Donald Crawford of Edgewater United Methodist Church, located at 211 N. Ridgewood Avenue is
requesting a Special Activities permit for a Car Show to be held April 9,2005.
BACKGROUND
The event is scheduled for April 9, 2005, with the hours of operation being from 10:00 a.m. to 4:00 p.m.
Outdoor amplified music shall be from 10a.m. until 3p.m. The applicant will be responsible for any law
enforcement and other expenses the City incurs during this event. Property owners within 500-feet have
been notified of the public hearing.
STAFF RECOMMENDATION
The Technical Review Committee has reviewed the application and recommends approval of the special
activities permit to allow the United Methodist Church to have a car show to be held April 9, 2005, based
on the following conditions:
1. Driveways must remain readily accessible to the rear of the building to allow emergency vehicle
access;
2. The occupant load of the assembly area may never be exceeded;
3. Daily fire, life safety and code inspections will be conducted throughout the duration of the permit;
4. The applicant fully complies with Section 21-37 (Special Activity Requirements) of the Land
Development Code and Ordinance 2002-0-04 (Noise Ordinance);
5. No parking is permitted in public right-of-ways or in the site visibility triangle.
ACTION REQUESTED
Motion to approve the special activities permit to allow the United Methodist Church to have a car show to
be held April 9, 2005, based on staffs recommendations.

THE FOLLOWING PERMIT CONDITIONS ARE APPLICABLE TO EDGEWATER UNITED
METHODIST CHURCH FOR April 9, 2005.
SPECIAL ACTIVITY PERMIT REQUIREMENTS
1. A Special Activity Permit has been issued for Edgewater United Methodist Church for a Car
Show, to be held April 9,2005. (1 day at $200.00 per day, Fee of $200.00 paid).
2. All conditions of the City's Code of Ordinances (nuisances, noise, health, sanitation and
miscellaneous offenses, unless otherwise provided for, shall be applicable during the activity.)
3. Proposed use will not result in unsafe ingress and/or egress for pedestrians or vehicles, and shall
comply with parking requirements for that use.
4.
A description of adequate provisions for parking will be supplied in advance to the Planning
Department for staff review. Applicant must obtain written permission from all propertY owners
granting authorization to use their property for this event, including use for parking facilities.
Applicant will supply adequate manpower for parking vehicles during the event.

5. Applicant will provide the City Clerk with a bond or an insurance policy to protect City from
liability in form and substance acceptable to City and in the amount of a minimum of $200,000.
6. Sanitary facilities must be adequate for expected attendance and remain on site for the duration of
the event. (Including potable water, if necessary)
7. The City shall provide scheduled and unscheduled inspections prior to and/or during the special
activity by police, fire, code compliance, building and/or city administration representatives to
monitor and ensure compliance with all applicable City, County and State codes. Special activity
permits that include outdoor entertainment may require a code compliance officer to remain on
site during the activity. The cost of said officer shall be reimbursed to the City by the
sponsor/promoter. Appropriate State agencies are responsible for the inspection of amusement
rides and public food preparation facilities.
8. The proposed use will substantially comply with the appropriate Florida Fire Prevention Code and
Building Code requirements. Plans must be approved by Fire and Police Departments.
9. No signage for advertising the event shall be placed on any public right-of-way. Any signs used for
the event must be permitted and inspected by the Building Department. All signs shall be removed
within 1 day at the end of the event.

The proposed use is limited to a specific period of time listed on the Special Activity Application,
not to exceed one day.

The proposed special activity event shall not be permitted on the same parcel property more than
two (2) times within a six-month period. A letter of authorization from property owner must be
supplied to the City.
12. The proposed use will operate only during the specific daily time period requested on the
application.
13. The proposed activity will direct on-site lighting away from adjacent parcels and roadways.
14. It shall be the responsibility of the applicant of the special activity permit to ensure the structural
integrity of all temporary structures erected for special activities. The structures are to be safe,
structurally sound and of adequate capacity to service the number of persons proposed to use the
structure and must be removed with five (5) days of completion of the special activity. The
Building Official and Fire Marshal shall verify such compliance is obtained.
15. No electrical cords to be placed across driveways or driving lanes.
16. No open flames permitted.
17. Fire extinguishers (minimum size 2a40bc) must have valid inspection tags and must be on site at
all times and be readily available. The quantity of fire extinguishers to be determined by the Fire
Department.
18. Access roadways must be maintained at a minimum width of 20 feet.
19.
Overnight parking or camping is prohibited.
20. For events taking place in grass lots or fields, the vegetation must be cut prior to set up.
21. Individual vendors must register with the City Clerk and food vendors must have proper state
inspections. {Department of Business and Professional Regulations will do inspections (800-375-
6975), fees may be required by the State}
22. Applicant is responsible for leaving property clear of all trash, garbage and litter.
23. Any person or entity who shall conduct, operate or maintain a special activity and fails to obtain a
special activity permit shall be ordered to cease and desist and be punished by a fine of three
times the cost of the application fee as well as all associated City fees. No further special
activities shall be authorized until all penalties are current. A repeat offender shall not be eligible
for a special activity permit for a one-year period. A repeat offender is defined as a
sponsor/promoter who violates any of the conditions of the special activity permit more than one
time in a six-month period.
24. Must provide adequate parking for those in attendance.
25. All off site parking will require a traffic detail.
26. No parking is permitted in public right-of-ways or in the site visibility triangle - see attached
diagram.

