HALL WEDNESDAY SDAY + + RU RY 7th, 1934. Meeting was called to order by Mayor-Councilman, P.R.: Retwick at &:O alo5 P.M. ROLL CALL, Mayor-Councilman F.R. Renwick, Present Councilman H.P. Wilkinson Present Councilman E.A. Ely Present Clerk E.H. Lohman Present Attprney G.O. Rasco Present READING OF TaNUTES Minutes of regular meeting of the Town Council held ' January 17th, 1934 were read and approved on motion made by Councilman H.P. ';ilkinson, seconded by Councilman E.A. Ely. COMIEMI CATIONS Clerk read letter from Smyrna Yacht Club Regatta asking for advertisment from the Town in their official programs at a price of :50.00 for half page advertisnient. Mayor Renwick advised the Council that he had a talk with tim ^'r. F.D. Bristley, Chairman of the Regatta and that Mayor Renwick informed ?Tr. Bristley that the Town had no appro- priation for advertising purposes. Clerk read letter from Bew Smyrna Chamber of Commerce with enclosure of mimeographed copy of the Rules • for Automobile Inspection. The Clerk was authorized to keep this letter on file for inspection of the public. Clerk read a petition presented by the Citizens Committe of Edgewater asking Attorney Rasco to return to the Town Clerk, all papers and documents in his possession belonging to the Town, and also asking. that the safe belonging to the Town be placed in possession of the To',,n Clerk. Attorney Rasco stated he had no papers belonging to the Town. Motion by Councilman E.A. Ely, seconded by Councilman H.P. Wilkinson that this petition be received and made part of the minutes. Ely for attendance council mee - ings $1:00; E.H. Lohman for Clerks Salary for one month 59.O0 E.H. Lohman 13:90 for miscellaneous expense , stamps and fuel; Mew Smyrna News Co. , 0:65 for rubber stamp. On motion made by Counci1mn H.P. Wilkinson, seconded by Councilman E.A. Ely, bills were ordered paid as read. REPORTS OF OFFICERS . Clerk read monthly budget report, which was received and ordered made a part of these minutes on motion made by Councilman H.P. Wilkinson, seconded by Councilman E.A. Ely; REPORT OF SPECIAL COru IITTES. - Councilman E.A. Ely reported he could not get labor at the price per hour paid by the Town, and that Councilman H.P. Wilkinson and Council E.A. El repaired three btd4ges = gPark Ave t , and one in r1 land Snores , and that same are now ooc condition. CLERK read two petitions presented by the Citizens Committe of Edgewater at the meeting held January 17th, 1934; one petition asking that the Council to have Attorney J.U. Gillespie wotk in conjunction with Town Attorney G.O. Basco in any proveedings which the Mill Dredging Corp. , may file against the Town. The other petition presented asked the Town Council to cancel the Four Thousand ($4,000.00) of time warrants issued by the Town. Councilman E.A. Ely stated that he thought the Council should accept both petitions and carry out the wishes of the people and made motion to that effect. There was no second to this motion. It was moved by Mayor F.R. Renwick and seconded by Councilman H.P. Wilkinson that the petition asking that Attorney J.U. Gillespie work with the Town Attorney, be received and made a part of these minutes, but no action was taken on same. It was moved by Councilman E.A. Ely that the petition asking for the cancellation of the Four Thousand ($4,000.00) of Time Warrants be received and that the said Time Warrants be cancelled. Mayor Renwick called for a second. As motion was not seconded, same was lost. Councilman H.P. Wilkinson made motion that said petition be received and made a part of the minutes. Mbtion seconded by Etaancilmln E.A. Ely. Motion carried. Motion by Councilman H.P. Wilkinson that Attorney G.O. Rasco be paid ;75.00 on account of hil bill for the sum of : 150.00 dated January 3, 1934; said .575.00 to be paid out of the Emergency Fund. Motion seconded by Mayor F.R. Renwick. This bill account defending injunction suit against the Town, re acceptance 1933 tax roll. Motion carried. Attorney G.Q. Rasco stated he received notice of suit for $10,000.00 filed by M.H. Long, Jacksonville Attorney for the Hill Dredging Corp., and that the council would have until March 5th, 1934 to reply to same. sTo action was taken by the Council on this matter. Mr. J.U. Gillespie, stated as a pepresentatibe of a group of 117 tax payers in Edgewater, he called on Mr. M.H. Long and proposed that a group of Edgewater citizens purchase bonds up to a certain amount of the claim of the Hill Dredging Corp, and carry on negotiations for the balance. There being no further business it was moved by Councilman H.P. Wilkinson and seconded by Councilman E.A. Ely that Council adjourn. Motion. carried. Mayor-Councilman Councilman A e - Councilman T Town Clerk EDGEWATER, FLORIDA, JANUARY 6th, 1934. TO THE MEMBERS OF THE TOWN COUNCIL OF THE TOWN OF EDGEWATER, FLORIDA. GENTLEMEN:- We, the Citizens Committee of the Town of Edgewater, by our President and Secretary, hereby respectfully petition your Honorable Body to authorize J. U. Gillespie, Attorney at Law and a resident of our city, to appear as Counsel for the Town of Edge- water along with Glynn Owen Raso, Town Solicitor, in any proceeding instituted or which may be instituted by Hill Dredging Corporation against said Town, without any obligation whatsoever on the part of the Town of Edgewater to pay Mr. Gillespie; (his fee or fees to be paid entirely by said Committee) , and to authorize Mr. Gillespie to act with Mr, Basco to the best interests of the Town and its taxpayers in said litiga- tion and in any settlement negotiations which may be taken up between said Hill Dredging Corporation and its agents and attorneys. CITIZENS COMMITTEE OF EDGEWATER, By President. (7.1/� Secretary. EDGEWATER, FLORIDA, JANUARY 6th, 1934. TO THE MEMBERS OF THE TOWN COUNCIL OF THE TOWN OF EDGEWATER, FLORIDA. GENTLEMEN:+F We, the Citizens Committee of the Town of Edgewater, Florida, by our President and Secretary, respectfully petition your Honorable Body to order cancelled all of those certain Time Warrants which were delivered to Hill Dredging Corporation of Ventnor, New Jersey, in the total sum of four thousand ($4,000. 00) dollars, and which were later returned by said Corporation, and which are now held by the Town Clerk pursuant to Resolution adopted by you on January 3rd, 1934, for the following reasons: (1) Said Time Warranats were issued for a specific purpose under Resolution adopted November 13th, 1933, namely, in part payment of a purported obligation of the said Town to said Corporation and under the terms of a proposed settlement with said Corporation, which settle- ment has been refused by said Corp oration and /rhich Resolution was rescinded by you under esolution adopted by you on January 3rd, 1934. (2) Said Time Warrants purport to consti- tute an obligation of the Town of dgewater in the total sum of four thousand ($4?000.00) dollars and purport to bear interest from their respective dates at the rate of five and one- half percent (5 ) per annum. If sold by the Town at a future date, the Town would therefore be obligated to pay interest from a date prior to their actual delivery and prior to the time when the Town would actually have the use of any money received by it therefrom. We further respectfully petition your Honorable Body to demand and require of the gill Dredging Corporation that it return to said Town the sum of four hundred seventy ($4 70.00) dollars which was paid to said Corporation as an advance payment on account of the deposit of spoilage along the Indian River North and within the corporate limits of said Town. This, for the reason that the said Hill Dredging Corporation has refused to accept the purported settlement made barteen its agent and the Town Cotncil, and for the further reason that the entire contract with the Hill Dredging Corporation is and was null and void, and ultra vireo, in that it directed the improvement of strictly personal property at the general expense of the taxpayers of the Town of 14dgewater. WHEREAS, is has come to the attention of the Committe that valuable papers and documents of the Town of Edgewater have for a n unnecessarily long period of time been allowed by you to remain in the hands of G.C. Rasco,, Esq., instead of their proper custodian, E.H. Lohman, Town Clerk and his predicessor in office, R.C. Fuller; AND WHEREAS, it has been disclosed by Mayor F.R. Renwick that he has received an offer for the sale of the safe owned by the Town, which safe is not in the possession of the Town Clerk and is not accessable to the Town Clerk, and the Town Clerk has no proper place to keep safely important records and papers belonging to the Town; AND WHEREAS, the safe is being used by other parties that the Town Officials; NOW THEREFORE, the Citizens Committe, by its undersigned officers, respectfully petitions; TEAT you direct the Town safe to be placed in the Council Chambers and there to be kept under the control of the Town Clerk; THAT you direct all valuable papers, records and documents of the Town to be kept in said safe and that said safe be not sold or otherwise disposed of; THAT you direct all papers, records and documents now in the hands of the Town Attorney to be delivered into the custody of the Town Clerk to be kept by him in their proper place.
