Meeting was called to order at 7:40 P.H . by :.ayor Councilman C.D.Bartlett. ROLL GALL. - Mayor Councilman C .D.Bartlett Present. Councilman H.L.Haughton Present . Councilman Ralph Adams Present. Attorney J.U.Gillespie Present. Clerk ' alter C.Fuller Present The purpose of the meeting was read by the Clerk. The Clerk requested permission of the Board to change the Valuation on the Preliminary Assessment Roll placed on the South 1/2 of Lot 4 Shepard and Sanchez Grant from 08660. to 06260. , for the reason that the depreciation on the buildings was figured. too low and that. a revision of the rate of depreciation to " 5 % on a diminishing value " brought the completed figure to 06260.. The Board by unanimous consent granted the Clerk per- mision to make this change and itnwas so ordered. There appeared before the Board Mr. Charles Winston Smith and Mr. Milton L. Fuller representing Maybelle Lohman, and.: ttley presented a. petition entitled " Ojections of Maybiblle Lohman, owner, to valuation of the South half of Lot 4, sec. 50 , Sheppard and Sanchez Grant, in the Town of Edgewater, Volusia County, "Florida, by the Town of Edgewater, for the ensuing Town fiscal year. " Mr. Smith after presenting the petition compared values of various properties with that of his client, and was followed by Mr. M.L.Fuller who addressed the Board. The Board received the petition and reserved deceision until Sept. 7th. Er. Smith also, presented a petition entitled " Objections of Maybelle Lohman, owner-, to the valuation of Lot17 G.Alvarez Grant; Lot 14 Alvarez Grant and Lots 9 10 and 11 Section 3 Block A of Highland Shores , all in the Town of Edgewater, Volusia county, Florida, by the Town of Edgewater for the ensuing Town fiscal year. "' Upon references to the Tax Roll showing valuations of adjoining properties , it was stated. by Mr. Smith that these objections were not insisted upon. CO 'W ICATIONE . Gentlemen:- Comes now Maybelle Lohman, by her attorney C. Winston Smith, and to the Town valuation placed on the South half of Lot 4, Section 50, Sheppard $nd Sanchez. Grant, for taxation, for the ensuing Town fiscal year, by your Town Clerk,amounting to Eight Thousand Six Hundred and Sixty ($8,660.00) dollars, as the owner of said property i your petitioner hereby objects and respectfully petitions your Honorable Board of Equalization to correct the same I by reducing the value placed on the said property, so that the total amount thereof, including valuation for improve- Iments thereon, will not exceed Five Thousand ($5,000.00) 1Dollars, for the following reasons, to-wit : 1. Because the valuation placed on the South half of Lot 4, Section 50, Sheppard and Sanchez Grant by your Towh Clerk, for taxation for the ensuing Town fiscal tax year, is confiscatory. 2. ecause the valuation placed on the South half of Lot 4, Section 50, Sheppard and Sanchez Grant by your Town Clerk, for taxation for the ensuing Town fiscal tax year is grossly in excess of the lues placed by him on other lands of the same grade , quality I and value , belonging to other taxpayers within the Town of Edgewater, for the same period. 3 Because the valuation placed on the South half of Lot 4, Section 50, Sheppard.and Sanchez Grant by your Town Clerk, for taxation for the ensuing Town fiscal tax year, deprives your� p y petitioner of her constitutional rights, secured to her under the Constitutiotl of the United States of America and of the State of Florida. 4. Because your Town Clerk in placing said valuation on the South half of Lot 4, Section 50, Sheppard and Sanchez Grant, the property of your petitioner, for taxation, as above set forth, did not act upon the principles established for State taxation, Constitution of the or in pursuance of law, as required by the/State of Florida. 5. ' Because the valuation as placed on the South half of Lot 4, Section 50, Sheppard and Sanchez. Grant , by your Town Clerk for ( taxation for the ensuing Town fiscal tax year, is not in fact reasonable nor just. 6. 1Because the valuation placed on the South half of Lot 4, Section 50, Sheppard and Sanchez Grant, by your Town Clerk for taxation for the ensuing Town fiscal tax year, is entirely arbitrary, un- ust and excessive, said value being arrived at or determined in n arbitrary and illegal manner. 7. Because the valuation placed on the South half of Lot 4, Section I r + ��� Per a` 50, Sheppard and Sanchez Grant by your Town Clerk for taxation for the ensuing Town fiscal tax year, to-wit, Eight Thousand I Six Hundred Sixty ($8,660.00) Dollars, was fixed arbitrarily and not upon any evidence which might or could enable him to form a fair and just estimate of its just and true value for assessment. 8. Because the valuation placed on the South half of Lot 4, Section 50, Sheppard and Sanchez Grant by your Town Clerk for taxation for the ensuing Town fiscal tax year, is twice the actual cash, I fair or just value of said lands, which are not worth over !
