07-15-2004 CITY OF EDGEWATER Charter Review Committee Minutes DR AFT Thursday, July 15, 2004 4:00 p.m. 1. CALL TO ORDER Chairman Card called to order the regular meeting of the Charter Review Committee at 4:00 p.m. 2. ROLL CALL Members present were Pat Card, Donna Wagner, Bob Lott and Bill Miller. Also present were City Manager Ken Hooper, Assistant City Manager Liz McBride, Paralegal Robin Matusick, Committee Secretary Bonnie Wenzel, News Journal reporter Lynn Bulmahn. 3. APPROVAL OF MINUTES Ms. Wagner moved to accept the minutes of June 16, 2004 as presented, second by Mr. Miller. MOTION CARRIED 4 -0. 4. OLD BUSINESS There was no old business at this time. 5. NEW BUSINESS A. Public Comments There were no public comments at this time. B. Member Reports There were no member reports at this time. C. Review of Ordinance No. 2004 -0 -25; first reading to be heard by City Council on July 19, 2004. Exhibits "E -1" and "B -1" with suggested changes from Mr. Heeb were provided to the committee members. Ms. Matusick explained Exhibit "E -1 ". Mr. Lott moved to include the recommended changes to Exhibit "E -1" in Ordinance 2004 -0- 25, second by Ms. Wagner. MOTION CARRIED 4 -0 Ms. Matusick went over Exhibit "B -1" with the committee. Mr. Hooper stated these recommendations were good; they were cleaning up the language. Mr. Miller moved to decline the recommended changes to Exhibit "B -1 ", concerning rotation of the Vice Mayor, second by Ms. Wagner. MOTION CARRIED 4 -0. 7 -15 -04 minutes 1 CITY OF EDGEWATER Charter Review Committee Minutes Thursday, July 15, 2004 4:00 p.m. Chairman Card asked how the committee would convey their recommendations to Council. Mr. Miller suggested letting the minutes speak for them. Ms. Wagner moved to accept Ordinance 2004 -0 -25 as is, with the recommended changes to Exhibit "E -1 ", second by Mr. Lott. There was discussion regarding Ballot Questions 4 and 5. Mr. Lott moved to add "Police Department/Fire Rescue Services" after Public Safety Services on ballot question 4, second by Mr. Miller. MOTION CARRIED 4 -0. Mr. Miller moved to add "Police Chief/Fire Chief" after Public Safety Services on ballot question 5, second by Ms. Wagner. MOTION CARRIED 4 -0. There was further discussion regarding whether the language was clear enough concerning Public Safety Services. The tape of the Charter Review Committee reflects the discussion. The proposed Charter amendment creates a department concerning Public Safety (Police Department or Fire Rescue Services). Chairman Card entertained a motion to eliminate all language in the Charter naming the Police and Fire Departments. Further discussion ensued. Motion repeated for clarification: Ms. Wagner moved to accept Ordinance 2004 -0 -25 as is, with the recommended changes to Exhibit "E -1 ", second by Mr. Lott. Section 4.11 (Residency requirements for certain city employees) of Article IV (Administration) ofthe Charter ofthe City ofEdgewater is amended to read as follows: Sec. 4.11. Residency requirements for certain city employees. Except as to the city manager, police chief and fire chief, the city council may waive the residency requirement if the waiver is deemed to be in the best interests of procuring the services of the most qualified professional applicant. This section shall not apply to any department head or city olcer emplQyee hired prior to the effective date o f this section ... .. .., • t EXHIBIT "E -3" ORDINANCE #2004 -O-25 b) Ballot Ouestion: BALLOT QUESTION #5 CHARTER AMENDMENT TO LIMIT THE CITY EMPLOYEES REQUIRED TO RESIDE WITHIN THE CITY TO: CITY MANAGER, CITY ATTORNEY, CITY CLERK, AND ALL DEPARTMENT HEADS IN CHARGE OF PUBLIC SAFETY SERVICES. Shall the above - described amendment be adopted? Yes No Ferd Heeb - Comments EXHIBIT "B-1" ORDINANCE #2004 -O-25 (a) Text of Proposed Amendment. Section 3.06 (Mayor) of Article III (City Council) of the Charter of the City of Edgewater is amended to read as follows: Sec. 3.06. Mayor. The mayor shall be a member of the city council and preside at meetings of the council. The mayor shall be recognized as head of the city government for all ceremonial purposes, by the governor for purposes of military law, for service of process, and execution of contracts, deeds and other documents, but shall have no administrative duties. Any additional duties of the mayor shall be such as are conferred upon the mayor by the council.
