94-O-04 --- ......, ORDINANCE NO. 94-0-04 (ORDINANCE DIED DUE TO LACK OF MOTION ON JANUARY 24, 1994) AN ORDINANCE OF THE CITY COUNCIL OF EDGEWATER, FLORIDA, AMENDING SECTION 4-5 (HOURS OF SALE) OF CHAPTER 4 (ALCOHOLIC BEVERAGES) OF THE CODE OF ORDINANCES OF THE CITY OF EDGEWATER, FLORIDA, TO AUTHORIZE AN EXTENSION OF HOURS FOR BARS AND TAVERNS FROM 2:00 A.M. TO 3:00 A.M. DURING RACE WEEKS AND BIKE WEEK; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR CODIFICATION, AN EFFECTIVE DATE AND FOR ADOPTION. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. Pursuant to the request of an individual bar owner, the City Council for the past two years has authorized an extension of hours for bars and taverns during "Bike Week". 2. In order to eliminate the need to address such a request annually and to insure that all bars and taverns have equal notice of any extension of hours, it is appropriate that the extension be codified. NOW, THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: PART A. AMENDMENT OF SECTION 4-5 (HOURS OF SALE) OF CHAPTER 4 (ALCOHOLIC BEVERAGES) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA. Section 4-5 is amended as follows: Section 4-5. Hours of Sale. (c) An extension of hours for taverns and bars is authorized as follows: From 7:00 a.m. until 3:00 a.m. the followinq morninq durinq periods of the year desiqnated as "Race Weeks" and "Bike Week." For the purposes of this section, "Race Weeks" is defined as that period of time terminatinq at 3:00 a.m. followinq the day of the automobile race known as the Daytona 500, and beqinninq fourteen (14) days prior thereto: and "Motorcycle Week" is defined as that period of time terminatinq at 3:00 a.m. followinq the day of the motorcycle race known as the Daytona 200, and beqinning seven (7) Struck through passages are deleted. All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PARTC. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance. PART D. CODIFICATION. Provisions of this ordinance shall be incorporated in the Code of Ordinances of the City of Edgewater, Florida, and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts B through F shall not be codified. PART E. EFFECTIVE DATE. This Ordinance shall take effect upon adoption. PART F. ADOPTION.
