A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, ESTABLISHING A SCHEDULE
OF SURCHARGES, FEES AND CIVIL PENALTIES
RELATING TO CHAPTER 5 (ANIMAL CONTROL))
REPEALING RESOLUTIONS IN CONFLICT HEREWITH AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Edgewater, Florida,
has made the following determinations:
1. On July 7, 1997, the City Council adopted Ordinance No.
97-0-08 repealing Chapter 5 Animals and Fowl and adopting Chapter
5 Animal Control.
2. Chapter 5 provides for the establishment of surcharges,
fees and civil penalties by resolution of the City Council.
3. With the August 1, 1997 effective date of Ordinance No.
97-0-08, it is necessary for the Council to adopt the applicable
schedule of surcharges, fees and civil penalties.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida:
Section 1. Establishing a Surcharge on Civil Penalties
Pursuant to Section 828.27(4)(b), Florida Statutes, and
Section 5-70(h) of Chapter 5 Animal Control, a surcharge of five
and 00/100 dollars
($5.00) is hereby imposed upon each
civil
penalty imposed for a
violation
of Chapter 5 Animal Control
of the
Code of Ordinances, City of Edgewater, Florida.
Section 2. Establishing Schedule of Fees and Civil
Penalties.
Pursuant to Chapter 5 Animal Control, the schedule of fees and
civil penalties set forth in Exhibit A, attached hereto and
incorporated by reference, is hereby established.
Section 3. All resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section 4. This resolution shall take effect August 1,
1997.

Mitchum, the vote on this resolution was as follows:

in court:
