ORDINANCE NO. 92-0-09
AN ORDINANCE AMENDING ORDINANCE NO. 82-0-10 BY
REDISTRICTING THE CITY OF EDGEWATER FOR THE
PURPOSE OF ELECTING COUNCIL MEMBERS; PROVIDING
FOR CONFLICTING PROVISIONS, SEVERABILITY AND
APPLICABILITY; PROVIDING FOR AN EFFECTIVE
DATE; PROVIDING FOR ADOPTION.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. The Charter of the City of Edgewater establishes four
voting districts for the purpose of electing four members of the
City Council.
2. The City of Edgewater was redistricted after the 1980
census pursuant to Ordinance No. 82-0-10.
3. The 1990 census showed a tremendous disparity among the
four voting districts established in Ordinance No. 82-0-10 in terms
of population.
3. The one man, one vote principle of the equal protection
clause of the united States and Florida Constitutions, together
with the Voting Rights Act of 1965, mandate that the City of
Edgewater redistrict to insure that each voting district is as
nearly as equal in population as possible.
4. It is necessary to amend Ordinance No. 82-0-10 by
redistricting the City of Edgewater to reflect the population of
the City of Edgewater as determined by the 1990 census.
NOW, THEREFORE, BE IT ENACTED by the People of the City of
Edgewater, Florida:
PART A. AMENDMENT OF ORDINANCE NO. 82-0-10.
Section 1.
The four voting districts of the City of Edgewater established in
Ordinance No. 82-0-10 are hereby redistricted as follows:
A. Voting District 1 shall include the following Blocks

PART B.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof
in conflict with this ordinance, are hereby superseded by this
ordinance to the extent of such conflict.
PART C. SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance. If this
ordinance or any provisions thereof shall be held to be
inapplicable to any person, property, or circumstances, such
holding shall not affect its applicability to any other person,
property, or circumstance.
PART D.
EFFECTIVE DATE.
This ordinance shall take effect on August 1, 1992.
PART F. ADOPTION.

Jones, the vote on the first reading of this ordinance held on June
1, 1992, was as follows:
