S AGENDA REQUEST Date: August 11, 1997 skew PUBLIC HEARINGS, ORDINANCES, AND RESOLUTIONS August 18, 1997 CONSENT AGENDA OTHER BUSINESS ITEM DESCRIPTION /SUBJECT: Evaluation and Appraisal Report (EAR) Resolution 97 -R -20 Adopting the EAR and Transmittal to the Florida Department of Community Affairs (DCA) BACKGROUND: �..- The Department of Community Development has completed the preparation of the evaluation and appraisal report. The EAR is a formal review of the 1990 Edgewater Comprehensive Plan. Its purpose is to identify information that needs to be updated and amendments that should be made to the plan. The Department of Community Development has prepared the EAR in accordance with the requirements of Chapter 163, Part II of the Florida Statutes and Rule 9J- 5.0053 of the Florida Administrative Code. Upon transmittal to DCA, the EAR will be reviewed to determine if it meets the requirements of the law. The City will not be able to amend its plan until DCA has determined that the EAR is sufficient. Once the EAR has been found in compliance by DCA, the City will have one year to make the plan amendments identified in the EAR. The EAR has been thoroughly reviewed by the LDRA.The LDRA acting in its role as the local planning agency reviewed drafts of the EAR at meetings held in February, April, and May. The LDRA held a formal public hearing on the EAR at their June 25th meeting. The LDRA voted 6 -0 to transmit the EAR to the City Council. RECOMMENDATION /CONCLUSION: Nay After hearing from staff and any interested members of the public, the Mayor and Council should consider approval of Resolution 97 -R -20 adopting the EAR and authorizing transmittal of the document to DCA. Storey City Attorney ear. req CITY OF EDGEWATER Land Development and Regulatory Agency Regular Meeting Wednesday, June 25, 1997 ,.,. 6:30 p.m. Chairman Masso called to order the regular meeting of the Land Development and Regulator Agency at 6:30 p.m., June 25, 1997 in the Community Center, 102 N. Riverside Drive, Edgewater, Florida. ROLL CALL Members present were Ms. Hickox, Mr. Moncure, Mr. Garthwaite, Ms. Agrusa, Mr. Hildenbrand and Chairman Masso. Ms. Lichter was recorded absent. Also in attendance were Mark P. Karet, Director of Communit Development, Krista A. Storey, City Attorney, Lynne Plaskett, Planner and Sondra M. Pengov, Board Coordinator. APPROVAL OF MINUTES A motion was made by Mr. Garthwaite to approve the minutes of May 28, 1997 and seconded by Ms. Agrusa. Motion CARRIED 6 -0. OLD BUSINESS Public Hearing - Review of "Draft" Evaluation and Appraisal Report (EAR) and Decision on Transmittal to City Council Chairman Masso opened the public hearing and asked Mr. Karet for his report. Mr. Karet stated the Evaluation and Appraisal Report was advertised as a legal ad, announcing the meeting date and the topic to be discussed. Mr. Karet said this discussion of the EAR of the Comprehensive Plan is a summar of previous meetings. He said all the recommended changes and additions have been addressed. Mr. Karet defined the meaning of the EAR. Amendments have been made in particular to land use. Mr. Karet said there has been few changes to the Plan since its adoption. Consequently, it is appropriate to do an assessment of the Comprehensive Plan to Land Development and Regulatory Agency Regular Meeting June 25, 1997 1 determine any required changes or information that should be incorporated into it. Mr. Karet said it is a law, required by Chapter 163, Part II of the Florida Statutes and Rule 9J- 5.0053 of the Florida Administrative Code. He said the City is required to prepare the EAR and send it to the LDRA for review, then it's to be transmitted to the City Council. The Council then transmits it to the Department of Community Affairs (DCA). The DCA will then conduct a sufficiency review to determine whether the City has sufficiently met the requirements of the law. Once this is completed the City has one year to amend the Comprehensive Plan to incorporate the identified changes. Mr. Karet said the "Draft" document before the Board has had significant changes made since the last "Draft ". Maps and tables have been included along with the changes. Mr. Karet also said an suggestions from the Board or the public will be incorporated into the document. Mr. Karet then reviewed the EAR Based Amendments of each element. After the review of each element, Mr. Karet addressed comments from the Board and the public. Mr. Moncure inquired of Mr. Karet, Policy 1.7, Access points to arterial and collector systems of the Traffic Circulation element. He questioned the north /south Florida Shores roads designated