A Special Activity requesting road closures will provide "road closure signs" and barricades.

A special activity with heavy/congested vehicular and/or pedestrian traffic will provide
"congested area ahead" signs along with and additional generated light system that will illuminate
the area of crossing/congestion.

29. The City shall monitor noise levels to determine if a public nuisance exists. The permit holder
shall comply with the City's determination. Special Activity permit is subject of revocation if
owners fail to comply with noise abatement. Article IT (Noise) of Chapter 10 (Health and
Sanitation) of the Code of Ordinances shall be upheld.
30. No amplified public address system shall be in use after 9:00 p.m.
ADDITIONAL CONDITIONS PER FIRE MARSHAL/POLICE DEPARTMENT:
1. Driveways must remain readily accessible to the rear of the building to allow emergency vehicle
access,
1. The occupant load of the assembly area may never be exceeded,
2. Daily fire, life safety and code inspections will be conducted throughout the duration of the
permit,
3. The applicant fully complies with Section 21-37 (Special Activity Requirements) of the Land
Development Code and Article IT (Noise) of Chapter 10 (Health and Sanitation) of the Code of
Ordinances.

Community Development Block Grant (CDBG) Annual Plan Worksheet and Five-Year CDBG
budget projection expenditures.
BACKGROUND:
Each year, the City is required to submit an Annual Plan Worksheet (FY2005/2006), describing a
proposed activity for the next fiscal year as well as a Five- Year (2005/2009) CDBG Budget
Projection. This years allocation is $96,639. The required public hearing was held on March 11,
2005. Staff is requesting to use this years appropriation for stormwater improvements. All
documentation must be submitted to the County by May 2,2005.
STAFF RECOMMENDATION:
Approve the Annual Plan Worksheet and the Five-Year CDBG Budget Projections.

BACKGROUND: On August 24, 2004, Mr. Joseph Wagner submitted a non-administrative
variance application for a variance to the site dimension requirements of Section 21-50.02, Table V-I
of the City of Edgewater Land Development Code (to allow an 8,442 square foot lot in the R-2
zoning district in lieu of the required 10,000 square foot) at his property located at 2530 Travelers
Palm Drive. The Planning and Zoning Board considered this request during their November 17, 2004
meeting. The request was denied.
Mr. Wagner revised the plan regarding his original submittal and resubmitted a second request for a
variance from the site dimension requirements of Section 21-50.02, Table V-I of the City of
Edgewater Land Development Code (to allow for a 67.875::1: lot width in lieu of the required eighty
(80') feet). This request was considered during the February 9, 2005 Planning and Zoning Board
meeting and was denied.
STAFF RECOMMENDATION: The City of Edge water Land Development Code, Section 21-70
(Non Conforming Uses - Purposes) states "the provisions of the Article are intended to curtail
substantial investment in non-conformities and to bring about their eventual elimination". Therefore,
staff recommends denial of Resolution No. 2005-R-05.
ACTION REQUESTED: Motion to deny the variance appeal contained in Resolution No. 2005-R-
05.

WHEREAS, the City Council of the City of Edgewater, Florida, has made the following
determinations:
1. Joseph Wagner owner of property located at 2530 Travelers Palm Drive applied for
variances from the requirements ofSection21-50.02, Table V -I (minimum lot width square footage)
of the Land Development Code in an attempt to construct an additional residence on what would be
on a newly created non-conforming lot.

