ORDINANCE NO. 2001-0-102
AN ORDINANCE OF THE CITY OF EDGEWATER,
FLORIDA, REDISTRICTING THE CITY OF EDGEWATER
FOR THE PURPOSE OF ELECTING CITY COUNCIL
MEMBERS; PROVIDING FOR CONFLICTING PROVISIONS,
SEVERABILITY AND APPLICABILITY; PROVIDING FOR
AN EFFECTIVE DATE AND FOR ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. Article III of the Charter of the City of Edgewater establishes four (4) voting districts
for the purpose of electing the four (4) members of the City Council.
2. Article III ofthe Charter of the City of Edgewaterrequires that within six (6) months
after official publication of the decennial census, the City Council shall by ordinance adjust the
district boundaries as required to provide for four (4) districts as nearly equal in population as
possible.
3. The City was redistricted after the 1980 census pursuant to Ordinance No. 92-0-10
and was redistricted after the 1990 census pursuant to Ordinance No. 92-0-90.
4. The Planning Department, utilizing the 2000 decennial census, prepared a
redistricting report dated November 27,2001 which sets forth the recommended new voting district
boundaries (the "Redistricting Report").
5. For the purpose of carrying out the provisions of Article III of the Charter, the City
Council of the City of Edgewater desires to change the voting district boundaries as recommended
in the Redistricting Report.

NOW, THEREFORE, BE IT ENACTED by the City Council of the City of Edgewater,
Florida:
SECTION 1. Authority. The City Council of Edgewater has the authority to adopt this
Ordinance pursuant to Article VIII of the Constitution of the State of Florida, Chapter 166, Florida
Statutes and Article III of the Charter of the City of Edgewater.
SECTION 2. Establishment of District Boundaries. The four (4) voting districts of
the City of Edgewater are hereby established as follows:

Voting District 1 shall include that portion of the City generally described within the
following boundaries:
East of Tatum Boulevard, South of 10th Street East to the Easterly City limits. South
to Rhode Island Street, thence West to Evergreen Drive, thence South to Eaton Road,
thence West to Dayton Street, thence South to 16th Street, thence West to Orange
Tree Drive, thence North to 14th Street, thence West to Willow Oak Drive. Including
all properties West of Willow Oak Drive and East ofthe Westerly City limits South
to State Road #442 and all properties North of 14th Street to the Westerly City limits
back to the Point of Beginning East of Tatum Boulevard. See Exhibit "A" - Voting
District Map for further detail.

Eaton Road, South of Rhode Island Street to the Easterly City limits. South to the
Southerly line of Friendly Shores Mobile Home Park, North along U. S. Highway #1
to Pine Avenue, thence West to Coco Palm Drive, thence South to 20th Street, thence
West to Guava Drive, thence South to 23rd Street, thence West to Lime Tree Drive,
thence South to 25th Street, thence West to Sabal Palm Drive, thence North to 23rd
Street, thence West to Silver Palm Drive, thence North to the City limits. Including
all properties located within the City limits West of Air Park Road East along State
Road #442 to the Point of Beginning. See Exhibit "A" - Voting District Map for
further detail.

V oting District 3 shall include that portion of the City generally described within the
following boundaries:
All properties South of the Southerly line of Voting District 2, West from Silver
Palm Drive to the Easterly City limits with a Southern boundary as follows:
The Northern boundary line of Edge water Landings Subdivision from
the Easterly City limits West to U. S. Highway #1, thence South
along U. S. Highway #1 to Joseph Avenue, thence West to the City
limits. Thence North-Northwest along said City limits to a point
approximately 600' West ofU. S. Highway #1, thence West along
said City limit line approximately 1 ,000' to a point approximately 300'

East of Glenwood Drive, thence South along said City limit line
approximately 1,300' to 27th Street, thence West to Evergreen Drive,
thence South to 28th Street, thence West to Fern Palm Drive, thence
North to 27th Street, thence West to Guava Drive, thence North to 26th
Street, thence West to the FEC right-of-way, thence South to 27th
Street, thence West to Lime Tree Drive, thence South to 30th Street,
thence West to Silver Palm Drive, thence North to the Southern
boundary of Voting District 2 at Silver Palm Drive and 23rd Street.

V oting District 4 shall include that portion of the City generally described within the
following boundaries:
All properties from the Southern boundary of V oting District 3 to the Southerly City
limits, including properties East of Silver Palm Drive and West of the Western City
limits North to the City limits that lie North of22nd Street. See Exhibit "A" - Voting
District Map for further detail.
SECTION 3. Voting District Map.
The voting district map of the City of Edgewater
shall be placed in a conspicuous location within City Hall depicting the voting districts described
in this ordinance. A copy of the voting district map is attached hereto as Exhibit "A" and
incorporated herein by this reference.
SECTION 4. Conflicting Provisions.

including Ordinance No. 82-0-10 and Ordinance No. 92-0-90, are hereby superseded by this
ordinance to the extent of such conflict.
SECTION 5. Severability and Applicability.
If any portion of this ordinance is for any
reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the
remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such holding shall not affect its applicability
to any other person, property, or circumstance.
SECTION 6. Effective Date.
This Ordinance shall become effective immediately
upon passage and adoption, or take effect on December 17, 2001.
SECTION 7. Adoption. After Motion by Councilman Vincenzi and Second by
Councilwoman Lichter, the vote on the first reading of this ordinance held on December 3, 2001,
was as follows:
