95-O-03 l .... ,.""., ORDINANCE NO. 95-0-03 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF EDGEWATER, FLORIDAj AMENDING ARTICLE II (DEFINITIONS) BY ADDING THE DEFINITION OF PERSONAL SERVICES; AMENDING SECTION 606.02 (B- 3 HIGHWAY SERVICE BUSINESS DISTRICT) BY ADDING PERSONAL SERVICES AS A PERMITTED USE AND CONSOLIDATING THE LIST OF PERMITTED USES TO DELETE REPETITIVE AND CONFUSING TERMINOLOGY; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR ADOPTION AND CODIFICATION. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. On March 29, 1995, the Land Development and Regulatory Agency considered a request from Kevin Pate and Andrew Johnson to amend the Zon ing Ordinance by adding a definition of personal services and by adding personal services as a permitted use in the B-3 Highway Service Business District, Section 606.02. 2. The Land Development and Regulatory Agency by a vote of 7-0 recommended approval of the amendment. 3. Because the current list of permitted US(!S is repetitive and confusing, consolidation of the list is warranted at this time. 4. It 1S in the best interests of the citizens of Edgewater that Article II and Section 606.02 be amended accordingly. NOW THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: PART A. AMENDMENT OF ARTICLE II (DEFINITIONS) OF THE ZONING ORDINANCE, CITY OF EDGEWATER, FLORIDA. All conflicting ordinances and resolutions, or parts thereof 1n conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PART D. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance. PART E. CODIFICATION. Provisions of this ordinance shall be incorporated in the Code of Ordinances of the City of Edgewater, Florida, and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts C through F shall not be codified. PART F. EFFECTIVE DATE. This ordinance shall take effect upon adoption. PART G. ADOPTION.
