EDGEWATE , HELD APRIL 3RD 1928.

Upon motion by Mr. Lohman, seconded by
Mr. Smith, the bills were ordered paid .
REPORTS :OF OFFICERS:
Clerk sub_iitted for Information f Council
a statement of tax collections. Due to closing of books
April 1st, usual fiscal reports had not yet been prepared .
Clerk reported that letter addressed to Mr.
J. P. Colby at 'earner, N. H. relative to cleaning property
off had been returned by post office marked "unknown" . It
was agreed to try to get in touch with Mrs. Jepson on this
matter.
Clerk reported that Mr. Jordan had been
advised of location of voting place for establishment of
voting precinct in Ederater.
REPORTS OF CO':' IT2 :k:S:
Mr. Smith reported that he had gone over the
drainage canal from Park Avenue to the Gabardy Canal, and found
canal in very good shape , there being some accumulation of
trees, boards, etc. , in the same that should be thrown out .
After discussion, up .n motion by mt. Spicer, seconded by Mr.
%e'Jitte, the marshall was instructed to secure two meen nd
have the canal cleaned as outlined. It was estimated the
one and one half days would suffice for this project .
The regular order of business was here
suspended to hear from Mr. J. C. Terris , City Manager of
New Smyrna. Mr. Ferris asked as to the opinion of the
effectiveness of the street lights, . hich had been turned on
for the first time tonight. Mayor Zipperer expre =seithe
sentiment of the council, stating that the installation
appeared satisfactory, so far as it had been inspected .
Mr. Ferris stated that if any change in locations, etc . , might
come up, that he would be very glad to cooperate in having
the system put in the exact cJndition desired by the Council.
Mr. Ferris also stated that after investigation
of the question of extending electric service on Park Avenue,
Ile had found only three parties who were willing to pay the
deposit to secure the service at the present time ; and that of

course this number of patrons would not justify the expense
of making the extension. The Council agreed that this
handling was satisfdctory, as it had been re)resented to
the Mayor and "ouncil that a sufficient number of patrons
had agreed to take the service, in order to justify the
e; tension,
Mr. W. J. Bigelow was present , and at
this time entered into a discussion of assessment values
in Highland Shores subdivision. It was explained to
him that this body has not the authority at this time to
consider any assessment values, but can do so only --hen it
meets as a board of equalization.
- ORDINANCES:
The following ordinance was introduced
by the Clerk:
ORDINANCE No . 21
AN ORDINANCE DECLARING THLe INTENT I OI\T OF TliE
TOWN COUNCIL OF THE TOWN OF EDGEWATER, VOLUSIA
COUNTY, FLORIDA, TO EXCLUDE FROM THE TERRITORIAL
LIMITS OF THE SAID TOWN OF EDGE WATER CERTAIN
LANDS AS Tr3IN DSCRIBED AND SET FORTH:
DESCRIBING THE LADS TO BE EXCLUDED IN METES
AND BOUNDS; DECLARING THE INTENTION OP THE
SAID TOWN COUNCIL TO CALL A SPECIAL ELECTION
FOR THE PURPOSE OF ALLOWING THE QUALIFIED
VOTERS OF THE SAID TOWN OF E.DGEWATER TO APPROVE
OR DISAPPROVE OF THIS ORDINANCE; AND DECLARING
THE INTENTION OP PTHE SAID TOWN COUNCIL TO
DECLARE BY ORDINANCE THE NEW BOUNDARIES OF
THE SAID TOWN OF EDGE. ATER.
BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OP EDGEWATER,
VOLUSIA COUNTY, FLORIDA, AS FOLLOWS:
Section 1. That the Town Council of the Town of
Edgewater, Volusia County, .Florida, hereby declares its
intention. to exclude from the corporate or #erritorial limits
of the said Town of Edgewater the lands comprehended and
included within the following metes and bounds , to wit ;
Commence at the southeast corner of lot nu:.;ber one,
in section three, township eighteen south of range thirty four
east , for a. point of beginning; thence south along the east
boundary of lot number seven, said section, township and range ,
to the southeast corner of said lot seven; thence westerly
along the south line of said lot seven to its intersection with
the east boundary of the Samuel -etts Grant in section thirty
eight , township eighteen south of range thirty four east ; thence
southerly along the east boundary of the Samuel Betts Grant ,
and along the east boundary of the John Bolton Grant , in
section thirty nine, township eighteen south of range thirty
four east, to its intersection with thensouth line of section
three, in saidto. nship and range ; thence easterly along the
south line of sections three, two andraone ; in township eighteen
south of range thirty four east, and along the south line of
sections six and five, in township eighteen south of range
thirty five east, to the low water mark on the Atlantic Ocean;
thence northerly along the low water mark on the Atlantic Ocean
to the south line of section twenty six, in township seventeen
south of range thirty four east; thence westerly along the