as collector roads. Mr. Moncure said his understanding was Queen Palm Drive was originally selected as a collector road because of VOTRAN service, but now has been changed to Willow Oak Drive. Mr. Karet responded that Willow Oak Drive has functioned as a collector, 'orw because of its location. Mr. Moncure also said north Mango Tree Drive may also be included as a collector. After discussion it was determined Policy 1.7 should be more clearly defined. Mr. Moncure also addressed Policy 5.1, Implement a Master Bikeway Plan by 1992 and asked if the Board may be supplied a copy of the Plan. William Lowe. 3003 Vista Palm Drive, questioned eliminating some of the north /south roads off S.R. 442. Mr. Karet responded, in two or three years the widening of S.R. 442 will eliminate some of the cross over roads. He said the City is working with F.D.O.T. to retain as many roads as possible. The next e lement discussed was the Housing Element of which Mr. Karet said significant revisions are required. He said the reasons being, it is ver population driven and there were aspects of the Housing Element that expected an aggressive approach toward housing. Mr. Karet stated the requirements followed were based on previous projections for growth. However, this growth has not materialized. Consequently, the targets have not been met and haven't needed to `Or► Land Development and Regulatory Agency Regular Meeting June 25, 1997 2 be met. Mr. Karet then addressed Board comments. Continuing, the next element discussed was the Infrastructure Element, Natural Groundwater section. Among the comments, it was suggested to include drainage from Florida Shores into Turnbull Hammock in this section. After discussion with the Board and no comments from the public, Mr. Karet moved on to the Coastal Management Element and the Conservation Element. Mr. Karet addressed the comments from the Board. There were no comments from the public. Chairman Masso called for a recess at 8:22 p.m. The meeting resumed at 8:31 p.m. Under the Recreation Open Space element, Mr. Moncure discussed the need for a g at the Turgot Avenue location. He questioned whether to assume the citizens need to be in support of this. Mr. Karet said an effort should be made to involve the citizens to accomplish the g It was agreed this should be done at a polic level. Mr. Karet then reviewed the Intergovernmental Coordination element, there being no comments from the Board or the public, he moved on to the Capital Improvement element. Chairman Masso asked if there would be an elimination of the enclaves in the City. Mr. Karet replied this has been investigated in the past. However, the Count has to be re- approached. The Count said the would give an agreement if there were no objections from the property owners, and the Cit abilit to provide infrastructure. There being no additional comments Chairman Masso closed the public hearing. Chairman Masso entertained a motion for approval of the EAR document to be sent to the Cit Council once the recommended changes and suggestions are completed by staff. Mr. Moncure moved to approve, seconded b Mr. Garthwaite. The motion CARRIED 6 -0. Mr. Moncure commended staff for the considerable amount of work done in preparing the document. NEW BUSINESS No New Business at this time. Land Development and Regulatory Agency Regular Meeting June 25, 1997 3 DISCUSSION ITEMS A. Community Director's Report Mr. Karet told the Board that the first reading for the request to rezone I -3 to I -1 at 417 W. Park Avenue, was approved b the Cit Council as well as the addition of aquaculture as a permitted use in the I -1 district. Mr. Karet informed the Board that the text amendment for a Bed and Breakfast had been denied b Council. He also said the request for an Institutional Residential Home, located at 1511 Mango Tree Drive had been approved by Council. Mr. Karet said the Department of Community Development received an application from Eckerd Drugs to build a new free standing building. B. Chairman's Report Chairman Masso made reverence to the letter received from Mr. Fazzone's son, expressing the families gratitude for the honors bestowed on his father by the Cit C. Agenc Member's Report No, Mr. Moncure suggested providing a copy of the LDRA's packet to the public for reference. Mr. Karet agreed, and said a packet would be provided. