Miller, Administrative Assistant 08 November 1996 TO: Kyle Fegley, City Engineer RE: Initial Commentary on the Preliminary Design of SR 442 In response to your request for my comments regarding the widening of SR 442: I must register my most vigorous objection to the elimination of any of the traffic crossovers along SR 442. This corridor is the singlar access point to the majority of the Florida Shores development, the largest single residential development within the City of Edgewater. 1) U -turns would be required to access streets in Florida Shores, should any crossovers be eliminated. U -turns across a 4 lane roadway are extremely hazardous to any vehicles under the best of circumstances. For long wheel based apparatus, U -turns are especially dangerous. It is inevitable that there will be a large increase in both the frequency and severity of motor vehicle accidents at the points where U -turns are required. 2) As was vividly demonstrated after the recent tornado strike, ingress to this development would be problematic for Fire /Rescue, ambulance, and other long wheel based vehicles should any of these crossovers be eliminated. 3) Access to the fire suppression system within this development would be greatly impacted. Fire hydrants are located on the corners of intersections. - Eliminating crossovers will reduce our ability to safely and rapidly access fire hydrants located along SR 442. William C. NO.: 96 -156 Date: November 26, 1996 err" PUBLIC HEARING 12/02/96 RESOLUTION ORDINANCE OTHER CONSENT BUSINESS CORRESPONDENCE ITEM DESCRIPTION /SUBJECT: Public Hearing to Consider Utilization of U.S. Department of Justice Local Law Enforcement Block Grant BACKGROUND: The U.S. Department of Justice Bureau of Justice Assistance has approved the City's application for funding under the Local Law Enforcement Block Grants Program (LLEBGP) in the amount of $31,497.00. The City's application proposes a match by the City of $3,500.00. Prior to obligation of any of the funds received under the LLEBGP the City is required to comply with certain Special Conditions. One of the Special Conditions is a public hearing to consider the utilization of the Grant for the purpose of hiring an individual to perform telecommunicator and clerical functions within the Police Department. At the hearing persons shall be given an opportunity to provide written and oral views about the Police Department budget and the relation of the Grant to the entire budget. Another Special Condition required is the establishment of an advisory board to review the application for funding and make nonbinding recommendations to the City on the use of the funds received under the LLEBGP. Membership on the advisory board must include a representative from: the local police department; the local prosecutor's office; the local court system; the local public school system; and a local nonprofit, educational, religious or community group active in crime prevention or drug use prevention or treatment. Attached is a copy of the minutes of the meeting of the advisory board held on November 13, 1996. RECOMMENDATION /CONCLUSION: After the public hearing, Staff requests that the Council consider *`,acceptance of the Local Law Enforcement Block Grant in the amount of $31,497.00 with a match of $3,500.00 by the City and authorize the Mayor to sign the attached award document, acceptance of special conditions and Request for Payment. BACKGROUND: On November 19, 1996, six bids for the above referenced project were received and opened. The work involved is to provide a 110' diameter aluminum cover for the reuse storage tank, metering, chlorination, and reuse high service pumping improvements. RECOMMENDATION /CONCLUSION: The low bidder for the project was Wharton- Smith, Inc., the same company that constructed our current water plant. Their bid for this work is $347,000.00. I recommend the Edgewater City Council award the contract to Wharton- Smith, Inc. This workshop would also present Staff and Council with the opportunity to discuss the basic plans for the operation and staffing of this station and the future plans for the level of Fire /Rescue services for this City. BACKGROUND: Florida Law requires CCNA process for any governmental construction project that exceeds a certain threshold value. Since Fire /Rescue Station #57 will exceed that threshold, we are required to seek RFP's for CCNA services. I would also like to propose wording the RFP to include the design, project management, and construction of the Parks and Recreation maintenance facility, 26 acre project, and generic language to cover any other substantial City building project in the near term future. By doing so, the lead time required to procure these services would be eliminated and the costs of such services reduced, much the same as has been done with water, sewer, and other Utilities and Public Works projects. ow In addition to this request for permission to publish an RFP, Fire /Rescue needs an opportunity to discuss the level of emergency services operations provided to our citizens. We have developed a set of departmental goals and objectives and had them reviewed by a citizen review board. But, as of this time, these have not been discussed at a Council level or been formally adopted for implementation. Included in this strategic plan is the operation of Fire /Rescue Station #57 and a series of other operations and services. RECOMMENDATION /CONCLUSION: 1) Recommend approval of the request to publish an RFP for CCNA services for Fire /Rescue Station #57 and other general municipal building design and construction projects. 2) Set a date and time certain in March 1997, for a Council /Staff workshop on Fire /Rescue services. SUBJECT: Expansion of Library Parking Lot Mayor Hayman has asked that I provide a status report on the attached request from the Friends of the Library who have been informed that Volusia County has allocated funds for the expansion of the Edgewater Library parking area. I have discussed this with our City Engineer and wish to advise you of the status of the work he will provide to the County for the parking space. Kyle has scheduled the completion of the plans during the month of December and hopes to be able to submit the plans to the County this month. Council should be aware that the County's final allocation of total funds is the only source of funding anticipated for completing this project. Additionally, there are permits to be obtained from the State that will take considerable time before this project can go forward and our City Engineer, as you know, has been heavily involved with all the details for the road improvement project which have priority over all other work in the City. These details include the redesign work which must be submitted on a daily basis to the project construction company to prevent delays in work completion. The plans requested by Volusia County will be submitted in as timely a manner as Kyle can complete this work but this does not assure that this parking project will be completed until adequate funding is provided by the County for this work. Keenan brought a taxpayer class action composed of residents of the City of Edgewater, community of Florida Shores. They appeal from an order dismissing their suit on the pleadings. The trial court ruled that despite the possible merit of their complaints against the City of Edgewater ( "City "), stemming from requiring them to pay user fees commencing in 1964, and imposing on them ' NOV 25 '96 03 :57PM NABORS GIBLIN NICKER P.3/4 a special assessment in 1991 for a sewer /waste, water treatment plant, the lawsuit is barred by the four -year statute of limitations.' We agree and affirm_ Through the mechanism of this lawsuit, appellants sought to challenge a resolution passed by the City on August 6, 1991, which imposed special assessments on their properties for the construction of a water and sewer treatment plant. They claimed the new plant is to serve all parts of the City, but only property owners in Florida Shores were specially assessed to pay for the system. This lawsuit was not filed until December 21, 1995. There is little specific statutory guidance regarding when a cause of action on a wrongful municipal special assessment accrues for purposes of the running of a statute of limitations and which statute is applicable. Section 170.08 provides that a special assessment lien attaches to property at the time the governing board of the municipality equalizes and approves the special assessment by resolution, even if the improvements have not been completed, as in this case. J.& L Enterprises v. Jones, 614 So. 2d 1151 (Fla. 4th DCA), rev. denied, 626 So_ 2d 296 (Fla. 1993). Although it is not clear from the current statutes, special assessments by counties may be barred 60 days from the date the assessment is certified. § 194.171(2), Fla_ Stat. (1995).
