Shellenbarger , requesting permission to build and maintain a clock for landing purposes • at east end of Park Avenue on river front . Referred to committee on streets and highways, for action. Science Park, regarding honorable mention being made of Volusia County exhibit at Sesqui- Centennial Exposition at Philadelphia. Motion by A. R. Patch that communication be accepted and filed , seconded by A. 13. UUilkinson, and unanimously carried. REPORTS OF STANDING COL;I:aT mES: The committee on by laws and ordinances , t.. R. ; Patch, chairman: The committee has secured a copy of the New Smyrna City Code of 1921, and proposes to use this Code as a basis for formulating and ,resenting to the council at a 'later date such ordinances as :ay be advisable. On motion by A. B. Jilkinson, seconded by . . H. Lohman, the report was accepted by the council. The committee on building and construction, A. R. Patch, chairman: The chairman handled a complaint by J. 0. aebster regarding the construction k of a certain house being built near the north end of t town, by consulting withthe builder and with the com- t plainant. The matter was satisfactorily adjusted. 4 On motion by A . B. 'Jilkir_son, seconded by E. H. Lohman, ! am the report was accepted by the council. The committee on streets and highways, A. B. 1;iilkinson_, chairman: The chairman reported that the committee had taken no action in any case, therefore , there was nothing to report . On motion by A. R. Patch, seconded by E. H. Lohman, the report was accepted by l the council. k $ - ..,w A '4"01) REPORT'S OF STANDING COMMITTEES: (Continued) The committee on finance and auditing, E. H. Lohman, chairman: The chairman reported that upon investigation with E . A. Latham, it was found that the bond of Mrs. Maybelle Lohman, Tax Collector, in the amount of 01,000.00 did not expire until January 1st 1927; and that it was agreed upon between Mr. Latham and himself to renew the bond at the end of the present calendar year. The matter of a like bond for the Treasurer was also handled with Mr. Latham, who had taken such steps as necessary to have bond provided to cover. Mr. Latham was instructed to present bills to the council for this service. Upon motion by A. B. Wilkinson, seconded by A. R. Patch, the report was accepted by the council. REPORTS OF SPECIAL COI `ITTEES: The committee consisting of S. R. Fee, appointed by the council to investigate the preparation of tax bills for 1926: The committee reported that it had made it' s investigation, and was pleased to advise that the bills in question were now in the hands of the tax collector. Upon motion by A. B. Wilkinson_, seconded by T. R. Warren, the report was accepted by tie council. The motion was put before the body by Mayor Zipperer, President Fee being incapaciated. UNFINISHED BUSINESS: P. H. Simpson, Marshall, reported that he had obtained a pair of handcuffs, twisters, and a club for his use in his official capacity, the same being his personal property. He requested the council to furnish him with a. suitable badge and gun. Mr . A. B. :Wilkinson moved that clerk be instructed to secure a badge for the marshall, of suitable type and design. Seconded by A. Patch, and unanimously carried. Mr. E. H. Lohman moved that marshall make investigation as to securing a gun, and report to the council what kind, where , and for how much a suitable Pain might be obtained , suggesting that he cbnfer with New Smyrna city and County officers. Seconded by T. R. Warren, and unanimously carried. Mr. T. R. Warren reported that Ray Ballentyne , former marshall, reported to him that he had no property of the tom in his possession. (Contracts) Er. A. R. Patch moved that contract entered into by the council and Austin Brothers Bridge Co. , jointly with the City of New Smyrna, covering the construction of a bridge over Gobardy Canal between New Smyrna and Edgewater, on the river front , to- gether with blue print of specifications be approved minutes.and spread upon tthe _: nutcs. Seconded by 1. a. Warren, and unanimously carried. The contract as specified is therefore attached to, and made a part of these minutes. 59 (silo) UNFINISHED BUSINESS: (Continued) (Clerk and Tax Collector' s Office) Mr. A. R. Patch moved that President 9 Fee bra authorized to hove sufficient, office space partioned off in VIA Hall, -making necessary provisions for doors, windows, locks, etc. , such as might be concurred in by directors of the Village Improvement Association, bill for costs to be presented to council. Seconded by A. 13. Wilkinson, and unanimously approved . Motion put before the body by Mayor Zipperer, President Fee being incaoaciated. ISCELLEANOUS: (Tax Collections) President Fee stated that arrangerrnn_ts had been made :iith Mrs. Lohman, Tax Collector, to observe the follauine office hours for the purpose of collection of taxes: Mondays, Wednesdays and Fridays, 1U a.m. to 3 p.i:i. , at VIA Hall, bekeinnin_g Monday, December 13th, and continuing thereafter as long as necessary. This arraneement was approved by the council upon motion by e. Lohman, seconded by A. R. Patch. (Advertisements) Upon motion by A. R. Patch, seconded by E. H. Lohman, the council instructed clerk to prepare and post in public places in Edgewater • notice of the above arrangement to the public. Clerk was further instructed to prepare adver- tisements of these office hours ,to be inserted once each uee > for two consecutive ,leeks in the New S :yrna Breeze , and the New Smyrna News. (He s to hull) Mr. ;.ill inson moved that clerk h ve two duplicate keys made for the VIA Hall, one key to be issued to clerk, and one to tax collector, rendering biel to council for costs. Seconded by A. R. Patch, and un_ar_i mouciy passed . ( town Attorney) Bids from several attorneys and legal firms were read before bhe body. Mr. A. 33. 'iilkin_son moved that a coi:eeiitt-cc be appointed to confer with Landis, ii:h, Hull and ;hitehair regarding their appointment. Seconded by e;. H. Lohman, and carried . President Fee thereupon appointed on this cocunittee Counc _amen N. II. Lohman and A. R. Patch. No action Jae taken on any bids, pending the report of this committee . (Supplies) Mr. A. N. ',ilkinson_ moved that clerk be authorized to have 50U each of mayor' s warrants and mayor' s affidavits printed at a cost of 416.00. Seconded by E. H. Lohman_, and unanimously ;gassed. Mr. A. R. WHEREAS, the contract for the construction of a certain creosote timber trestle bent bridge across the South Canal in the cAty of ;:ow Smyrna and the Town of Edgewater, County of Volusia, State of IA.orida, as shown on the plans in the office of the Engineer, and in all respects made a pert hereof and subject to all conditions, agreements, stipulations, terms and provisions contained in said plans, copies of which are hereto attached and in all reepects made a part hereof Las recently been awarded to th Contrfctor by the City Commissioners of New Smyrna and the Town Council of Edgewater at and for the our of _3,200.00 , AND VIIERLsrlAS, it was one of the conditions of the said award that a formal contract should be executed by and between the Contractor and the City of New Smyrna, through the agency of the City Commissioners, and the Town OF EDGEWATER, through the agency of the Town Council, NOW THEREFORE, This contract vAtnesseth, that for and in consideration of the payments and agreealents, terms and conditions herein mentioned to be !lade and preformed by the parties hereto, the Contractor doth hereby agree with the City of New Smyrna through the agency of the City. Commission and the Town of Ldgewater through the agency of the Town Council, that he, they or it will well and faithfully build and construct a creosote !Amber trestle bent bridge across The South Canal at Filisboro Street in the City of New 6myrna and the '2own of Edgewater in accordance with all terms, conditions and provisions of said plans end said award.