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. Pursuant to Section 163.3191, Florida Statutes, the Local Planning Agency is responsible for the preparation of an Evaluation and Appraisal Report of the City of Edgewater Comprehensive Plan (EAR)at least once every five years. The EAR shall be submitted to the City Council, who upon adoption or upon adoption with changes shall submit the EAR to the Department of Community Affairs. — 2. The Department of Community Development prepared the EAR in accordance with the requirements of Section 163.3191, Florida Statutes, and Rule 9J- 5.0053 of the Florida Administrative Code. The Local Planning Agency reviewed drafts of the EAR on February 26, 1997, April 23, 1997 and May 28, 1997. 3. On June 25, 1997, the Local Planning Agency held a public hearing to consider transmittal of the EAR to the City Council after publishing notice of such hearing in The News - Journal on June 21, 1997. That notice is attached hereto and incorporated by reference as Exhibit A. After conducting that public hearing the ''ftlI' Local Planning Agency voted 6 -0 to transmit the EAR to the City Council. 4. On August 18, 1997, the City Council held a public hearing to consider adoption of the EAR after publishing notice of such hearing in The News - Journal on August 11, 1997. That notice is attached hereto and incorporated by reference as Exhibit B. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. The Evaluation and Appraisal Report of the City of Edgewater Comprehensive Plan which is incorporated by reference is hereby adopted. 97 -R -20 1 Section 2. McMahon 'fir Chief of Police City anager lsk Attachment DISPATCH SERVICES INTERLOCAL AGREEMENT THIS INTERLOCAL AGREEMENT made this day of August, Now 1997, by and between the CITY OF EDGEWATER, FLORIDA, a municipal corporation, (hereinafter referred to as "Edgewater ") and the CITY OF OAK HILL, a municipal corporation, (hereinafter referred to as "Oak Hill ") . WHEREAS, Oak Hill has requested that Edgewater consider providing dispatch services to the Oak Hill Police Department; and WHEREAS, after evaluating the request, Edgewater has determined that it would be able to provide a professional dispatch service to Oak Hill without any appreciable impact on Edgewater's telecommunication staff and system; and Nor WHEREAS, Edgewater and Oak Hill have the authority to enter into this Interlocal Agreement pursuant to Section 163.01, Florida Statutes. NOW, THEREFORE, in consideration of the foregoing and the mutual promises hereinafter expressed, the parties mutually agree as follows: 1. Edgewater will provide dispatch services for the Oak Hill Police Department. Dispatch services will not be provided by Edgewater for fire and rescue services in Oak Hill. Incoming 911 fire and rescue calls from Oak Hill will be transferred by Edgewater to EVAC Ambulance. Nor 2. Edgewater will develop the administrative policies and procedures necessary to implement the provision of dispatch services to Oak Hill. Oak Hill shall be responsible for compliance with the developed policies and procedures. 3. Based on the current level of calls, Edgewater will provide dispatch services to Oak Hill at no cost. However, Oak Hill shall be responsible for the cost of all activities, services and equipment necessary to enable Edgewater to provide dispatch services, including, but not limited to, the reprogramming of Oak Hill's radios with Edgewater's EDG1 and EDG2 modules, modifying the `ur 911 system to route Oak Hill's calls to Edgewater, and additional Agreemnt \Intrlocal - Dispatch July 28, 1997 1 911 lines into the Edgewater Police Department. 4. This Agreement shall be effective from October 1, 1997, until terminated by either party upon sixty (60) days written notice. However, Edgewater reserves the right to request a renegotiation of the fee arrangement at such time as Edgewater, in its sole discretion, determines that the level of calls from Oak Hill has increased to such an extent that it is necessary for Edgewater to be compensated for the provision of dispatch services. 5. To the extent authorized by law, Oak Hill shall indemnify, defend, and hold Edgewater harmless from any and all liability, claims, demands, damages, expenses, fees, fines, penalties, suits, proceedings, actions, and costs of actions, including reasonable attorney's fees of any kind or nature arising or growing out of 14011' Edgewater's provision of dispatch services except as shall have been occasioned by the sole negligence of Edgewater. 6. This Agreement shall be filed with the Clerk of the Circuit Court of Volusia County, Florida, prior to its effectiveness. 7. This Agreement is not assignable by either party without the written permission of the other party. 8. This Agreement may only be amended by a written document signed by both parties. Any amendment must be filed with the Clerk of the Circuit Court prior to its effectiveness. 