02-21-1934 - Regular MINUTES OF OF REGULAR MEETING OF THE TOWN COUNCIL OF THE TOWN OF EDGET ATER, VOLUSI' COUNTY, FLORIDA, HELD IN THE V.I .A. HALL ' EDHESDAY FEBRUARY 21st, 1934. Meeting was called to order by Mayor-Councilman F.R. Renwick at 7:55 P.M. ROLL CALL, Mayor-Councilman F.R. Renwick, Present Councilman H.P. Wilkinson Present Councilman E.A. Ely Present Clerk E.H. Lohman Present Attorney G.O. Rasco Present READING OF MINUTES Minutes of the regular meeting of the Town Council held February 7th, 1934 were read and approved on motion made by Councilman H.P. Wilkinson, seconded by councilman L.A. Ely. COMMUNICATIONS Clerk read letter from First Atlantic National Bank of Daytona Beach, requesting that the Town release the $5,000.00 Swift & Co. , bonds pledged to secure the deposits of the Town. Clerk was instructed to write said bank, asking what other bonds the bank could give as security against the Town's deposit; stating their present market value. Clerk read letter addressed to the TAn Attorney, Ts. G.O. Rasco , from the New Smyrna Abstract Co . , advising they would compile necessary data for estimating the amount due the Town of Edgewater by the County of Volusia for "Road Maintenance" within the corporate limits of Edgewater. Mayor F.R. Renwick suggested to defer action on the matter for the time being. Clerk read letter from the Citizens Committe of Edgewater, requesting that the suit brought by the Hill Dredging Co. , be fought, and asking that the Town Attorney indicate to the tax payers what steps he will take to defend this suit. Motion made by councilman H.P. ilkinsom, seconded by Councilman E.A. Ely that getter be received and made a part of the minutes. Motion carried. Attorney G.O . Rasco stated that he had just received notice of suit and that he had not as yet had time to study the bill of com- plaint, and therefore could not indicate what steps would be taken to defend suit. BILLS AND ACCOUNTS Clerk read following bills; New Smyrna Hard- ware Co. , $a.00 for, files hooks , handles etc. , for street repairs; H.P. Wilkinson, yp:75 for repairing bridges on Park Ave. , west of the FEC RR; E.A. Ely, $:75 for repairing bridges on Park Ave. , west of the FEC RR. On motion made by Councilman E.A. Ely, seconded by Councilman H.P. Wilkin- son, said bills were ordered paid. Motion carried. Renwick stated he had received a com- plaint from property owner on Sanchez Ave. , about pile of rubbish on said Ave,' Mayor Renwick stated that he would try to have same removed without cost to the Town. There being no further business it was moved by Councilman H.P. Wilkinson, seconded by Councilman E.A. Ely1 that Council adjourn. Motion carried. Meeting adjourned at 6:3O P.M. To the lembers of the Town Colincil, and to Glynn Owen Rasa()) Esq. , Solicitor, of the Town of Edgewater. Gentlemen:- The Citizen's Committee has recently been furnished with a copy of the Eeclaration filed by the Hill Dredging Corporation in its suit against the Town. This Declaration discloses that the suit is based on a purported contract between the Town and the Company for a contract price of $4 700.00, and a certain letter directed to Mr. Klopp, then at the Ocean House in New Smyrna, Fla. , under date of June , 1933, signed by Mr. F. R. Renwick, and dictated by the Town Solicitor, providing for a payment of $800.00 additional for certain extra spoilage. On behalf of the tax payers, this Committee feels that at this time the Council should formally go on record as being willing to fight this suit, and that the Solicitor should indicate to the tax payers what steps have been taken by him thus far to defend the suit, and what plans will be undertaken in the future for that purpose , and we therefore request that this information be given to the tax payers of our community. We make this request because the minutes of the Council and the documents above referred to show that the purported contract was entered into by the Town Council when it was composed of Messrs. Renwick, Wilkinson and Francis , and Mr. Renwick and Mr. Wilkinson at this time constitute a majority of the present Town Council, and Mr. Rasco then Town Solicitor is still in office . Because of this situation, we feel that the present officials of our town cannot defend the suit without considerable embarrassment to them selves, they having been instrumental in effecting the said agreement. Inasmuch as the tax payers have a vital interest in the outcome of the suit, and are in fact the real persons affected by it, we deem it only fair and proper that this information be furnished, and that the action be vigorously defended.
