Land Development Code Workshop

1. CALL TO ORDER
Chairman Vopelak called to order the Land Development Code Workshop of the Planning and Zoning
Board at 8:30 a.m., April 26, 2006 in the Community Center, 102 N. Riverside Drive, Edgewater,
Florida.
2. ROLL CALL
Members present were Edwin Vopelak, Pat Card, David Ross, and John Weiss. Todd Fuhrmann,
Sandy Jones and Charlene Zeese were absent. Also present were City Manager Ken Hooper,
Assistant City Manager Liz McBride, Development Services Director Darren Lear, Finance Director
Jon Williams and Planning Technician Bonnie Wenzel.
3. DISCUSSION OF PROPOSED CHANGES TO THE LAND DEVELOPMENT CODE
Chairman Vopelak stated he was concerned the changes would promote urban sprawl.
Mr. Card stated he was concerned with the lack of flexibility. He is also concerned about
development within the floodplain.
Chairman Vopelak thought suggested indicating where in the City high-rise buildings can be located.
Mr. Weiss was concerned about the rush to get the changes to the Land Development Code adopted.
Mr. Hooper stated that City Council was not pleased with methods used by the past Council. He
added they do not like 50-foot lots. Mr. Hooper stated that staff proposed most of the other changes
in the Code.
Mr. Ross stated he sees an effort to urbanize a small town. He added that a vision was needed from
City Council for the City. Mr. Ross stated that the City should do what the citizens want, not what
outside groups want.
Greg Blase, Volusia Home Builders Association, stated that a middle ground was needed for the City.
Mr. Weiss stated he felt the section in the Code on vested rights needs to be more flexible.
Mr. Card felt that those who would be affected by the changes should be notified. He also stated that
they could recommend to Council that if a PUD Agreement is approved, then the development is
vested.
There was discussion as to when a development would be considered vested. Mr. Lear suggested at
Future Land Use Map amendment approval.
The consensus of the Board was to have development vested once the Future Land Use Map
amendment was approved.
