RESOLUTION NO. 99-R-10
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, VACATING BLOCK 1 AND 6
THROUGH 21, J. K. ROWLEY'S SUBDIVISION; PROVIDING
THAT UPON ADOPTION A CERTIFIED COpy OF THIS
RESOLUTION SHALL BE FURNISHED TO THE VOLUSIA
COUNTY COUNCIL; REPEALING ALL RESOLUTIONS IN
CONFLICT HEREWITH AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Council of the City of Edgewater, Florida, had made the following
determinations:
1. South V olusia Properties, Inc., James Lau, President has requested the vacation of
Block 1 and 6 through 21, J. K. Rowley's Subdivision.
2. A public hearing was held on June 21, 1999, after notice of the request was published
in the Observer on June 10, 1999, and notifying by mail all property owners who own real property
directly affected by the proposed action and all property owners who own real property within 500
feet of the subject property.
3. The City Council has determined that is in the best interests of the citizens of
Edgewater to approve the requested abandonment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edge water,
Florida:
Section 1.
The following described portion of property (Block 1 and 6 through 21, J. K.
Rowley's Subdivision) is hereby vacated:

A portion of the Southwest 1/4 ofthe Northeast 1/4 and a portion of
the 9.785 acres as described in Official Records Book 1729, Page

at an iron pin on the Southeast corner of the Northwest 1/4 of the
Northeast 1/4, said iron pin also being described as the Northeast
corner of the Southwest 1/4 of the Northeast 1/4; thence South
00021'54" East along the East line of the said Southwest 1/4 of the
Northeast 1/4, a distance of 580.43 feet; thence North 26041 '41 "

Section 2.
Upon adoption, pursuant to the provisions of Section 177.101(4), Florida
Statutes, the City Attorney's Office is hereby directed to send a certified copy ofthis resolution to
the V olusia County Council.
Section 3.
All resolutions or parts of resolutions in conflict herewith be and the same are
hereby repealed.
Section 4.
The applicants are hereby advised that pursuant to Section 177.101 (4), Florida
Statutes, in order to complete the vacation process, subsequent to action by the City Council, an
application for plat vacation must be filed with V olusia County.
Section S.
This resolution shall take effect upon adoption.
