AN ORDINANCE CHANGING THE FUTURE LAND USE
DESIGNATION OF THE EDGEWATER COMPREHENSIVE
PLAN FROM COMMERCIAL TO INDUSTRIAL FOR
APPROXIMATELY 52 ACRES OF PROPERTY LOCATED ON
GUAVA AND HIBISCUS DRIVES, NORTH AND SOUTH OF
STATE ROAD 442, ABUTTING THE EAST COAST
RAILROAD IN THE FLORIDA SHORES SUBDIVISION;
PROVIDING FINDINGS OF CONSISTENCY; AUTHORIZING
THE AMENDMENT OF THE FUTURE LAND USE MAP;
PROVIDING FOR FILING WITH THE DEPARTMENT OF
COMMUNITY AFFAIRS; PROVIDING FOR CONFLICTING
PROVISIONS, SEVERABILITY AND APPLICABILITY;
PROVIDING FOR AN EFFECTIVE DATE AND FOR
ADOPTION.
WHEREAS, the city Council of the City of Edgewater, Florida,
has made the following determinations:
1. The character of the existing development along certain
portions of Hibiscus and Guava Drives is industrial in nature. It
is appropriate that infill uses established in these areas develop
as industrial uses rather than commercial.
2. On September 28, 1994, the Land Development and
Regulatory Agency considered the proposed change in Future Land Use
designation and by a vote of 6 to 0 recommended approval. On July
26, 1995, the LDRA reconfirmed their previous approval of the
proposed change.
3. On July 1, 1996, the City Council considered on first
reading and held the first required public hearing to consider the
proposed change in the Future Land Use designation. Pursuant to
section 163.3184(15) (b), Florida Statutes, on June 25, 1996, the
notice of such hearing was published in The Daily Journal of the
News-Journal.
4. Pursuant to Section 163.3187(15) (b), Florida Statutes, on
, the city Council held the second required public
hearing to consider the change in the Future Land Use designation
after publishing notice of such hearing in The Daily Journal of the
News-Journal on