2. On November 17,2004, the Planning and Zoning Board (Local Planning Agency)
held a public hearing on the application and denied the requested variances. Pursuant to Section 21-
100 of the Land Development Code, Mr. Wagner submitted an Appeal Application to appeal the
decision of the Planning and Zoning Board.
3. In a letter dated December 28, 2004, Mr. Wagner withdrew his Appeal and
resubmitted another Non-Administrative Variance Application with a revised plan requesting a
different variance from the site dimensions.
4. On February 9, 2005, the Planning and Zoning Board held a public hearing on the
application and denied the resubmitted variance request from the requirements of Section 21-50.02,
Table V -I (minimum lot width requirement) of the Land Development Code in an attempt to

construct an additional residence on what would be on a newly created non-conforming lot. Pursuant
o to Section 21-100 of the Land Development Code, Mr. Wagner submitted an Appeal Application
to appeal the decision of the Planning and Zoning Board.
5. Pursuant to Section 21-100 of the Land Development Code, on February 18,2005,
Joseph Wagner submitted an Appeal Application relating to the Planning and Zoning Board (Local
Planning Agency) decision during the February 9, 2005 meeting "asking compassion for our
situation" .

7. After consideration of the testimony presented during the public hearing, including

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edge water,
Florida:
Section 1. The City Council hereby grants/denies the Appeal submitted by Joseph Wagner
relating to the Planning and Zoning Board's denial of variance( s) for property located at 2530 Mango
Tree Drive.
Section 2. Based on the foregoing, the February 9,2005 decision of the Planning and Zoning
Board denying variances on the subject property for Article V (Site Design Criteria), Section 21-50

In the foreword of the book, 'A Meaningful Life', Rabbi Simon Jacobson, on the subject of Moses
appealing to God's mercy, writes the following: "Because he, (Moses), knew the "secret" of God that
. there is always a pathway to compassion, that God is not bound by His own laws of cause and effect,......."
A famous 1 SI Century Rabbi, Jesus of Nazareth, put it this way when he said, "Was man made for the law
or was the law made for man?"
A Connecticut prosecutor during the 1970's stated to the press the following: "Without mercy, (the act of
compassion), there is no justice."
So why is the City of Edge water so legal and uncompassionate if God's ways are contrary? Is this a
forecast of an evil trend for our country or has Edwin V ope1ax just lost his way as a community leader,
when he questions the relevance of compassion to a petty zoning law? See the following article:

It was brought to Mr. Lear's attention that 50% of my written request for a variance was not presente!f4V~G
the Planing and Zoning Board hearing on Nov. 17,2004. At that meeting the board rejected the variance 4 ~A
to 2 because of a lack of 10,000 sq. ft. in a lot. Therefore, Mr. Lear has kindly granted me another hearing
to present before the Planing and Zoning Board plan "B" that will allow 10,000 sq. ft. in each lot. He has
also said there would be no additional fee of$1000.00 for the hearing.
I believe there is a deep moral issue to this matter. I believe this issue, of a petty zoning law over
dominating the welfare of a person, shows a cruel trend in American society. This matter does not only
reflect America's superficial reasoning of, "green lawns and cold hearts philosophy", but causes us to be
more fascist and act cruelly and irrational as a world leader. I am interested in how the courts view this
issue.
I would like to put my request for an appeal aside for now until after the rehearing with the Planing and
Zoning Board. The appeal fee should be kept in escrow because I feel that an appeal will be needed due to
the irrational cold heartedness of the opposition to this issue.

A resolution accepting and approving Edgewater's portion of Volusia
2020, The Local Mitigation Strategy
BACKGROUND:
In 1998, City Council appointed Deputy Fire Chief Joseph Daly as Edgewater's representative to serve
on a steering committee to establish a countywide mitigation strategy designated as "V olusia 2020".
Since this time, with cooperative efforts of many individuals from many jurisdictions throughout the
county, the committee has identified, justified and prioritized a number of proposed projects and
programs needed to mitigate the vulnerabilities to the impacts of future disasters.
Adoption of this resolution will expresses your approval of Edgewater's portion of the Volusia 2020
Mitigation Strategy, pursue available funding opportunities, implement proposals once funded,
continue participation with V olusia 2020, and encourage businesses and other groups to participate in
updating and expansion of the V olusia 2020 Mitigation Strategy.

EDGEWATER'S DESIGNATED PORTION OF THE

AUTHORIZING RESEARCH AND PARTICIPATION FOR
AVAILABLE FUNDING OPPORTUNITIES FOR
IMPLEMENT A TION OF THE PROPOSALS DESIGNATED IN
THE MITIGATION STRATEGY; REPEALING
RESOLUTIONS IN CONFLICT HEREWITH AND
ESTABLISHING AN EFFECTIVE DATE.

WHEREAS, areas of the City of Edge water are vulnerable to the human and economic costs
of natural, technological and societal disasters; and
WHEREAS, the City Council recognizes the importance of reducing and/or eliminating
those vulnerabilities for the overall good and welfare of the community; and
WHEREAS, the City has been an active participant in V olusia Prepares, the Local

Mitigation Strategy working group which has established a comprehensive, coordinated planning
process involving the county and its municipalities, as well as other public and private sector
organizations to eliminate or decrease these vulnerabilities; and
WHEREAS, City representatives and staff have reviewed the information provided by or
for other participatingjurisdictions and organizations, including the projects and programs proposed
for incorporation into the V olusia County Local Mitigation Plan; and
WHEREAS, the proposed projects and programs have been incorporated into the current
edition of the V olusia County Local Mitigation Plan that has been prepared and issued for
consideration and implementation by the communities within Volusia County.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of

Edgewater, Florida:
Section 1. The City Council hereby approves and authorizes acceptance of the designated
portion ofthe V olusia County Local Mitigation Plan as it relates to the City of Edgewater. The City
further accepts and endorses the mitigation goals and objectives established by V olusia Prepares for
the countywide plan, and the anticipated schedule for the next updating of the plan. The City will
further seek to encourage participation from local businesses, industries and community groups in
the updating and expansion of the Plan.
Section 2.
The City finds the proposed mitigation projects and programs included in the
plan by other municipalities and organizations are acceptable and that they will not adversely affect
the county or its neighborhoods, and that they do not conflict with or duplicate the mitigation
proposals made by the county itself.
Section 3.
The City Manager or his designee is hereby requested and instructed to pursue
available funding opportunities for implementation of the proposals designated therein, subject to
the approval ofthe City Council for application of grants or other contracts offered to provide such
funding. Upon the City finding such funding or other resource, the proposals contained in the
applicable section of the Strategy will be implemented.

Volusia County Proposal for Road Paving from 35th Street in
Florida Shores to Volco Road
BACKGROUND:
During Council Reports at a recent Council Meeting, Mayor Schmidt
expressed his desire to see the road between 35th Street in Florida Shores
and Volco Road paved due to the high volume oftraffic and concern for
public safety, due to the failing condition of the shell road. The Mayor
directed, with concurrence from Council, that staff approach Volusia
County about the feasibility of paving this stretch of roadway in
conjunction with another County paving project in close proximity to
afford the City the benefit of reduced cost from equipment and personnel
mobilization savings. Staff was able to secure a very cost effective
proposal from the County to perform this paving job at the same time
frame Clinton Cemetary Road is scheduled for surfacing. The County
proposes to pave 35th Street using 3" of hot mix asphalt over a 6" crushed
concrete base, to construct drainage swales, and to grass the swale area
using hydroseed for a total cost of $33,000. Monies are budgeted in
Public Works under the Other Contractual Services line item for paving.
STAFF RECOMMENDATION:
Staff recommends approval of the V olusia County Proposal for
the paving of 35th Street between Florida Shores and Volco Road.
ACTION REQUESTED:
A motion to accept the Volusia County proposal to pave 35th Street
between Florida Shores and Volco Road at a total cost of $33,000.00, and
to authorize the City Manager or Mayor to execute the necessary
documents with Volusia County.

Sorry about the delay, it has been one of those weeks. To give you guys some flexibility, we
broke the project into 2 parts.
To pave 35th St using 3" of hot mix asphalt over a 6" crushed concrete
base, install drainage swales & grass using hydroseed the cost would be
$33,000.
If you just want to pave it & let the water run off onto the existing shoulders without swale
installation & grassing, the estimated cost would be $25,100.
Let me know what you think & we'll get it on the schedule ASAP.

City Council Policy - 2005/2006 Goals/Objectives
BACKGROUND:
The City Council and staff conducted a work session February 9,2005, concerning policy goals and
objectives for FY 2005/2006. The purpose is to discuss the important issues that impact the City and
its residents. The City Council's role is to establish policies and priorities and the staff s function
is implementation of the policies.
After discussion and an exchange of ideas, the 2005/2006 Goals and Objectives are presented.
1. Economic Development
~ concentrate on commercial/industrial growth
~ job creation
~ residential areas south along US 1 and west ofl-95 should adhere to smart growth philosophy
~ strengthen policies to insure growth pays fair share
~ maintain impact fees/service costs to keep pare with inflation
