RESOLUTION NO. 96-R-29 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EDGEWATER, FLORIDA, URGING THE CITIZENS OF THE CITY OF EDGEWATER TO SUPPORT, THROUGH THEIR AFFIRMATIVE VOTE ON THE GENERAL ELECTION BALLOT OF 1996, AN AMENDMENT TO THE FLORIDA CONSTITUTION ALLOWING THE GOVERNOR TO APPOINT MEMBERS OF THE CONSTITUTION REVISION COMMISSION (CRC) 30 DAYS FOLLOWING THE 1997 REGULAR LEGISLATIVE SESSION, AND RESTORING THE CRC'S AUTHORITY TO REVIEW MATTERS RELATING TO TAXATION OR THE STATE BUDGETARY PROCESS; REPEALING ALL RESOLUTIONS IN CONFLICT HEREWITH AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, Article XI, section 2 of the Florida Constitution (1968) regarding the convening of the Constitution Revision Commission (CRC) included an inconsistency in the timing of the appointments of the CRC; and WHEREAS, in 1977, Governor Askew, after recognizing this problem, requested and received an advisory opinion from the Florida Supreme Court clarifying the authority of the Governor to appoint CRC members sooner than required by the Constitution; and WHEREAS, the Florida Legislature concurred with this opinion and passed a joint resolution codifying the Court's interpretation, as well as including a provision to restore the authority of the CRC to review matters relating to taxation or the state budgetary process which was exempted in 1988; and WHEREAS, the City of Edgewater strongly supports this proposed amendment and believes that it is vital to all Florida governments and citizens that it be approved. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Edgewater, Florida: Section 1. The City Council supports this constitutional amendment and advises all citizens of its importance and urges their support of this amendment through their affirmative vote in the November 5, 1996, general election. 96-R-29 1 Section 2. A copy of this resolution will be provided to members of the Florida media and other interested parties. Section 3. All resolutions or parts of resolution in conflict herewith be and the same are hereby repealed. Section 4. This resolution shall take effect upon adoption.
