BUILDING TRADES REGULATORY AND APPEALS BOARD
REGULAR MEETING
JULY 21, 1994
7 :00 P.M.
Chairman Les Ogram called to order the Regular Meeting of the
Building Trades Regulatory and Appeals Board on Thursday July 21,
1994, at 7 : 03 p.m. in the City Hall Conference Room.
ROLL CALL:
Members present were Chairman Les Ogram, Michael Nelson, Douglas
Cole, Robert Howard and Gary Butt. John Ciaffoni and Lester
Yarnell were absent. Also present were Robert Dunn, Building
Official, Frank Conrey, Electrical Inspector, Mark P. Karet,
Director of Community Development (arrived at 7 :57 p.m. ) , and Tonya
Elliott, Recording Secretary.
APPROVAL OF MINUTES:
Chairman Ogram asked if there were any additions or correction to
the minutes of May 19, 1994 . Being none, Mr. Butt made a motion to
approve the minutes of May 19, 1994 . Seconded by Mr. Nelson.
Motion CARRIED 4-1. Mr. Howard abstained as he was absent from
that meeting.
UNFINISHED BUSINESS:
1) Construction Regulation Board (CRB) Draft Review - Chairman
Ogram asked Mr. Dunn if the creation of a new Board would replace
the current Board. Mr. Dunn said yes, and explained as previously
discussed the CRB would be a combination Building/Fire Board.
Chairman Ogram asked the Board members if they had any comments.
Mr. Howard said after a quick review of the CRB draft he saw
shadows of Chief Vola's proposed Fire Board, and would like more
time to review the draft.
After a lengthy discussion on the current role of the Board and the
CRB draft, Mr. Howard moved to have a special meeting Thursday
August 11, 1994 to further review and discuss the CRB draft. Mr.
Nelson said that date was not good for him. Mr. Howard amended his
motion to have a special meeting Thursday August 18, 1994 .
Seconded by Mr. Nelson. Motion CARRIED 5-0.
NEW BUSINESS:
1) Building Code Ordinance Draft - Mr. Dunn explained after
reviewing the current Building Codes, several need to be removed or
updated. He pointed out that the current list of Technical Codes
shown on the proposal indicate the 1991 edition, and will be
changed to the 1994 edition. Mr. Howard said he thought the Board
had previously recommended to Council that when new editions came
out they would automatically be adopted. Mr. Dunn said that was
true, however, a lot of codes need updating such as the National
Electrical Code (NEC) , Swimming Pool Code, and Satellite Signal
Receiving Station Code. Mr. Butt asked Mr. Conrey if this
Electrical Code was more stringent than the NEC. Mr. Conrey said

yes and explained that he feels these items are not properly
addressed in the NEC. The Board discussed in depth the NEC and
proposed Code amendments.
Mark P. Karet Arrived at 7 :57 p.m. Chairman Ogram asked if there
was any further discussion on the Building Code Ordinance. Mr.
Nelson said he was not disagreeing with Section 3 under
Certifications Required, but asked if it was consistent with State
Statute not allowing a homeowner to do their own electrical work.
Mr. Conrey said his main concern is electrical work dealing with
water such as swimming pools, hot tubs, sprinkler pumps and so on
and that is why this City Ordinance was put in. Mr. Nelson said
his concern was if it was legal. Mr. Karet said the City's legal
department was aware of language and has not directed any change.
There was then discussion on what electrical work can be performed
by a homeowner.
Mr. Cole asked if a homeowner is allowed to build their own
swimming pool. Mr. Dunn said no. The Board briefly discussed the
Swimming Pool Code.
Mr. Howard moved to recommend adoption of the Building Code
Ordinance. Seconded by Mr. Butt. Mr. Nelson said he noticed the
Ordinance required a fence be required even if a pool had a screen
enclosure and stated he thought that had been changed. Mr. Conrey
said a fence or screen enclosure were acceptable. Mr. Dunn said he
would make that change. Motion CARRIED 5-0.
2) Building Plans, Permit Approval, Inspections - Mr. Dunn
advised the Board that this section was going to be added to the
future Land Development Code, and the purpose was to set forth the
process requirements pertaining to building permits and
certificates of occupancy. He said he felt Staff had come up with
a real good recommendation for the Board to make to Council for
approval.
After discussion, Mr. Howard moved to approve the Building Plans,
Permit Approval and Inspection proposal. Seconded by Mr. Cole.
Motion CARRIED 4-1. Mr. Nelson was not present at the time of
vote.
3) Election of Officers - Chairman Ogram asked for nominations
for Vice-Chairman. Being none he said Vice-Chairman would remain
the same. He then asked for nominations for Chairman, and resigned
as the current Chairman. Mr. Butt nominated Mr. Nelson. Mr.
Nelson said with his job at the County and dealing with
contractors, he felt it would be a conflict of interest. Mr.
Howard nominated Mr. Butt. Being no other nominations, Mr. Butt
was nominated as Chairman.

Being no other business to come before the Board a motion to
adjourn was made and seconded. Meeting adjourned at 8 : 34 p.m.
