
the City Council.
7.02 CITY SERVICE
A. Continuous Service.
1. An employee's continuous service date is established as the most recent date of hire and
cannot precede the date the employee reported for and began work as a full time employee.
Paid absences do not affect the date of continuous service.
2. The continuous service date for an employee who was initially hired as a temporary or part
time employee and becomes a regular employee is the date of full time regular hire.
3. Authorized unpaid leaves of absence for a period of thirty (30) days or more and layoff as
provided in these policies and procedures are not considered a break in continuous service,
but do affect the employee's benefit date.
7.03 PAY ADMINISTRATION
An employee shall be paid at the rate of pay specified in the approved Compensation Plan.

A. Appointment and Starting Rate Guidelines.
1. Generally, a new employee will be hired at the minimum rate for a position. This rate reflects
the "market place" value of the position based upon the minimum qualifications needed to
perform the work.
2. Hiring above the minimum salary may be authorized by the City Manager, if the applicant's
training, experience or other qualifications are above those required for the position. Hiring
may be approved at a rate within the range established for the position, by the City Manager.
The Personnel Director can authorize a new hire up to 50% above the minimum of the
classification. The Department Director can authorize a new hire up to 25% above the
minimum of the classification.
3. Fire/Rescue personnel who perfonn specific duties related to time-consuminQ special
projects may be paid a Fiftv ($50.00) Dollar month Iv special project stipend. These
projects must be established bv the Fire Chief and approved bv the City Manaaer as
Qualified extra duties deservina stipend pay. One individual will be assianed bvthe Fire
Chief to one specific project.
B. Promotion.
A promotion is defined as the advancement of an employee from the current classification
to another classification that is higher. When promoted an employee retains his original
anniversary/benefit date.

EDUCATIONAL INCENTIVES: These courses are not considered a condition of employment but as a
contribution to improve efficiency, work quality and/or job knowledge. The courses also are not reimbursable by
State incentive funds.
Fire Department Personnel who receive certification in the following courses shall be eligible to receive
monthly educational incentive pay. The appropriate and/or adjusted educational incentive pay shall
commence on the first pay period of the month following notification to the Personnel Department that the
employee has successfully completed the course. Proper notification shall be a copy of the transcript and
the certificate of completion of degree.

Revision of the City of Edgewater Position Classification Salary Ranges.
BACKGROUND:
1) The minimum and maximum level of the City's Position Classification Salary Ranges are
increased by 2.3% to keep current with the year's Consumer Price Index. In the future,
employees who have reached the maximum of their classification range will receive this pay
increase. (The CPI)
2) Title changes and new titles developed have been added to the classification bands.
3) Separate salary ranges have been prepared for all Public Safety Personnel to equate to the
number of hours worked by them per year.
STAFF RECOMMENDATION:
Staff recommends the City Council approve these revisions to the City's Position Classification
Salary Ranges.

BACKGROUND:
In accordance with Florida statutory requirements, the City of Edgewater advertised a Notice of
Public Hearing informing the public/citizens of the Special MeetinglPublic Hearing regarding the
final millage rate and budget for the fiscal year 2004 - 2005.
On June 23, 2004, Council conducted a work session to review the preliminary budget for Fiscal
Year 2004-2005. The tentative budget is attached with all changes requested by Council at the work
seSSIOn.
On July 19, 2004, Council approved advertising a millage rate of 6.45 mills per $1,000.00 of
assessed taxable value. This millage rate represents a 12 mill roll back over the previous millage rate
approved for fiscal year 2003-2004.
STAFF RECOMMENDATION:
Staff respectfully recommends that Council consider approval of Ordinance No. 2004-0-28 and
Ordinance No. 2004-0-29 which adopts the final millage rate and budget for fiscal year 2004 _ 2005.

3. The provisions of Chapter 200 ofthe Florida Statutes prescribing the method of fixing

SECTION 1. Authority. The City Council of the City of Edgewater has the authority to

adopt this Ordinance pursuant to Article VIII of the Constitution of the State of Florida and Chapters 0
166 and 200, Florida Statutes.
SECTION 2. Millage Levy. The City Council of the City of Edgewater hereby adopts,
establishes and levies a millage rate for ad valorem taxation of real and business personal property
within the City of Edgewater, Florida, for the fiscal year beginning October 1, 2004 and ending
September 30, 2005, at the rate of $6.45 per $1,000 of assessed valuation.
SECTION 3. Percentage Increase of Rolled-Back Rate. The millage rate, as herein levied,
exceeds the rolled-back rate computed pursuant to Section 200.065, Florida Statutes, by 2.59%, such
percentage increase being characterized as the percentage increase in property taxes adopted by the
City Council of the City of Edgewater.
SECTION 4. Millage Adjustment. The City Council hereby authorizes the City Manager
to administratively provide the Property Appraiser with the millage adjustment, pursuant to his report 0
of the aggregate change in the assessment roll as provided for by Section 200.065(5), Florida
Statutes.
SECTION 5. Collection of Taxes. The tax shall be collected by the Volusia County Tax
Collector, subject to discounts prescribed by law, and distributed to the City in accordance with
Florida law.
SECTION 6. Severability. If any section, subsection, sentence, clause, phrase or portion
of this Ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portion hereto.
