ORDINANCE NO. 92-0-12 AN ORDINANCE AMENDING SECTION 2-20 (REGULAR MEETING TIMES) OF ARTICLE II (COUNCIL PROCEEDINGS) OF CHAPTER 2 (ADMINISTRATION) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA, BY PROVIDING THAT IF THE FIRST OR THIRD MONDAY OF A MONTH FALLS ON A HOLIDAY RECOGNIZED BY THE CITY, THE MEETING SHALL BE CANCELED OR RESCHEDULED AS DETERMINED BY THE CITY COUNCIL; PROVIDING FOR CONFLICTING PROVISIONS, SEVERABILITY AND APPLICABILITY; PROVIDING FOR AN EFFECTIVE DATE; PROVIDING FOR ADOPTION AND CODIFICATION. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. Section 2-20 of the Code of Ordinances currently provides that regular City Council meetings shall be held on the first and third Monday of each month. If the Monday is a national holiday, Section 2-20 requires that the regular meeting be canceled or held on the preceding Wednesday. 2. It is in the best interest of the citizens of Edgewater that Section 2-20 be amended to allow the meeting to be canceled or rescheduled to another date as determined by the City Council. NOW, THEREFORE, BE IT ENACTED by the People of the City of Edgewater, Florida: PART A. AMENDMENT OF SECTION 2-20 (REGULAR MEETING TIMES) OF ARTICLE II (COUNCIL PROCEEDINGS) OF CHAPTER 2 (ADMINISTRATION) OF THE CODE OF ORDINANCES, CITY OF EDGEWATER, FLORIDA. Section 2-20 is amended to read as follows: Section 2-20 Reqular Meetinq Times The city council shall hold regular city council meetings on the first Monday and the third Monday of each month at 7:00 p.m. If the first or third Monday falls on ahall be a national holiday recoqnized bv the City, then the regular meeting shall be either canceled or rescheduled as determined bv the City Council held on the preceding Wedneaday. PART B. CONFLICTING PROVISION. All conflicting ordinances and resolutions, or parts thereof in conflict with this ordinance, are hereby superseded by this ordinance to the extent of such conflict. If any portion of this ordinance is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this ordinance. If this ordinance or any provisions thereof shall be held to be inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property, or circumstance. PART D. CODIFICATION. Provisions of this ordinance shall be incorporated in the Code of Ordinances of the City of Edgewater, Florida, and the word "ordinance" may be changed to "section", "article", or other appropriate word, and the sections of this ordinance may be renumbered or relettered to accomplish such intention; provided, however, that Parts B through F shall not be codified. PART E. EFFECTIVE DATE. This ordinance shall take effect upon adoption. PART F. ADOPTION. After Motion by Councilperson Gillespie and Second by Councilman Hays, the vote on the first reading of this ordinance held on July 20, 1992, was as follows: Mayor Tanya B.
