94-R-05 ( ~ """'" RESOLUTION NO. 94-R-OS A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, ESTABLISHING FINES AND SERVICE CHARGES FOR ALARM SYSTEMS; REPEALING RESOLUTIONS IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, has made the following determinations: 1. On March 21, 1994, the City Council adopted Ordinance No. 94-0-06 creating Article III (Alarm Systems) of Chapter 12 (Offenses and Miscellaneous provisions) of the Code of Ordinances. 2. Section 12-62 of Article III provides that any person who does not obtain the required alarm permit shall be subject to a fine as established by a resolution of the City Council. 3. Section 12-67 of Article III provides that an alarm user shall be charged a service fee as established by a resolution of the City Council for response to excessive alarms by the Police Department and/or Department of Fire and Rescue Services. 4. It is in the best interest of the citizens of Edgewater that these fines and services charges be established at this time. NOW THEREFORE, BE IT ENACTED by the City Council of the City of Edgewater, Florida: Section 1. Fine for Failure to Obtain Alarm Permit. A fine of twenty-five and 00/100 dollars ($25.00) is hereby established for failure to obtain the alarm permit required by Section 12-62 of the Code of Ordinances. Section 2. Service Charge for Response to Excessive False Alarms by Police Department. For response to excessive false alarms by the Police Department, the alarm user shall be charged a service fee of fifty and 00/100 dollars ($50.00) for the first false alarm in excess of three false alarms in any six (6) month period; seventy-five and 00/100 dollars ($75.00) for the second false alarm in excess of three (3) false alarms in any six (6) month period; and one hundred and 00/100 dollars ($100.00) for the third and each successive false alarm in excess of three (3) in any six (6) month period. 94-R-OS 1 Section 3. Service Charge for Response to Excessive False Alarms by the Department of Fire and Rescue Services. For response to excessive false alarms by the Department of Fire and Rescue Services, the alarm user shall be charged a service fee of one hundred twenty-five and 00/100 dollars ($125.00) for the first false alarm in excess of three false alarms in any six (6) month period; one hundred fifty and 00/100 dollars ($150.00) for the second false alarm in excess of three (3) false alarms in any six (6) month period; and two hundred and 00/100 dollars ($200.00) for the third and each successive false alarm in excess of three (3) in any six (6) month period. Section 4. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. Section S. This resolution shall take effect on May 1, 1994.
