Attached please find the "Updated " Lien Research & Payoff Worksheet that reflects what we discussed —
1) The Code, Lot & Nuisance Abatement liens have been removed/reduced in the amount of $7, 478.55
2) The recording fees for those have been added in the amount of $473.00
Which now brings the total payoff to $8, 020.07. At the time, this is closed/paid off, Satisfactions will be done on
the Utility Liens with Releases done on the Code, Lot & Nuisance Abatement Lien.

Recently, SAM received notice that the City of Edgewater (the "City") has recorded
multiple Claims of Lien (hereinafter collectively referred to as the "Liens") against the Property
for a code violation(s), which the City claims entitles it to collect over Two Hundred Forty Two
Thousand Thirty Seven and 151100 Dollars ($242,037.15) from the Owner. These fines and
Liens are for violations which were either barred by the Lis Pendens dated November 29, 2012,
or foreclosed as a result of the Final Judgment on February 6, 2015. As such, the Owner disputes
the validity of the City's entitlement to these fines.

48.23, Florida Statutes, a Notice of Lis Pendens was recorded in O.R. Book 6788, Page 2070, of
the Official Records of Volusia County, Florida, on November 29, 2012. A true and correct
copy of the Notice of Lis Pendens is enclosed for your reference.
The recording of the Notice of Lis Pendens operated to protect the Owner's interest in
the Property from any impairment from intervening liens, including the City's code enforcement
liens. See Medical Facilities Development Inc. v. Little Arch Creek Properties Inc., 675 So. 2d
915 (Fla. 1996); Chiusolo v. Kennedy, 614 So. 2d 491 (Fla. 1993). The recording of the Notice
of Lis Pendens constituted a bar to the enforcement against the Property of the code enforcement
lien/fines referenced above. §48.23(1)(d), Fla. Stat. (2009). Further, once the Property was sold
at the judicial sale and the Certificate of Title was issued to the Owner on March 18, 2015, the
Property was forever discharged from the alleged liens/fines. Op. Att'y Gen. Fla. 93-77 (1993)
(The lis pendens "statute specifically provides that if the proceedings are prosecuted to a judicial
sale of the property described in the lis pendens notice, the property is forever discharged from
all such unrecorded interests and liens."). True and correct copies of the Certificate of Title and
Final Judgment in the Owner's foreclosure are also enclosed for your reference.
Even if the City's lien ordinance is deemed to be a "super -priority" ordinance, it would
constitute an unconstitutional impairment of the Owner's contractual relations as applied to the
mortgage with the former owner, which established the Owner's mortgage lien as a first -priority
lien against the Property. Sarasota County v. Andrews, 573 So. 2d. 113 (Fla. 2d DCA 1991);
City of Palm Bay v. Wells Fargo Bank, N.A., 57 So.3d 226, 227 (Fla. 5th DCA 2011); aff'd, 114
So.3d 924 (Fla. 2013) (holding a City ordinance granting code enforcement liens priority over
mortgages conflicts with § 695.11, Florida Statutes, which codifies the common law recording
rule of "first in time, first in right," and thus violates Art. VIII, §2(b), Fla. Const., which
prohibits such a conflict between municipal ordinances and state statutes).
Additionally, the City was a party to the Owner's foreclosure action. As such, any
interest that the City may have had in the Property was foreclosed when the Final Judgment was
entered. As such, the Owner hereby demands that the City provide Releases of Lien for the
aforementioned Liens as soon as possible. The Property is under contract and is expected to
close as soon as the Liens can be resolved. To that end, the Owner is willing to pay Five
Hundred and 00/100 Dollars ($500.00) towards the City's administrative expenses in order to
resolve this matter.

THIS MATTER came before this Honorable Court upon Plaintiffs Motion for Final
Summary Judgment of Foreclosure, and Attorney Fees and Costs, wherein the Court finds that
service ofprocess was properly rendered against Defendants. All Defendants were properly served
with process and were then either voluntarily dismissed or timely defaulted.
The Court also finds that all Defendants have failed to assert any material facts or issues that
precludes summaryjudgment. The Court finds that Plaintiff has filed Affidavits and Exhibits herein
as proof of the sums due; and the Court having heard argument of counsel and being fully and
sufficiently advised in the premises,

on May 18, 2013 and did not have a probate estate established in the interest of ROBINA. TYLER
a/k/a ROBIN TYLER in Volusia County, Florida, nor has a Last Will and Testament for ROBIN

Estate appointed a Guardian/Attomey Ad Litem, Richard Filson, an Attorney in good standing with
the Florida Bar, who has filed an answer and his report is accepted into evidence by this judgment.
The Court finds that publication has'occurred and that the requirements of due process and notice
have been met in this matter.

5. The Court finds that the 21.71 hours expended by counsel for Plaintiff in obtaining this
Final Summary Judgment is a reasonable number of hours, and that the range ofhourly rates charged
by the attorney working on this matter for Plaintiff of One Hundred Seventy Five Dollars [$175.00]
is reasonable and is the prevailing rate charged in this Judicial Circuit by lawyers of reasonable
comparable skill, experience, and reputation for similar lawyers. Accordingly, the Court finds that
the amount of One Hundred Seventy Five Dollars [$175.00] per hour for a period of 21.71 hours for
a total attorney's fee of Three Thousand Eight Hundred Dollars ($3,800.00) as set forth herein
the above paragraph is reasonable.

purchase of the property for sale shall be responsible for the documentary stamps payable on the.
certificate of title. At the time ofpayment of the bid amount any purchaser other than Plaintiff shall
pay a service charge assessed by the Clerk of the Circuit Court pursuant to Florida Statute 28.24,
