A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, OPPOSING STATE AND
FEDERAL REGULATIONS OF WATERWAYS THAT ARE
NOT BASED ON SCIENTIFIC DATA AND DO NOT
ADEQUATELY PROTECT THE RIGHTS OF WATERFRONT
PROPERTY OWNERS, MARINE INDUSTRIES,
RECREATION BOATERS AND OTHER USERS OF THE
NAVIGABLE WATERWAYS; REPEALING RESOLUTIONS
IN CONFLICT HEREWITH; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, both the State and Federal governments have adopted regulations for the
protection of manatees and other environmental concerns that have severely restricted the ability of
boaters to use the navigable waterways in this State; and
WHEREAS, the marine industry is a major part of the economy of this State as well as the
City of Edgewater; and
WHEREAS, although the City Council is unaware of any pending legislation that would
impact that portion of the Indian River lying adjacent to the City limits, regulations impacting other
areas could adversely impact the residents of the City; and
WHEREAS, the City Council realizes that the rights of boaters and other users of the
navigable waterways must be balanced with the protection of the environment; and
WHEREAS, however, the protection of the environment should be based on scientific data
that establishes a need for protection and the regulations should be tailored to protect the specific
need; and
WHEREAS, the City Council is concerned that both the State and Federal regulations that
have been adopted in the past have not been based on scientific data and the rights of waterfront
property owners, the marine industry, recreation boaters, and otherusers of the navigable waterways

have not been adequately considered and protected.
NOW, THEREFORE, be it resolved by the City Council ofthe City ofEdgewater, Florida:
Section 1. The City Council of the City of the City of Edgewater hereby requests that both
State and Federal governments base all regulations ofthe navigable waterways on scientific data that
establish a need for the protection of the environment. Furthermore, in establishing these
regulations, the State and Federal agencies must acknowledge the rights of the waterfront property
owners, the marine industry, recreation boaters and other users of the navigable waterways and
establish regulations that establish a balance between the protection of the environment and the
protection of these interests.
Section 2. All resolutions or parts of resolutions in conflict herewith be and same are hereby
repealed.
Section 3. This resolution shall take effect upon adoption.
