A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, VACATING ALL OF BLOCKS
A, B, C, D AND E IN HIGHLAND SHORES
SUBDIVISION, SECTION 4 AND THE REMAINING
PORTION OF LOT 18 WEST OF THE RAILROAD;
PROVIDING THAT UPON ADOPTION A CERTIFIED COpy
OF THIS RESOLUTION SHALL BE FURNISHED TO THE
VOLUSIA COUNTY COUNCIL; REPEALING ALL
RESOLUTIONS IN CONFLICT HEREWITH AND PROVIDING
FOR AN EFFECTIVE DATE.

WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. Oscar Zeller and Julian Greene have requested the
vacation of a portion of the Highland Shores Subdivision Plat.
2. A public hearing was held after notice of the request was
published in the Daytona News-Journal on December 6, 1995, and
notifying by mail all property owners who own real property
directly affected by the proposed action and all property owners
who own real property within 500 feet of the subject property. Due
to the lateness of the hour, the public hearing originally
scheduled for December 18, 1995, was continued until December 19,
1995.
3. The City Council has determined that is in the best
interests of the citizens of Edgewater to approve the requested
abandonment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida:
Section 1. The following described portion of Highland Shores
Subdivision is hereby vacated:
All of Blocks A, B, C, D and E in Highland
Shores Subdivision, Section 4, as per Map Book
8, Page 80 of the Public Records of Volusia
County, Florida; and the remaining portion of
Lot 18 west of the railroad, sometimes known
as Lot 16 and 16A west of the railroad, of the
Assessor's Subdivision of the Sheppard and
Sanchez Grants as per Map Book 3, Page 49, and
also Map Book 14, Page 99 of the Public
Records of Volusia County, Florida.
Section 2.
Upon adoption, pursuant to the provisions of
Section 177.101(4), Florida Statutes, the City Attorney is hereby
directed to send a certified copy of this resolution to the Volusia
County Council.

Section 3. All resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 4. This resolution shall take effect upon adoption.
Section 5. The applicants are hereby advised that pursuant to
Section 177.101(4), Florida Statutes, in order to complete the
vacation process, subsequent to action by the City Council an
application for plat vacation must filed with Volusia County.
After Motion by Councilman Hatfield and Second by
Councilwoman Martin, the vote on this resolution was as follows:
