07-13-2011 - Special CITY COUNCIL OF EDGEWATER SPECIAL MEETING JULY 13, 2011 7:57 P.M. COUNCIL CHAMBERS MINUTES 1.CALL TO ORDER Mayor Thomas called the Special Meeting to order at 7:57 p.m. in the Council Chambers. ROLL CALL Mayor Michael Thomas Present Councilman Justin Kennedy Present Councilwoman Gigi Bennington Absent Councilman Michael Ignasiak Present Councilman Ted Cooper Absent City Manager Tracey Barlow Present City Clerk Bonnie Wenzel Present City Attorney Carolyn Ansay Present INVOCATION, PLEDGE OF ALLEGIANCE Having done the invocation and pledge of allegiance at the CRA Workshop that was held prior to this meeting, Mayor Thomas skipped this item. 2.OTHER BUSINESS A.Amending the Agreement for Legal Services between the City and Doran, Sims, Wolfe, Ansay & Kundid City Attorney Ansay informed Council she had been offered a position as General Counsel to the South Florida Water Management District and st was accepting that position effective August 1. She recommended the City continue to use her firm to represent the City on a go forward basis. The contract they have merely lists her as the City Attorney and the other folks as Assistant City Attorneys. She recommended they move Aaron Wolfe’s name up as the City Attorney on a go forward basis. She would continue to be available into the future in terms of talking with the folks in her firm as well as City Manager Barlow. She wants to do everything she can to assist in the transition, which she felt would go smoothly. She referred to Section 4-11 of the City Charter, containing the residency requirements for the City Attorney, which were waived for her and could be waived for Mr. Wolfe as they are authorized to do so if it is in the best interest of the City, which she felt it was given the fact there was so much institutional 1 Council Special Meeting July 13, 2011 knowledge with her firm on the issues of the City and the people with the City. Mayor Thomas stated it had been a privilege and honor working with City Attorney Ansay. He felt she represented herself, her firm and the citizens well. He appreciated the advice she had given him which had helped him and the City. Councilman Ignasiak congratulated City Attorney Ansay. She has defended the City’s interest very well. They will miss her. He hoped counsel coming behind her was as just good as she was. He looked forward to a very promising relationship. Councilman Kennedy wished City Attorney good luck and all the best. City Manager Barlow commented on City Attorney Ansay and her staff being instrumental in helping him with the transition from Fire Chief to City Manager. He expressed his appreciation to her. City Attorney Ansay introduced Aaron Wolfe, Ted Doran, Karon Lavassaur, and Mike Ciocchetti, who have all been involved in the dealings with the City in her tenure here over the last four and a half years. City Manager Barlow stated City Attorney Ansay had presented the marked up version of the amended agreement. It was staff’s recommendation that Council approve those amendments and appoint Aaron R. Wolfe as the primary. Councilman Ignasiak made a motion to approve the amending of the Agreement for Legal Services between the City and Doran, Sims, Wolfe, Ansay and Kundid, second by Councilman Kennedy . The MOTION CARRIED 3-0 . City Manager Barlow informed Council that City Clerk Wenzel and Paralegal Robin Matusick had put together a small reception as kind of a last opportunity to break bread with Carolyn as she rides into the sunset going south. City Manager Barlow reminded Council that Monday night at 5:00 p.m. was their first preliminary tentative budget work session. 3.ADJOURNMENT There being no further business to discuss, Mayor Thomas adjourned the meeting.
