RESOLUTION NO. 92-R-27
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, VACATING A PORTION OF
LOTS 30, 31, 32 AND 33 OF THE FERNALD AND
CHADWICK'S SUBDIVISION; PROVIDING THAT UPON
ADOPTION A CERTIFIED COPY OF THIS RESOLUTION
BE FURNISHED TO THE VOLUSIA COUNTY COUNCIL;
REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. Bill Cichewicz has requested the vacation of a portion of
Lots 30, 31, 32, and 33 of the Fernald and Chadwick's Subdivision
for the purpose of creating a single undivided parcel of land for
the purpose of expanding an existing duplex.
2. On November 12, 1992, the Land Development and Regulatory
Agency recommended approval of the requested vacation.
3. It is in the best interests of the citizens of Edgewater
to approve the requested plat vacation.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida:
Section 1. That the following described portion of Fernald
and Chadwick's Subdivision is hereby vacated:
All of Lot 31 and 30, except the Easterly 5.00 feet
thereof, FERNALD AND CHADWICK'S SUBDIVISION of a part of
HAWK'S PARK, in the City of Edgewater, Florida, as per
map recorded in Map Book 4, Page 192, Public Records of
Volusia County, Florida, and Lots 32 and 33, except
triangle and except Westerly 27 feet now in State Road,
FERNALD AND CHADWICK'S SUBDIVISION as shown on map in Map
Book 4, Page 192 of the Public Records of Volusia County,
Florida.
Section 2. That upon adoption, the City Attorney is hereby
directed to send a certified copy of this resolution to the Volusia
County Council pursuant to the provisions of Section 177.101(4),
Florida Statutes.
Section 3. That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 4. This resolution shall take effect upon adoption.