9. If any provision of this Agreement is held to be invalid, illegal, or unenforceable, that shall not affect or impair the validity, legality, or enforceability of the remainder of this Agreement. 10. This Agreement embodies the whole understanding of the parties. There are no promises, terms, conditions, or obligations other than those contained herein, and this Agreement shall supersede all previous telecommunication, representations, or agreements, either verbal or written, between the parties hereto. 11. Oak Hill usually only has one car on day shift and a two man car working at nights. I checked their area to see how the 800 radio system performed and I had no problems reaching our department. There will be no cost to our department to dispatch for them. The only cost involved will be for Oak Hill PD to re- program their radios with our EDG1 and EDG2 module. The cost for Oak Hill will be $350.00. There is no cost to have the phone company change the 911 lines to ring into our department. If a problem arises and we find we need more than the two 911 lines we have coming into dispatch, there will be no cost to put additional lines in. BACKGROUND: The existing 1970 Ford Emergency Response Support Unit is mechanically unsound and has been removed from routine service due to its unsafe condition. Fire /Rescue's budget has an approved funding amount of $60.000 for the replacement of this critical apparatus. This unit carries heavy extrication equipment, hazardous materials containment supplies and chemical suits, large volume breathing air supply, confined spaces rescue equipment, and other specialized tools, equipment, and supplies too numerous to list. By purchasing the chassis and body separately and having them mated by Centennial Truck Body, Fire /Rescue will purchase an apparatus that is designed around their specific needs at a savings of more than $30,000 over purchasing a commercially designed and built specialty response apparatus. RECOMMENDATION /CONCLUSION: Council consider approval for the purchase of: 1) a GMC Heavy truck chassis from King Truck Center using the purchase contract from the City of Gainesville, Florida purchasing contract, in the amount of $32,925, and 2) an all aluminum utility body from Centennial Body in the amount of $12,784. The purchase price to Centennial Body includes the mounting of the utility body to the chassis and painting of both body and chassis. The existing apparatus is mechanically broken down on more than 50% of it's responses due to 25+ years of emergency duty driving on this city's unpaved streets. In March of this year, we researched the purchase of the cab & chassis and requested permission to purchase off of the City of Gainesville's existing bid. This would purchase a heavy Duty GMC Diesel truck cab & chassis (from Kings *.lo.. Truck Center) upon which to mount the utility body. The City Council directed us to table the purchase until such time as the utility body was ready for purchase. In May, the City Attorney's office released the utility body chassis for solicitation of Bids. The City received no bids from that solicitation. Review of those bids revealed some area for improvements in the bonding requirements and approval testing, but the base construction requirements of the utility body remained unchanged. The City Attorney's office released the revised specifications in June and the request for bids advertised again. On July 27th, a sole bid was opened in the amount of nearly $48,000 for the purchase of a utility body and mounting that body on a chassis provided by the City. The budget for the purchase of this utility body is $20,000. The $48,000 bid was for an NFPA compliant fire truck; the City desires to purchase a utility and support apparatus. After research and review, the City Attorney has determined that the City has exercised due diligence and good faith in the solicitation of bids for this utility body on 2 different occasions, unsuccessfully. EDGEWATER'S LIFE FORCE Section #8 of the City's Purchasing Regulations provides several exceptions to the requirement for bidding of capitol purchases one of which, Paragraph J, states that "when bids /quotations have been solicited and no responsive bid has been received... ". Attorney Storey has stated that this ` situation now exists with respect to the attempted purchase of this utility body. Based upon the City Attorney's determination of our eligibility for the exemption from the bidding requirement, I am requesting permission to waive the bid requirements and negotiate with known vendors of utility bodies for the lowest price for purchase.
