09-20-1938 - Regular REGULAR MEETING OF THE TOWN COUNCIL OF THE TOWN OF EDGEWATER, FLORIDA, HELD IN V. I. A. HAIL ON SEPTEMBER 20, 1938. Meeting was called to order at 7 :30 P. Swann Present READING OF MINUTES The minutes of the Board of Equalization held September 5th, and the minutes of the regular meeting held September 6th were read and upon motion made by Councilman Adams, seconded by Councilman Haughton, were approved as read . DEPORTS OF OFFICER Since the Town Attorney has sent out lettersto Delinquent Tax Property Owners, the Clerk had collect4d the sum of $88 .37 . ORDINANCES Ordinance No. 76 entitled "AN ORDINANCE APPROPRIATING REVENUES TO BE COLLECTED BY THE TOWN OF EDGEWATER') VOLUSIA COUNTY, FLORIDA, FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 1938, and ENDING SEPTEMBER 30, 1939 , TO THE VARIOUS ITEMS OF THE TOWN BUDGET. ", was read a first time in full and it was moved by Councilman Adams, seconded by Councilman Haughton, that said Ordinanc be passed upon first reading. Upon vote mption was unanimously CARRIED. Whereupon it was moved by Councilman Adams, seconded by Councilman Haughton, thatthe requirement of reading Ordinance o. 71# on second reading be waived and that said Ordinance be out upon its final passage . Upon vote this motion was carried unanimously. • T • Whereupon it was moved by Councilman Adams, seconded by Councilman Haughton, that Ordinance No.76 be passed and adopted and roll call being taken on said motion resulted as follows : Mayor Councilman H. L. Haughton Yes Councilman Ralph Adams Yes Councilman C . D. Bartlett Absent Said motion was declared carried unanimously and said Ordinance was declared adopted . Ordinance No. 77 entitled "AN ORDINANCE PROVIDING FOR THE RATE OF TAXATION FOR ALL PROPERTY IN THE TOWN OF EDGEWATER, FLORIDA, FOR THE YEAR A. D. 1938; PROVIDING WHEN SUCH TAXES SHALL BECOME DUE AND BECOME DELINQUENT AND BE SOLD FOR NON-PAYMENT : AND PROVIDING FOR DISCOUNTS IF PAID BEFORE MARCH ,lst , 1939", was read a first time in full and it was moved by Councilman Adams , seconded by Councilman Haughton, that said Ordinance be passed upon first reading. Upon Vote motion was unanimously CARRIED. Whereupon it was moved by Councilman Adams, seconded by Councilman Haughton, that the requirement of reading Ordinance No. 77 on second reading be waived and that said Ordinance be put upon its final passage . Upon vote this motion was carried unanimously . Whereupon it was moved by Councilman Adams, seconded by Councilman Haughton, that Ordinance No.77 be passed and adopted and roll call being taken on said motion resulted as follows : Mayor Councilman H. L. Haughton Yes Councilman Ralph Adams Yes Councilman C . D. Bartlett Absent Said motion was declared carried unanimously and said Ordinance was declared adopted . NEW BUSINESS A Resolution entitled "Resolution Adopting Tax Assessment R )ll for the Year of 1938" was read in full by the Clerk, whereupon motion made by Councilman Adams seconded by Councilman Haughton, that the resolution be adopted , wqs unanimously carried , the vote of the Council upon roll call being as follows : Mayor Councilman H. L . Haughton Yes Councilman Ralph Adams Yes Councilman C . D. Bartlett Absent A copy of the Resolution is attached and forms a part of these minutes . A Resolution entitled "Resolution Establishing Special Delinquent Tax Fund" was read in full by the Clerk, whereupon motion made by Councilman Adams seconded by Councilman Haughton, that the resolution be adopted , was unanimous) carried , the vote of the Council upon roll call being as follows : Mayor Councilman H. L. Haughton Yes Councilman Ralph Adams Yes Councilman C. D. Bartlett Absent A copy of the Resolution is attached and forms a part of these minutes . Councilman Adams moved that the Attorney be paid for his services in collecting the Delinquent Tax Roll, the sum of 10% of the amount collected , to be paid as and when the Taxes are collected and to cover his fees in such foreclosure suit or suits as the Council may deem proper to file . This motion was seconded by Councilman Haughton and upon vote declared unanimously carried . Councilman Adams moved that permission be granted to the ladies of 3 gewater to hold a fish fry for profit on the grounds adjacent°. to the V. I. A. Hall , fo the purpose of raising funds to build a barbecue pit which will be a benifit to the Community. This motion was seconded by Councilman Haughton and upon vote declared unanimously carried . Councilman Adams moved that the property transfer service of the New Smyrna Abstract Company be taken for the year Octoberl , 1938 to September 30, 1939 . The sum of p25.00 to be paid for this service and that the Clerk make the necessary arrangements with'. the New Smyrna Abstract Co. This motion was seconded by Councilman Haughton and upon vote declared unanimously carried . The Mayor reported that in the Municipal Court case of Wm. B. Norment, that the bond had been estreated and that the watch deposited as a bond was declared forfeited , said watch being placed with the Town Clerk as Town Property. Councilman Adams moved that the Certificate of Deposit #3 covering Permanent Improvement Funds of $540.43, at the Bank of New Smyrna be renews with the interest added to the principal . This new certificate to be paya ble September 30, 1939 . This motion was seconded by Councilman Haughton and upon vote declared carr4ed . Councilman Adams moved that the Clerk communicate with Pendleton and Adams , Certified Public Accountants of Daytona Beach and engage them to audit the Towns Books at a cost of $60 .00 or not more than $75.00. Councilman Naughton seconded this motion and upon vote declared carried . Councilman Adams moved that we do now adjourn, seconded by Councilman Haughton and by vote declared carried . Time 8 :50 P.
