CALL TO ORDER
Chairperson Linda Johnson called the regular meeting of the Code Enforcement
Board to order at 2:03 PM in the Community Center.
ROLL CALL
Members present: Linda Johnson, Glenn Barnhill, Gail Anderson, Ben Wagner,
Alice Haldeman, and Sherry Lester. Also present were Code Supervisor Jeff
Lariscy, Code Officer Mike McGrath, and Board Coordinator Shontella Jackson.
Absent and excused Ed Corn.
APPROVAL OF MINUTES
The Minutes for the regular meeting of April 12, 2012 were presented to the
Board for approval. MOTION by Alice Haldeman, SECOND by Glenn
Barnhill to adopt the minutes of Regular Citizen Code Enforcement
Board on A. ril 12 2012 as written. MOTION CARRIED UNANIMOUSLY.

summary to the Board. Code Officer Mike McGrath presented staff's
recommendation to find William A. Hamilton in violation of Section 7 -1 of the
Code of Ordinances continuing the citation fine of $75.00 and an additional fine
of $50.00 per day each day the violation continues to exist past May 11, 2012
and for a lien to be placed on the property if not satisfied by May 16, 2012. (B)
Code Officer Mike McGrath presented the case summary to the Board. Code
Officer Mike McGrath presented staff's recommendation to find William A.
Hamilton in violation of Section 21 -36.02 of the City of Edgewater Code of
Ordinances. It is the recommendation of the staff that the Board finds William A.
Hamilton in violation of Section 21 -36.02 of the Code of Ordinances and continue
the citation fine of $75.00 and an additional fine of $50.00 per day each day the
violation that continues to exist past May 11, 2012 and for a lien to be placed on
the property if not satisfied by May 16, 2012.
William Hamilton was present and testified that he was not aware that the
contractor he hired did not pull a permit. Mr. Hamilton stated that the contractor
placed a pink piece of paper on his fence and removed it when he completed the
job; therefore he assumed a permit was pulled. Mr. Hamilton stated that he
does not have any way of contacting the contractor. Mr. Hamilton stated that he
installed the shed up. Mr. Hamilton stated he thought because he had an
existing shed he would be okay with setbacks on the property. Mr. Hamilton

stated it was a month and half after the shed had been installed until he had
contact with the City of Edgewater. Mr. Hamilton stated that he did go and
applied for a permit afterwards. Mr. Hamilton stated that he was in constant
contact with Dennis Fisher and was informed to wait. He also stated that he was
advised by Dennis Fisher & Mike McGrath to appear before the Code
Enforcement Board. Mr. Hamilton stated he thought he would be grandfathered
in regarding the setbacks since a shed existed on the property. Mr. Hamilton
requested that the Board grants him thirty days before any fines or liens are
accessed. Chairwoman Linda Johnson closed the public hearing. The Board had
a brief discussion.
MOTION by Alice Haldeman, SECOND by Gail Anderson that the Board
finds William A. Hamilton in violation of Section 7 -1 of the Code of
Ordinances postponing fines and liens until the regular scheduled
meeting in August 2012. MQTION CARRIED 5 -1.
MOTION by Alice Haldeman, SECOND by Gail Anderson that the Board
finds William A. Hamilton in violation of Section 21 -36.02 of the Code

NEW BUSINESS:

Corp LLC, Violation of Section 21 -54.02 (Installation standards).
Code Supervisor Jeff Lariscy presented the case summary to the Board. Code

LLC in violation of Section 21 -54.02 of the Code of Ordinances assessing a
citation fine of $75.00 and an additional fine of $100.00 per day per violation
that continues to exist past May 11, 2012 and for a lien to be placed on the
property if not satisfied by May 16, 2012. No one was present to testify.

Code Officer Mike McGrath gave a brief update stating the Mr. Carder is currently
in compliance. No one was present to testify.
OTHER BUSINESS:

The stats are as follows: 106 new cases and 132 cases currently being worked.
