AN ORDINANCE AMENDiNG SECTION 19-13 (PAYMENT
OF BILLS; SERVICE CHARGE) OF CHAPTER 19
(UTILITIES AND SERVICES) OF THE CODE OF
ORDINANCES, CITY OF EDGEWATER, FLORIDA, BY
ESTABLISHING A SERVICE CHARGE FOR
RECONNECTIONS MADE OTHER THAN DURING NORMAL
WORKING HOURS; PROVIDING FOR CONFLICTING
PROVISIONS AND SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE; PROVIDING FOR ADOPTION AND
CODIFICATION.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. Section 19-13 of the Code of Ordinances currently
provides for a ten dollar service charge for reconnection to the
utility system after service has been discontinued.
2. The utility Department has recently received requests for
reconnect ions to be made other than during normal working hours.
3. The ten dollar service charge does not cover the cost for
reconnect ions made outside of normal working hours due to the
increased costs of overtime, etc.
4. It is necessary to amend Section 19-13 to clarify that
the ten dollar service charge is applicable to reconnections made
during normal working hours only and to establish a fee of fifty
dollars for reconnect ions made during other than normal working
hours.
NOW, THEREFORE, BE IT ENACTED by the People of the City of
Edgewater, Florida:
PART A. AMENDMENT OF SECTION 19-13 (PAYMENT OF BILLS, SERVICE
CHARGE) OF CHAPTER 19 (UTILITIES AND SERVICES) OF THE CODE OF
ORDINANCES, CITY OF EDGEWATER, FLORIDA.
Section 19-13 is hereby amended to read as follows:
Section 19-13. Payment of bills; service charge.
Bills for the monthly charges and fee for water service and
sewage disposal service shall be submitted and shall be payable
upon receipt.
A delinquency charge of ten (10) percent of the
amount due for water and sewage disposal fees shall be charged
against the customer by the city if the customer shall fail to pay
the charges due for water service and sewage disposal fees within

twenty (20) days of the billing date of said charges. Should there
be a failure by the customer receiving water and sewage service to
pay his bill in full for said service not later than thirty-five
(35) days from the billing date for said service, then said service
shall be terminated and shall not be reconnected after
discontinuance until all past due water bills and sewer disposal
fees are fully paid, together with said charge of ten (10) per cent
of past due bills and payment of a ten-dollar ($10.00) service
charge for reconnection durinq normal workinq hours, as those hours
are established by the city.
A service charqe of fifty dollars
($50.00) shall be imposed for reconnections made durinq other than
normal workinq hours.
The owner of each equivalent unit,
regardless of whether the equivalent unit is rented or being
occupied by the owner, shall be absolutely responsible for the
payment of all charges incurred to the equivalent living unit. No
service will be discontinued for a delinquent bill of less than
five dollars ($5.00).
PART B.
CONFLICTING PROVISIONS.
All conflicting ordinances and resolutions, or parts thereof,
in conflict with this ordinance, are hereby superseded by this
ordinance to the extent of such conflict.
PART C.
SEVERABILITY AND APPLICABILITY.
If any portion of this ordinance is for any reason held or
declared to be unconstitutional, inoperative, or void, such holding
shall not affect the remaining portions of this ordinance. If this
ordinance or any provision thereof shall be held to be inapplicable
to any person, property, or circumstances, such holding shall not
affect its applicability to any other person, property, or
circumstance.
PART D.
CODIFICATION.
provisions of this ordinance shall be incorporated in the Code
of Ordinances of the City of Edgewater, Florida, and the word
"ordinance" may be changed to "section", "article", or other
appropriate word, and the sections of this ordinance may be

renumbered or relettered to accomplish such intention; provided,
however, that Parts B through F shall not be codified.
PART E. EFFECTIVE DATE.
This ordinance shall take effect on March 3, 1992.
PART F. ADOPTION.
After Motion by Councilperson Gillespie and Second by
Councilperson Martin, the vote on the first reading of this
ordinance held on February 3, 1992, was as follows:
