The minutes of the regular meeting of September 2nd and the special meet- ing of September 8th were read whereupon Councilman Goodyear moved that the minutes of both meetings be approved as read, sceonded by Council- man Southard and by vote declared CAHRI D. BILLS AND ACCOUNTS . Cash. 6.05 The H. and W.B.Drew Co. 6.2 nursery School. 4.00 J.S .Bates. 5.35 .H.Sharpe, cutting weeds . 4.25 E.J.Miller, cutting Weeds. .50 councilman Southard moved that the bills be approved, paid and be made a part of the minutes, seconded by councilman Goodyear and by vote declared CARRIED. REPORTS OP OFFICERS. Mayor Renwick reported that he had received a complaint about a fruit stand being built very close to the street right of way. A discussion followed as to sidewalk areas and the importance of contriling the building of structures within such areas. The Mayor reported that the Streets should be scraped and graded. it Bevel- • oped that there was no one to rill the Grader at this time whereupon the Marshall was instructed to find some one to ride the grader and start with the work as soon as possible. The Marshall reported upon the condition of the .Brady Property at the corner of Ocean Ave. and Riverside Dr. as to outside and foundati0asbut that a later report would be more complete. he was requested to inspect the Sanitarium Building, also to give the clerk a record of the amount of shell hauled recently and placed on the streets. The Marshall. requested permiss ion to move an orange tree on Bigelow Drive outside the line of sidewalk but Council decided it best to leave the tree there. the Marshall reported being unable to find a grease gun of heavy construction for the Power Mower but that a used one could be bought for 50 cents. Councilman Goodyear moved that the Marshall purchase a used grease gun for 50 cents from E .J.Miller, seconded by councilman Southard and by vote de- clared CARRIED. COMNICATIONS . The Clerk read a letter from Pentland and Robertson dated September 15th, 1101. Minutes of September 16th, 1941. ORDINANCES . Ordinance No. 99 entitled' AN ORDINANCE ESTABLISHING THE CO ?ENSATION TO BE PAID THE TOWN CLERK AND TOWN MARSHALL OF THE TOWN OF EDGEWATER, FLORIDA, AND ESTABLISHING THE COSTS TO BE PAID IN THE MAYOR'S COURT AND THE DISi POSITION THEREOF AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH." was read in full. Councilman Goodyear moved that Ordinance No. 99 be passed upon first read- ing , sceonded by Councilman Southard and by vote declared CARRIED. Councilman Goodyear moved that the requirement of reading Ordinance fo.99 on second reading be waived and that said Ordinance be placed upon final passage, seconded by councilman Southard and by vote declared unanimously Carried. Whereupon it was moved by Councilman Goodyear, seconded by Councilman Southard, that Ordinance No. 99 be passed and adopted and a roll call being taken upon this motion resulted as follows; Mayor Councilman. Ordinance No. 100 entitled * AN ORDINANCE ESTABLISHING SIDEWALK LINES AND SIDEWALK AREAS ALONG RIDGEWOOD AVENUE IN TEE TOWN OF EDGEWATER, FLORIDA, PROHIBITING THE ERECTION AND MAINTAINANCE OF CERTAIN STRUCTURES WITHIN SAID SIDEWALK AREAS, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF." was read in full. Councilman. Southard moved that Ordinance .io. 100. be passed upon first read- ing, seconded by Councilman Goodyear and by vote declared CARRIED. Councilman Southard moved that therequirement of reading Ordinance No. 100 on second reading be waived and that said Ordinance be placed upon final passage , seconded by Councilman Goodyear and by vote declared unanimously CARRIED. hereupon it was moved by Councilman Southard, seconded by Councilman Good- year, that Ordinance No. 100 be passed and adopted and a roll call being taken resulted as follows; Mayor Councilman. &.R.Renwick. yes. Councilman. vr .T.Goodyear. Yes. Councilman. O .E.Southard. Yes. A Resolution entitled " A RESOLUTION AUTHORIZING TEE TRANSFER OF CERTAIN FUNDS TO THE STREET FUND." was read in full. Councilman. Goodyear moved the adoption of the resolution, seconded by Councilman Southard and adopted tha roll call vote being as follows; Mayor Councilman. F.R.Renwick. Yes. Councilman. W.T .Uoodyear. Yes. Councilman. 0 .E.Southard. Yes. A copy of the Resolution is attached and forms a part of these minutes. UNFINISHED BUSINESS . Councilman Southard moved that the Mayor and the Clerk be authorized to purchase a storage steel cabinet(used) from the Purdue Office Furniture Co. at a cost of X25.00 including freight, seconded by Councilman Goodyear and by vote declared CARRIED. HEW BUSINESS . COUNCILMAN Southard reported on the purcbbse of some games'for the Recreatio Center and it was decided to hold this matter over until the next meeting. An application for a permit to keep hogs on the rear of Lot 23 Sheppard and Sanchez grant was held over until the next meeting. Councilman Goodyear moved that the Mayor and Clerk be and they are hereby authorized to surrender to the Bank of New Smyrna Certificate if Deposit No. 12 of date October 1, 1940 and. maturing September 30th, 1941 of a face value of 0.000.00 and procure therefore a Certificate of Deposit for 4p1020.00 dated October 1st, 1941 and maturing September 30th, 1942, seconded by Councilman Southard and by vote declared CARRIED. • Minutes of September 16, 1941. Councilman Goodyear moved that the balance in the Special Foreclosed Propel. ty Fund at the and of the Fiscal year be allocated to and continued in this fundfund for the fiscal year October 1st, 1941 to September 30th, 1942, for the purposes stated in the resolution passed April 1st, 1941 establishing this Special Foreclosed Property Fund, seconded by touncilman Southard and by vote declared unanimously UARRIKL . councilman Goodyear moved that Pentland and Robertson, C.P.A. be employed to Audit the town' s Books :Cot the Fiscal Year ending September 30th, 1941 at a cost not to exceed *60.00, seconded by Councilman 8oythard and by vote declared CARRIED. The Clerk read aletter dated September 15, 1941 from W.T.Goodyear tendering his resignation as a member of the sown Council, effective lovember 4th,1941 Councilman. Goodyear moved that the resignation of Y .T.Goodyear as Council- man, effective 1ovember. 4th, be accepted, seconded by Councilman Renwick and by vote declared CARRIED. Councilman Southard not voting. Councilman Southard moved that the Salaries of the Clerk and Marshal as set forth in Ordinance 'to. 99 be effective as of October let, 1941, seconded by Councilman Goodyear and by vote declared unanimously CARRIED.
