2001-R-17 - Granting the Appeal for Property Known as Coastal Tire Companyc RESOLUTION NO. 2001-R-17 (VARIANCE GRANTED) " 't A A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF " EDGEWATER, FLORIDA, GRANTING THE APPEAL FOR VARIANCE REQUESTS FOR PROPERTY KNOWN AS N COASTAL TIRE COMPANY AND LOCATED AT 1701 m 0 a SOUTH RIDGEWOOD AVENUE; REPEALING o HBO, RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. Joe Martin, authorized agent for Coastal Tire Company applied for variances from the requirements of Sections 21-56.02 (Off -Street Parking Standards), 21-54.03 (Puking Lot Landscaping Requirements), 21-50.02 (Minimum Site Dimensions), 21-54.04 (Buffer Yard Determination Process) and 21-56.05 (Loading Berth Standards) of the Land Development Code to modify the building on the north side from a one-story to two-story office building for multiple tenancy. 2. On June 13, 2001, the Planning and Zoning Board (Local Planning Agency) held a public hearing on the application and denied the requested variances. Pursuant to Section 21-100 of the Land Development Code, on June 21, 2001, Mr. Martin submitted an Appeal Application to appeal the decision of the Planning and Zoning Board (Local Planning Agency). 3. On August 6, 2001, the City Council held apublic hearing on the Appeal Application after publishing notice of such hearing in the Observer on July 25, 2001 and notifying by mail all property owners who own real property directly affected by the proposed action and all property owners who own real property within 500 feet of the subject property. 2001-R-17 C r Y Ul 00 Om Ma 3. After consideration of the testimony presented during the public hearing, including staff comments, the City Council finds that the requested Variances do meet the variance requirements set forth in Section 21-100 of the Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. The variance requests of Joe Martin on behalf of Coastal Tire Company from the requirements of Sections 21-56.02 (Off -Street Parking Standards), 21-54.03 (Parking Lot Landscaping Requirements), 21-50.02 (Minimum Site Dimensions), 21-54.04 (Buffer Yard Determination Process) and 21-56.05 (Loading Berth Standards) of the Land Development Code to modify the building on the north side from a one-story to two-story office building for multiple tenancy shall hereby be approved. Section 2. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section 3. This resolution shall take effect upon adoption.
