BUILDING TRADES REGULATORY AND APPEALS BOARD
REGULAR MEETING
MAY 19, 1994
7 :00 P.M.
Chairman Les Ogram called to order the Regular Meeting of the
Building Trades Regulatory and Appeals Board on Thursday May 19,
1994 at 7 : 10 p.m. in the City Hall Conference Room.
ROLL CALL:
Members present were Chairman Les Ogram, John Ciaffoni, Michael
Nelson, Douglas Cole and Lester Yarnell. Robert Howard and Gary
Butt were absent. Also present were Bob Dunn, Building Official,
Mark P. Karet, Director of Community Development, (arrived at 7 :52
p.m. ) , and Tonya Elliott, Recording Secretary.
APPROVAL OF MINUTES:
Chairman Ogram asked if there were any additions or corrections to
the minutes of March 24 , 1994 . Being None the minutes were
approved as written.
UNFINISHED BUSINESS:
None at this time.
NEW BUSINESS:
Chairman Ogram said the purpose of the meeting was to discuss the
ordinances given to the Board regulating the appeal boards of other
communities, then decide what the Board wants to do, and possibly
make suggestions to City Council. He asked the Board members if
they wanted to discuss each city ordinance separately or together.
It was decided to discuss them separately.
The Board began by briefly discussing New Symrna Beach, and Volusia
County's Ordinance, and how their boards are involved with the
licensing contractors.
Chairman Ogram then decided to look at the Edgewater Ordinance.
The Board was in agreement that they feel their functions have been
superseded by Ordinance and Charter.
The Board then began discussing the Port Orange Ordinance. Mr.
Dunn said their board is a building and fire combination, and that
he was looking into possibly combining Chief Vola's proposed Fire
Board and this Board. There was a brief discussion on the duties
of the Port Orange Construction Regulation Board.
Mr. Dunn said he had reviewed the Deland Ordinance and liked it
because it spelled out everything, such as reasons for appeals and
the process. Chairman Ogram asked Mr. Dunn what the current
procedure was if someone wanted to appeal a decision. Mr. Dunn
said he would have a meeting with the person and try to resolve the
disagreement before going to the Board. The Board discussed the
ordinance and agreed it was very detailed.

Chairman Ogram said that since everyone agreed the Deland Ordinance
was the most informative, maybe they could make suggestions to
amend or add to the ordinance. Mr. Nelson asked if it would need
to be tied in with the Edgewater Licensing Ordinance since Deland
was structured as an appeals board. Mr. Dunn said yes and that
something like the Deland format would be ideal for the Contractor,
Board and Building official, and could be tied into what the Board
already has.
The Board then began discussing their role in code changes.
Mr. Karet Arrived at 7 :52 p.m. Mr. Dunn informed Mr. Karet what
the Board had discussed and said the Board had a question as to
their role in reviewing possible code changes. Mr. Karet it is not
a requirement that the Board review code changes, however, the
Board could propose changes.
Mr. Nelson asked Mr. Karet if the issuance of competency cards when
it comes to licensing was still a function of the Board. Mr. Karet
said no that licensing is done through outside agencies such as the
State.
Chairman Ogram asked Mr. Karet if the duties of the Board were just
appeals. Mr. Karet said yes, and advisory if the Board wanted to
recommend code changes.
Mr. Karet said he had not reviewed the other cities ordinances in
detail, but it seemed to him most of the cities are doing the same
thing with their boards, and the whole idea is to get this Board up
to date with what they should be doing and what staff should be
doing. The Board further discussed their current role and possible
changes. Mr. karet said the primary task of the Board should be
appeals, and also have some power to make other recommendations.
Chairman Ogram asked Mr. Karet if the Board should try to decide
its own fate only to have someone else say no they cannot do that,
or should the guidelines be set by someone else. Mr. Karet said a
draft with Staff recommendations could be brought before the Board
at a later date by Mr. Dunn, then the Board and Mr. Dunn can take
it from there. The Board agreed with the idea.

Chairman Ogram asked if there was any other business the Board
needed to discuss. Being none a motion was made and seconded to
adjourn.
Meeting adjourned at 8: 14 p.m.
