The minutes of the meeting of January 7th were read whereupon Councilman Goodyear moved that they be approved as read, seconded by Councilman Renwick and by vote declared CARRIED. City of New Smyrna Beach, Prison Board , $ 8.80 Henry Dixon, Labor $ 3.20 Fire Calls , J.S.Ba. es and J.R.'aood $ 2.00 Frank Lee , Abstractors Fee Settlement, $50.00 J.U.Gillespie , Attorney' s Fee , Feb. 1, to May 1, 1941. $37. 50 Councilman Goodyear moved that the bills be approved, paid as read and be made a part of the minutes , seconded by Councilman Renwick and by vote declared Carried. REPORTS OF OFFICERS . The Clerk reported that the lease given Mrs. Frances ' bod on Lot 35 AA Ass' rs Sub. of G. Alvarez Grant had expired on December 20 , 1940. Whereupon ::fir. Horace King advised that Mrs. food wished to renew the lease on a monthly payment basis. Councilman Goodyear _coved that the Mayor and Clerk be autiorized to renew the lease for one year from December 20 , 1940 at a .rental of $45.00 per year payable one twelfth monthly in advance, seconded by Councilman Renwick - and by vote declared C.ARRI= D. They. `arshall. reported that the ditch on the Lutz property had been cleaned. Mr. Miller residing on the Arnett property advised Council that the properly was still suffering from back water and that more work would be necessary t relieve the present condition. After a discussion Councilman Goodyear moved that a man be employed for not more than two days to further Cagan the ditch known as the Foster Ditch, seconded by Councilman Renwick and by vote declaim ed CARRIED. The Clerk was requested to write D .G.McBride State Highway Mainyenance Supep. visor requesting his co-operation in keeping the culvert under the highway cleaned out and in widening the ditch to take care of the water. The Marshall reported a list of Fire Extinguishers available in case of fire with the understanding that when used they would be refilled without expense to the owners. The Clerk was ordered to post a list on the Buletin Boards and give a list to each of the Fire Call Men. The ittormey .Gas requested to prepare a Bill for the handling of the Town' s Delinquent Taxes and a Resolution creating a Special Foreclosure Property Fund. 4 ftimisoe Minute of January 21, 1941. Page 2 REPORTS OP OFFICERS . Continued. The marshall was requested to report on the cost of cleaning -=ilkinson Street at the East end. The Attorney was excusedat this time. COM hrI CATI ONS. The Mayor read a communication from C .O .Oliver, District 3uperintendent of the state Recreation Dept. in reference to paying the Expenses of a delegate to a Convention to be held at Orlando. Councilman Goodyear moved that the Town allow Yr. George Gunthrop an amount of $3.50 for hotel expense at Orlando , seconded by Councilman Renwick and by rote declared CARRIED. The Clerk read a letter dated Jan. 15th from D .G.McB ride in response to our letter requesting repair of various street intersections with the State High- way. UNFIIIISHED BUSINESS . Mr. Brown reported having made repairs to several bridges. Mr. King reported having seen ,Ir. Longstead and he was not interested in re- moving trees on Wilkinson Street for the wood. Mayor Renwick reported having been unable to contact all the Property Owners on the Highway where trees close to the paved road were to be removed. The Question of the time to hold a Public hearing on the Zoning Commission' s Report was brought up and continued to the next meeting of Council. NEW BUSINESS . After a discussion upon data given by T .C .Brown who had operated the Power ;Tower Scythe it was ordered by Council that a charge of x1.00 per hour be made for the use of the scythe in cutting of weeds on lots. An offer was received for the fruit on the trees ,on Town owned lots , of 25 cents per field box. Councilman Goodyear moved that the Clerk be authorized to purchase a list of properties in Edgewater which had reverted to the :state under the Murphy Act, at a cost of $5.00 , seconded by Councilman Renwick and by vote declared CARRIED . Councilman Goodyear moved that the Clerk be authorized to pay the State and County Taxes on Lots 8, 9 and 22, Block D, section 1, Highland shores sub. , seconded by Councilman Renwick and by vote declared CARRIED. Councilman Goodyear moved that the Mayor and Clerk be and they are hereby auth orized to sign "Contracts to Purchase" Town owned properties for 'Sale at the listed prices which have been approved by Council, provided that in such con- tracts to purchase the down payment shall not be less than 16% of the total purchase price and the monthly payments shall not exceed 12 in number, with of 1% per month interest computed monthly on the unpaid monthly balance , such contracts to be reported at the next meeting of Council, seconded by Councilman Renwick and by vote declared unanimously CARZIED. It v=as moved by Councilman Goodyear, seconded by Councilman Renwick, that Er. Frank Lee be paid „>50,00 14 lieu of any furt'ier payments of '.;2.00 for each parcel of property sold and in full settlement of the agreement of January 3rd 1939; by vote the motion was declared C_4RRIED. Councilman Goodyear moved that the Clerk be designated the Custodian of the Flag and that it be displayed on the following Holidays; New Years January 1st. January 19th, Lees Birthday..
