93-O-08 ........ ...., ORDINANCE NO. 93-0-08 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF EDGEWATER, FLORIDA; AMENDING ARTICLE II (DEFINITIONS) SECTION 200.00 (INTERPRETATIONS OF CERTAIN TERMS AND WORDS) BY AMENDING THE DEFINITION OF STORY; AMENDING SECTION 602.02 (R-IA SINGLE-FAMILY RESIDENTIAL DISTRICT) BY DELETING THE LIMITATION OF PERMITTED USES TO ONE STORY BUILDINGS, INCREASING THE MINIMUM YARD SIZE WHEN A BUILDING EXCEEDS ONE STORY IN HEIGHT AND BY INCREASING THE MAXIMUM BUILDING HEIGHT; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR AN EFFECTIVE DATE, CODIFICATION AND FOR ADOPTION. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. On April 28, 1993 and May 26, 1993, the Land Development and Regulatory Agency considered the issue of maximum building height in the R-1A Single-Family Residential District, Section 602.02. The current twenty-two (22) foot maximum height above the crown of Riverside Drive has been effected by the Federal Emergency Management Agency's increase in the required base flood elevation. 2. On May 26, 1993, the Land Development and Regulatory Agency by a vote of 5-1 recommended that the limitation of permitted uses to one story buildings be deleted, the maximum building height be increased and the minimum yard size be increased when a building exceeds one story. 3. It is in the best interests of the citizens of Edgewater that Section 602.02 be amended accordingly. NOW THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: PART A. AMENDMENT OF ARTICLE II (DEFINITIONS) (INTERPRETATIONS OF CERTAIN TERMS AND WORDS) ORDINANCE, CITY OF EDGEWATER, FLORIDA. SECTION 200.00 OF THE ZONING Article II is amended as follows: Story: That portion of a building included between the upper surface of the ground any floor and the upper surface of the floor or ~ ceilinq next above it, includinq any qaraqes, hallways, storaqe spaces or other similar areas. AMENDMENT OF SECTION 602.02 (R-IA SINGLE-FAMILY RESIDENTIAL DISTRICT) OF THE ZONING ORDINANCE, CITY OF EDGEWATER, FLORIDA. Section 602.02 is amended as follows: Section 602.02 R-IA Single-Family Residential District (a) Permitted uses: Facilities owned and operated by federal, state, county or municipal government; playfields; playgrounds; public parks; recreation buildings; single-family eae atory buildinga dwelling units; and family residential homes provided that such homes shall not be located within a radius of one thousand (1,000) feet of another existing such family residential home and provided that the sponsoring agency or Department of Health and Rehabilitative Service (HRS) notifies the ci ty council at the time of home occupancy that the home is licensed by HRS. (d) Dimensional requirements: (2) Minimum yard size: Front yard: 40 ft. Rear yard: 30 ft. from high water mark. Side yard: Ten (10) percent of lot width with a minimum of 10 feet, except corner plots with a side street setback, a minimum of 30 feet. When a buildinq exceeds one story in height, the minimum side setback shall be increased bv 5 feet for each story added. CONFLICTING PROVISIONS. All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. PART D. SEVERABILITY AND APPLICABILITY. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. PART E. CODIFICATION. Provisions of this ordinance shall be incorporated in the Code of Ordinances of the City of Edgewater, Florida, and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, thats Parts C through F. shall not be codified. PART F. EFFECTIVE DATE. This ordinance shall take effect upon adoption. PART G. ADOPTION. After Motion by Councilman Mitchum and Second by Councilman Jones, the vote on the first reading of this ordinance held on June 7, 1993, was as follows: Mayor Jack H.
