A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF EDGEWATER, FLORIDA, SUPPORTING AND
ENDORSING ACTION BY OUR STATE LEGISLATURE TO
ADDRESS THE STATE MANDATED SENTENCING
GUIDELINES FOR CRIMINALS BY CHANGING THE
GUIDELINES FOR VIOLENT CRIMINALS SO THAT THEY
ARE MORE STRINGENT - REQUIRING 100% OF TIME
SENTENCED TO BE SERVED AND OPPOSING EARLY
RELEASE FROM PRISON OF VIOLENT OFFENDERS;
REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, after over 30 years of attempting to develop a method
to rehabilitate violent criminal offenders in our penal system; and
WHEREAS, after over 30 years of FAILURE to find ANY METHOD to
prevent or even significantly reduce recidivism in violent criminal
offenders, especially those who are violent sexual predators; and
WHEREAS, Florida has one of the highest per capita crime rates
in the nation, as well as being the nation's leader in the early
release of violent convicted offenders; and
WHEREAS, to relieve overcrowding in the prison system,
prisoners in Florida receive "gain time" which is deducted from
their original sentence; and
WHEREAS, after their release, more than seventy percent (70%)
of these dangerous predators violently rob, rape, torture and
murder more law-abiding citizens of the State of Florida who need
to be protected from these violent criminals, and who indeed should
be protected from these violent criminals by new, stringent
legislation enacted by state legislators; and
WHEREAS, ENOUGH IS ENOUGH! The City Council, representing the
citizens of the City of Edgewater, Florida, is aggressively seeking
the development of legislation to address and correct problems in
the state mandated sentencing guidelines along with legislation
that prevents the early release of any violent criminal offender.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Edgewater, Florida:
Section 1. The actions taken by our state legislators to

examine the state mandated guidelines for sentencing criminals with
the goal of making the punishment of criminals, and most especially
violent offenders, much more stringent is supported and endorsed.
Section 2. The state legislators are encouraged to realize
that the ONLY EFFECTIVE DETERRENT for repeat offenders is to keep
them locked up, increase the sentences for these repeat offenders
and then see that they serve one hundred percent (100%) of their
sentence.
Section 3. All resolutions or parts of resolutions in
conflict herewith be and the same are hereby repealed.
Section d. This resolution shall take effect upon
adoption.
After motion by Councilman Hays and Second by Councilman
Mitchum, the vote on this resolution was as follows:
