2001-R-05RESOLUTION NO. 2001-R-05 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGE WATER, FLORIDA, AMENDING THE SCHEDULE OF SURCHARGES, FEES AND CIVIL PENALTIES RELATING TO CHAPTER 5 (ANIMAL CONTROL); REPEALING RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. In 1997, the City of Edgewater enacted the "Schedule of Fees, Surcharges and Civil Penalties" relating to Chapter 5 (Animal Control). 2. No modifications have been made to the Schedule in the last four (4) years. 3. The Animal Control Board reviewed the existing Schedule and submitted modifications for incorporation to City Council. 4. It is necessary for Council to adopt a new Schedule that includes the recommended modifications. NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater, Florida: Section 1. Establishing a Surcharge on Civil Penalties Pursuant to Section 828.27(4)(b), Florida Statutes, and Section 5-70(h) of Chapter 5 (Animal Control), a surcharge of five and no/100 dollars ($5.00) is hereby imposed upon each civil penalty imposed for a violation of Chapter 5 (Animal Control) of the Code of Ordinances, City of Edgewater, Florida. Section 2. Establishing Schedule of Fees and Civil Penalties Pursuant to Chapter 5 (Animal Control), the schedule of fees and civil penalties set forth in 2001-R-05 1 Exhibit "A", attached hereto and incorporated by reference, is hereby established. Section 3. All resolutions or parts of resolutions in conflict herewith be and same are hereby repealed. Section 4. This resolution shall take effect upon adoption.
