ORDINANCE NO. 94-0-20
AN ORDINANCE OF THE CITY COUNCIL OF EDGEWATER,
FLORIDA, REGARDING ARTICLE VI (SOLID WASTE
DISPOSAL) OF CHAPTER 19 (UTILITIES AND
SERVICES OF THE CODE OF ORDINANCES, CITY OF
EDGEWATER, FLORIDA; AMENDING SECTION 19-63
(SERVICE CHARGES AND RATES) BY INCREASING THE
MONTHLY FEE FOR THE COLLECTION AND DISPOSAL OF
GARBAGE AND TRASH BY FORTY (40) CENTS FOR UP
TO THREE (3) CANS AND BY TWENTY (20) CENTS PER
CAN IN EXCESS OF THREE (3) CANS; AMENDING
SECTION 19-66 (PREPARATION OF TRASH) TO DELETE
THE ADDITIONAL CHARGE FOR ITEMS NOT CONSIDERED
TO BE TRASH; PROVIDING FOR CONFLICTING
PROVISIONS, SEVERABILITY AND APPLICABILITY;
PROVIDING FOR CODIFICATION, AN EFFECTIVE DATE
AND FOR ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. The Refuse Fund is an enterprise fund and accordingly
must be self-sustaining.
2. The basic refuse rate has not been increased since
September 21, 1992.
3. It is necessary to increase the monthly rate for
collection and disposal of garbage and trash by forty (40) cents
per month for up to a maximum of three (3) cans and twenty (20)
cents for each additional can.
4. It is cost effective and in the best interest of the
citizens of Edgewater to delete the additional charge for items not
considered to be trash.
NOW, THEREFORE, BE IT ENACTED by the People of the City of
Edgewater, Florida:
PART A. AMENDMENT OF SECTION 19-63 (SERVICE CHARGES AND
RATES) OF ARTICLE IV (SOLID WASTE DISPOSAL) OF CHAPTER 19
(UTILITIES AND SERVICES) OF THE CODE OF ORDINANCES, CITY OF
EDGEWATER, FLORIDA.
Section 19-63 is amended as follows:
Section 19-63. Service Charges and Rates.
(a) The city shall maintain and operate a service for the
collection and disposal of garbage and trash, and all persons whose
premises are serviced thereby shall pay to the city for such

services the following monthly rates:
(1) Residence: Ten dollars and fifty:&eft cents ($10.50
10.10) per month up to a maximum of three (3) cans or equivalent
per pickup. For each additional can in excess of three (3) cans
there shall be an additional charge of one dollar and twenty cents
($1.20 ~) per can.
(2) Multiple dwelling: Ten dollars and fifty :&eft cents
($10.50 10.10) per month to a maximum of three (3) cans or
equivalent per pickup. For each additional can in excess of three
(3) there shall be an additional charge of one dollar and twenty
cents ($1.20 ~) per can. A charge of nine dollars and seventy-
five thirty fi~e cents ($9.75 9.35) per month per unit shall be
made if the garbage and trash is centrally located.
(3) Business or commercial: Twelve Eleven dollars and

per month for each commercial or
business unit up to a maximum of three (3) cans or equivalent per
pickup. For each additional can in excess of three (3) there shall
be an additional charge of one dollar and twenty cents ($1.20 ~)
per can.

Professional:
Ten dollars and fifty :&eft cents
$10.50 10.10) per month for each professional unit up to a maximum
of three (3) cans or equivalent per pickup. For each additional
can in excess of three (3) there shall be an additional charge of
one dollar and twenty cents ($1.20 ~) per can.
(5) Trailer park:
Ten dollars and fifty :&eft cents
($10.50 10.10) per trailer or mobile home unit up to a maximum of
three (3) cans or equivalent per pickup. For each additional can
in excess of three (3) there shall be an additional charge of one
dollar and twenty cents ($1.20 ~) per can. A charge of nine
dollars and seventy-five thirty five cents ($9.75 ~) per month
per trailer or mobile home shall be charged if the garbage and
trash are centrally located within the mobile home park.
(6) Equipment reserve fund: in addition to the above
stated refuse account, there is an equipment reserve fund in the

City of Edgewater, Florida, created on September 28, 1981, for the
purposes of financing equipment used in the collection and disposal
of garbage and trash within the city in addition to the above
stated charges. Each account shall be charged an additional fifty
cents ($0.50) per month, per account, said funds being placed in
the separate equipment reserve fund for the aforementioned purpose.
(7) Citywide residential recycling fee:
One dollar
($1.00) per month, for weekly curbside collection service for
paper, glass, plastic, corrugated cardboard, aluminum, and metal
cans beginning June 28, 1991.
PART B. AMENDMENT OF SECTION 19-66 (PREPARATION OF TRASH) OF
ARTICLE IV (SOLID WASTE DISPOSAL) OF CHAPTER 19 (UTILITIES AND
SERVICES) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA.
Section 19-66 is amended as follows:
Section 19-66. Preparation of trash.

nature, ohall be moved at the expenoe of the property owner. The

Hall by the property O\mer, arrange for the pickup of itemo not

The charge for the picltup of nontraoh itemo
ohall be determined by a repreoentative of the public ~iOrl(O
department, and oaid charge ohall be baoed primarily upon, but not
limited to the following factorol
The number of loado, and the
time and other expenoeo incurred by the city in mo~ing the non
traoh itemo.
(eQ) piles of trash shall be stacked in piles not to exceed
four (4) feet in height, four (4) feet in width, and four (4) feet
in length.
(eQ) No trash pickups will be made from vacant lots; provided
however, the owner of any vacant lot may make arrangements with the
city for pickup of trash, and a reasonable charge for such service
shall be determined by the supervisor.
(eg) Trash which is not prepared as required herein will not

PART C.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof
in conflict with this ordinance, are hereby superseded by this
ordinance to the extent of such conflict.
PART D.
SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such
holding shall not affect its applicability to any other person,
property, or circumstance.
PART E.
CODIFICATION.
Provisions of this ordinance shall be incorporated in the Code
of Ordinances of the City of Edgewater, Florida, and the word
"ordinance", may be changed to "section", "article", or other
appropriate word, and the sections of this ordinance may be
renumbered or relettered to accomplish such intention; provided,
however, that Parts C through G shall not be codified.
PART F.
EFFECTIVE DATE.
This Ordinance shall take effect October 1, 1994.

ADOPTION.
After Motion by Councilwoman Martin and Second by Councilman
Jones, the vote on the first reading of this ordinance held on
September 7, 1994, was as follows:
