ORDINANCE NO. 95-0-04
AN ORDINANCE AMENDING THE ZONING ORDINANCE OF
EDGEWATER, FLORIDA; AMENDING SECTION 607.03
(PID PLANNED INDUSTRIAL DEVELOPMENT DISTRICT)
BY ADDING A DWELLING UNIT FOR SECURITY
PERSONNEL AS A CONDITIONAL USE; PROVIDING FOR
CONFLICTING PROVISIONS, SEVERABILITY AND
APPLICABILITY; PROVIDING FOR AN EFFECTIVE
DATE; PROVIDING FOR ADOPTION AND CODIFICATION.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. On March 29, 1995, the Land Development and Regulatory
Agency considered a request from Scott S. Porta to amend the Zoning
Ordinance to permit security personnel to reside onsite as an
accessory use in the Planned Industrial Development (PID) district,
Section 607.03.
2. The Land Development and Regulatory Agency by a vote of
7-0 recommended approval of the amendment.
3. During consideration of the amendment OIl April 17, 1995,
the Council determined that requests to allow security personnel to
reside onsite in the pro district would be more appropriately
addressed on a case by case basis as a conditional use.
4. rt is in the best interests of the citizens of Edgewater
that Section 607.03 be amended accordingly.
NOW THEREFORE, BE IT ENACTED by the People of the City of
Edgewater, Florida:
PART A. AMENDMENT OF SECTION 607.03 (PID PLANNED
INDUSTRIAL DEVELOPMENT DISTRICT) OF THE ZONING ORDINANCE,
CITY OF EDGEWATER, FLORIDA.
Section 607.03(c) (2) is created to read as follows:
Section 607.03 PID Planned Industrial Development District.

Condi tional uses: One (1) modular. ~i~elling unit In
conjunction with a permitted primary use, provided the dwellinq is
needed to accommodate security personne] employedbv the owner or
operator of the permitted primary use. The modul~r unit shall be
occupied only by security personnel. This modu]ar unit must be
located no less than 50 feet away from any structures housing
industrial
activities
or
containinq
hazardgus
materials.

Additional conditions may be attached pursuant to Section 613 of
the Land Development Code.
PART B.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof
ln conflict with this ordinance, are hereby superseded by this
ordinance to the extent of such conflict.
PART C.
SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such
holding shall not affect its applicability to any other person,
property, or circumstance.
PART D.
CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code
of Ordinances of the City of Edgewater, Florida, and the word
"ordinance" may be changed to "section",
"article", or other
appropriate word, and the sections of this ordinance may be
renumbered or relettered to accomplish such intention; provided,
however, that Parts B through F shall not be codified.
PART E.
EFFECTIVE DATE.
This ordinance shall take effect upon adoption.
PART F. ADOPTION.
After Motion by Councilman Mitchum and Second by Councilman
Hays, the vote on the first reading of this ordinance held on April
17, 1995, was as follows:
