RESOLUTION NO. 92-R-26
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, VACATING THAT PORTION
OF J. K. ROWLEY'S SUBDIVISION LYING WITHIN
LOTS 1 THROUGH 10 OF THE WINDSOR UNRECORDED
SUBDIVISION; PROVIDING THAT UPON ADOPTION A
CERTIFIED COPY OF THIS RESOLUTION BE FURNISHED
TO THE VOLUSIA COUNTY COUNCIL; REPEALING ALL
RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. Thomas Wright, on behalf of Eugene Pishnery, requested
the vacation of that portion of J. K. Rowley's Subdivision which
lies within Lot 9 of the Windsor Unrecorded Subdivision.
2. Based on the potential title problems common to all lots
within the Windsor Unrecorded Subdivision, on November 12, 1992,
the Land Development and Regulatory Agency recommended approval of
the vacation of that portion of the J. K. Rowley's Subdivision
which lies within Lots 1 through 10 of the Windsor Unrecorded
Subdivision.
3. It is in the best interests of the citizens of Edgewater
to approve the requested plat vacation recommended by the Land
Development and Regulatory Agency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida:
Section 1. That the following described portion of J. K.
Rowley's Subdivision, according to the plat thereof recorded in Map
Book 9, Page 83 of the Public Records of Volusia County, Florida,
is hereby vacated:
West 1/4 of the Northwest 1/4 of the Southeast 1/4,
Section 2, Township 18 South; Range 34 East.
Section 2. That upon adoption, the City Attorney is hereby
directed to send a certified copy of this resolution to the Volusia
County Council pursuant to the provisions of Section 177.101(4),
Florida Statutes.
Section 3. That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 4. This resolution shall take effect upon adoption.
