93-O-12 1illIIII'" "WI ORDINANCE NO. 93-0-12 AN ORDINANCE AMENDING ARTICLE IV (SELF- INSURANCE FUND) OF CHAPTER 2 (ADMINISTRATION) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA; AMENDING SECTION 2-63 (COMMITTEE- CREATED; MEMBERSHIP; DUTIES) BY SUBSTITUTING THE CITY MANAGER AND FINANCE DIRECTOR FOR THE CITY CLERK/CITY ADMINISTRATOR AND INSURANCE AGENT OF RECORD; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR AN EFFECTIVE DATE AND FOR ADOPTION. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. Article IV (Self-Insurance Fund) of Chapter 2 (Administration) of the Code of Ordinances for the City of Edgewater was enacted in 1986 and has remained virtually unchanged since that time. 2. Section 2-63 of Article IV establishes a Self-Insurance Committee consisting of the City Clerk/City Administrator, City Attorney, and the City's Insurance Agent of record. 3. It is the best interests of the citizens of Edgewater that this section be amended to reflect the status of current staff professionals that can perform the routine functions of the Committee without retaining outside consultants. NOW THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: PART A. AMENDMENT OF ARTICLE IV (SELF-INSURANCE FUND) OF CHAPTER 2 (ADMINISTRATION) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA. Section 2-63 is hereby amended to read as follows: Section 2-63. Committee-Created; membership; duties. There is hereby appointed a committee to be known as the City of Edgewater Self-Insurance and Insurance Committee, consisting of the city manaqer oity olerlt/oity adminiotrator, the city attorney and the finance director oity'o inouranoe agent of reoord. 'WJII program and maintain appropriate records which shall reflect the status of the program and be in such detail as required to enable the committee to determine appropriate reserves. The committee shall determine and recommend to the city council the amount of reserves to be accumulated and maintained and the amount to be appropriated annually to finance the self-insurance and insurance program. PART B. CONFLICTING PROVISIONS. All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PART C. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance. PART D. EFFECTIVE DATE. This ordinance shall take effect upon adoption. PART E. ADOPTION. After Motion by Councilwoman Martin and Second by Councilman Hays, the vote on the first reading of this ordinance held on July 19, 1993, was as follows: Mayor Jack H.