south line of section twenty six, said township and range,
to the middle df the main channel of the Hillsboro or
Indian River North; thence northerly along the middle of
the main channel of the Hillsboro or Indian -River North to
its intersection with a prolongation of the south line of
the Pedro de uala Grant; thence westerly to the middle of
the mouth of the Gabardy Canal, where the said Gabardy Canal
enters the Hillsboro or Indian River North; thence southefly
along the ,low water mark of the Hillsboro or Indian River
North to the southeast corner of lot five, in section two ,
township eighteen south of range thirty four east; thence
westerly along the south line of lots five and three, said
section, township and range, to the southwest corner of
saidlot three; thence northerly along the west boundary
of said lot three to the northwest corner of said lot three,
section two, township eighteen south of range thirty four
east; thence westerly along the south line of lots four,
three and two in section three, township eighteen south of
range thirty four east , to the point of beginning, which
point is the southeast corner of lot number one, in section
three, township eighteen south of range thirty four.` , _
Section 2. That a special election shall be
called by Resolution of the Town Counil of the Town of
Edgewater, Volusia county, Florida, at which special election
qualified voters of the said Town of Edgewater may a ,:prove
or disa prove of this Ordinance.
Section 3. That if two thirds of the qualified
voters actaally voting at the Special election as provided
in Section 2 hereof snall approve of this Ordinance, the
Town council of the said Town of Edgewater wi ..1 thereupon
proceed to declare the new territorial limits of the ,:aid
Town of Edgewater, excluding therefrom the lands described
by metes and bounds in Section 1 hereof.
Section 4. That section 7 of Ordinance No. 1
requiring readings of all ordinances for three consecutive
meetings of the Town Council, be and the same hereby is
waived.
ection 5. That 6,11 ordinances, or parts of
ordinances in conflict with this or inance, be and the same
hereby are repealed.
Section 6. That this ordinance shall become
effective upon its passage by the Town `'ouncil of the Town
of Edgewater, Volusia County , Florida, and upon the approval
of the mayor or upon its becoming effective without such
approval as provided by law.

No. 21 was as follows:

The following Resolution was then
intuoduced by Mr. Spicer:
RESOLUTION
A resolution calling a Special Election
for the purpose of elevating one of the qualified electors
of the Town of Edgewater, Florida, as Alderman to fill one
vacancy now existing in the Town Jouncil of the said Town;
and for the purpose of allowing the qualified voters of
the Town of Edgewater to approve or disapprove of the Passage
by the Town Council of said Town of Ordinance No. 21.
WHEREAS, the Town Council of the Town of
Edgewater, Florida, deems it advisable and necessary to
call a special election for the purpose of electing one
of the qualified electors of the Town of Edgewater as
Alderman to fill a vacancy in the T. wn Council; and
WHEREAS, the Town Council of the Town of
Edgewater, Florida, deems it necessary to call a special
election for the purpose of allowing the qualified voters
of the said Town to approve or disapprove of the pasaage
by the Town Council of Ordinance No. 21, now therefore,
BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, AS FOLLOWS:
Section 1. That a special election for
the purpeee of electing one of the qualified electors of
the Town of Edgewater as Alderman to fill a vacancy now
existing in the Town Council of said Townl and for the
purpose of allowing the qualified voters of the said Town
to approve or disapprove of the passage of Ordinance No .
21 by the Town Council, be and such election Ina is hereby
called to be held in the Town of Edgewater, Volusia County,
Florida, on the 15th day of May, A. D. 1928 .
Section 2. That such special election
shall be held under and in compliance with the laws of the
State of Florida, and the ordinances of the Town of
Edgewater relating thereto .
The roll call on this Resolution was as

.Passed and adopted by the unanimous vote
of all members present .
The following resolutionnwas then introduced
by Mr. Lohman:
RESOLUTION
WHEREAS, the Town Council of the Town of
Edgewater, Volusia County, Florida, deems it advkl able and
for the best interests of the said Town of Edgewater to open
the Town registration books on the 16th day of April, A. D.
1928, now therefore,,
BE IT RESOLVED BY THE TOWN COUNCIL OF THE
TOWN OF EDGEWATER, VOLUSIA COUNTY, FLORIDA, AS F OLLO:.SS:
That the Town Clerk be and he is hereby
authorized and instructed to open the registration books of
said Town on thg 16th day of April, A. D. 1928, and keep

said books open/each Monday, Wednesday and Friday of each
week, up to and including Friday, the 11th day of May,
A. D. 1928, from nine onlock to twelve o 'clock in the
forenoon of each of said days and from two o 'clock to five
o 'clock in the afternoon of each of said days .

Olerk requested (information as to the
handling of tax sale and advertisement for this year.
After discussion it was agreed to handle both in similiar
manner as in 1927 .
It was agreed that Ordinance No. 21, together
with proclamation of Mayor relating thereto , should be
published in a newspaper as well as posted. After some
discussion, it was agreed that Clerk should handle , and
have the same published . It was also agreed that the
newspaper making the best arrangement on the publication
of this ordinance would be entitldd to publish the same.
Meeting adjourned on m.Aion of Mr. Spicer,
seconded by Mr. Smith.
