ORDINANCE NO. 94-0-22
AN ORDINANCE OF THE CITY COUNCIL OF EDGEWATER,
FLORIDA, AMENDING SECTION 19-14 (METER RATES -
MINIMUM) .AND SECTION 19-15 (SAME - MULTIPLE
MINIMUM CHARGES) OF ARTICLE II (WATER),
CHAPTER 19 (UTILITIES AND SERVICES) OF THE
CODE OF ORDINANCES, CITY OF EDGEWATER,
FLORIDA, BY INCREASING THE WATER RATES;
PROVIDING FOR CONFLICTING PROVISIONS,
SEVERABILITY AND APPLICABILITY; PROVIDING FOR
CODIFICATION, AN EFFECTIVE DATE AND FOR
ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida,
has determined that it is necessary to increase the water rates in
order to provide debt service coverage, operations and maintenance
of the potable water system.
NOW, THEREFORE, BE IT ENACTED by the People of the City of
Edgewater, Florida:
PART A. AMENDMENT OF SECTION 19-14 (METER RATES - MINIMUM)
OF ARTICLE II (WATER), CHAPTER 19 (UTILITIES AND SERVICES) OF THE
CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA.
Section 19-14 is amended as follows:
Section 19-14. Meter rates - minimum.
The following meter rates shall be applied to all retail
quantities of water as shown by monthly meter readings to have been
delivered:
(a) Potable water system:
(1) Inside city limits.

CHARGES) OF ARTICLE II (WATER), CHAPTER 19 (UTILITIES AND SERVICES)
OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA.
Section 19-15 is amended as follows:
Section 19-15. Same - Multiple minimum charges.
(a) Minimum charge where a single water meter installation
serves multiresidential units. A multiresidential unit includes
residential dwellings of two (2) or more units and includes town-
houses, apartments, duplexes, condominiums and mobile home parks,
all of which are served by a single water meter. Euch meter

(c) Nonresidential rate. Commercial, industrial and service
accounts shall not be subject to the multiple minimum charge,
except as set forth in subparagraph (3) below. In lieu of the
multiple minimum:
(1) Inside of the city limits the nonresidential rate will be
used under the proposed schedule of charges:

PART C.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof
in conflict with this ordinance, are hereby superseded by this
ordinance to the extent of such conflict.
PART D.
SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such

holding shall not affect its applicability to any other person,

PART E.
CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code
of Ordinances of the City of Edgewater, Florida, and the word
"ordinance", may be changed to "section", "article", or other
appropriate word, and the sections of this ordinance may be
renumbered or relettered to accomplish such intention; provided,
however, that Parts C through G shall not be codified.
PART F.
EFFECTIVE DATE.
This Ordinance shall take effect on October 1, 1994.
PART G.

After Motion by Councilman Hays and Second by Councilman
Jones, the vote on the first reading of this ordinance held on
September 7, 1994, was as follows:
