91-R-66RESOLUTION NO. 91-R-66 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, ELECTING TO USE THE UNIFORM METHOD OF COLLECTING NON -AD VALOREM SPECIAL ASSESSMENTS LEVIED IN THE FLORIDA SHORES IMPROVEMENT AREA; STATING A NEED FOR SUCH LEVY; PROVIDING FOR THE MAILING OF THIS RESOLUTION; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Edgewater, Florida, (the City) pursuant to Ordinance No. 91-0-1 established the Florida Shores Improvement Area and adopted Resolution Nos. 91-R-9 and 91- R-46 levying the Florida Shores Improvement Area Special Assessment for the cost of the construction of a wastewater collection system including any necessary road restoration and resurfacing and a portion of an advanced wastewater treatment facility commencing for the city's 1992 - 1993 Fiscal Year; and WHEREAS, the City Council intends to use the uniform method of collecting non -ad valorem special assessments as authorized by Section 197.3632, Florida Statutes, because this method will allow the Florida Shores Improvement Area Special Assessment to be collected annually commencing November 1992, in the same manner as provided for ad valorem taxes; and WHEREAS, the City Council held a duly advertised public hearing prior to adoption of this Resolution, proof of publication of such hearing being attached hereto and incorporated by reference as Exhibit A. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: SECTION 1. Commencing with the 1992 - 1993 Fiscal Year and with the tax statement mailed for such Fiscal Year, the City intends to use the uniform method of collecting non -ad valorem assessments authorized in Section 197.3632, Florida Statutes, for collecting non -ad valorem assessments levied in the Florida shores Improvement Area special Assessment District for the cost of the construction of a wastewater collection system including any necessary road restoration and resurfacing and a portion of an advanced wastewater treatment facility. A legal description of the area subject to the assessment is attached hereto and incorporated by reference as Exhibit B. SECTION 2. The City hereby determines that the levy of the assessments is needed to fund the cost of the construction of a wastewater collection system including any necessary road restoration and resurfacing in the Florida Shores Road Area and a portion of an advanced wastewater treatment system which will provide service within the Florida Shores Improvement Area. SECTION 3. Upon adoption, the City Attorney is hereby directed to send a copy of this Resolution by United States mail to the Florida Department of Revenue, the Volusia County Property Appraiser, and the Volusia County Tax Collector by January 10, 1992. SECTION 4. That all resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed. SECTION 5. That this resolution shall take effect immediately upon its adoption by the City Council of the City of Edgewater, Florida, at a Regular meeting of said Council held on the 16th day of December 1991, and approved as provided by law. MA OR AppTrovfd for form: nor s• CITY OF EDGEWATER NOTICE OF INTENT TO USE UNIFORM METHOD OF COLLECTING MON-AD VALOREM ASSESSMENTS THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, (the "City Council") hereby provides notice pursuant to Section 197.3632(3)(a), Florida Statutes, of its intent to use the uniform method of collecting non -ad valorem special assessments to be levied in the Florida Shores Improvement Area Special Assessment District for the cost of the construction of a wastewater collection system including any necessary road restoration and resurfacing and a portion of an advanced wastewater treatment facility commencing for the City's 1992 -1993 fiscal year. The Council will consider the adoption of a resolution electing to use the uniform method of collecting such assessments authorized by Section 197.3632, Florida Statutes, at a public hearing to be held at its regular meeting on Monday', the 16th day of December, 1991, at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Edgewater Community Center, 104 N. Riverside Drive, Edgewater, Florida. Such resolution will state the need for the levy and will contain a legal description of the boundaries of the real property subject to the levy. Copies of the proposed resolution which contains the legal description of the real property subject to the levy are on file at the office of the City Clerk, 104 N. Riverside Drive, Edgewater, Florida. All interested persons are invited to attend. .If a person decides to appeal any decision made by the City Council with respect to any matter considered at a meeting or hearing, he will need a record of the proceedings, and for such purpose may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is based.
