A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
EDGEWATER, FLORIDA, VACATING A PORTION OF J.A.
BENOIT'S SUBDIVISION; PROVIDING THAT UPON
ADOPTION A CERTIFIED COPY OF THIS RESOLUTION
BE FURNISHED TO THE VOLUSIA COUNTY COUNCIL;
REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, John Massey has requested the vacation of a portion
of J.A. Benoit's Subdivision for the purpose of constructing a
roadway which would provide safer access from Park Avenue to the
Massey Ranch Airpark, Unit 1 subdivision; and
WHEREAS, on November 14, 1991, the Land Development and
Regulatory Agency recommended approval of the requested vacation in
conjunction with the proposed dedication to the City of Edgewater
by John Massey of the right-of-way for the roadway; and
WHEREAS, the City Council has determined that it is in the
best interests of the citizens of Edgewater to approve the
requested plat vacation.
NOW, THEREFORE, be it resolved by the City Council of the City
of Edgewater, Florida:
Section 1. That the following described portion of J.A.
Benoit's Subdivision is hereby vacated:
A portion of Lots 4. 5, 6, and 7, Block B3, and a portion of
Lots 3, 4, 5 and 6, Block B4, together with a portion of
Marion Street, lying southerly of said Block B3 and Northerly
of said Block B4, together with a portion of the platted Park
Avenue, lying Northerly of said Block B3, J.A. Benoit's
Subdivision, according to plat thereof recorded in Map Book 7,
page 39 of the Public Records of Volusia County, Florida, and
being more particularly described as follows: Beginning at
the southwest corner of said Lot 6, Block B4, said point of
beginning, also being the southwesterly corner of the G.
Alvarez Grant, section 52, Township 17 South; Range 34 East;
thence N 13 degrees 40' 49" W along the Westerly line of said
Blocks B3, and B4, a distance of 393.77 feet to the northerly
line of Park Avenue, as shown on said J.A. Benoit's
Subdivision; thence N 67 degrees 07, 54" E along said
Northerly line, a distance of 202.54 feet; thence S 23 degrees
08' 41" E along the Westerly line of Wildwood Subdivision,
according to plat thereof recorded in Map Book 35, page 199 of
the Public Records of Volusia County, Florida, a distance of
419.66 feet to the Southerly line of said Benoit's
Subdivision; thence S 73 degrees 43' 53" W along said
Southerly line, distance of 269.22 feet to the Point of
Beginning. Containing 2.19 acres more or less.
Section 2. That upon adoption, the City Attorney is hereby
directed to send a certified copy of this resolution to the Volusia
County Council pursuant to the provisions of Section 177.101(4),
Florida Statutes.
Section 3. That all resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 4. That this resolution shall take effect immediately
upon its adoption by the City Council of the City of Edgewater,
Florida, at a Regular meeting of said Council held on the 16th
day of December , 1991, and approved as provided by law.
This resolution was introduced and sponsored by Councilman
Hays and was read and passed by a vote of the City Council
of the City of Edgewater, Florida, at a Regular meeting of
said Council held on the 16thday of December 1991 and
authenticated as provided by law. ,
