2012-R-15 RESOLUTION NO. 2012-R-15 A RESOLUTION OF THE CITY OF EDGEWATER, FLORIDA, AUTHORIZING THE SUBMITTAL OFAN APPLICATION TO THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION FOR AN UPLAND EASEMENT TO CONSTRUCT A RECLAIMED WATER LINEAT THE INTERSECTION OF U.S. 1 AND ALAMANDA DRIVE; REPEALING RESOLUTIONS IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY AND APPLICABILITY AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida ("Board") requires submittal of an application for an easement interest in land, title to which is vested in the Board, and; NOW, THEREFORE, be it resolved by the City Council of the City of Edgewater, Florida: Section 1. The City Council hereby authorizes and directs the City Manager to submit an Upland Easement Application to the Florida Department of Environmental Protection to obtain an easement from the Board of Trustees of the Internal Improvement Trust Fund of the State of Florida to allow for the construction of a reclaimed water line at the intersection of U.S. 1 and Alamanda Drive. A copy of the Upland Easement Application and surveys are attached hereto and incorporated herein as Exhibit"A". Section 2. Conflicting Provisions. All resolutions or parts of resolutions in conflict herewith are hereby repealed. Section 3. Severability. If any portion of this resolution is for any reason held or declared to be unconstitutional, inoperative, or void, such holding shall not affect the remaining portions of this resolution. If this resolution or any provisions thereof shall be held to be 2012-R-15 1 o inapplicable to any person, property, or circumstances, such holding shall not affect its applicability to any other person, property or circumstance. Section 4. Adoption and Effective Date. This resolution shall take effect upon adoption. The requested easement will facilitate the construction of a reclaimed water main that will cc.nnect to the;existing reclaimed water distribution syst,!ir?. The reclaimed water main will provide water for irrigation to the recently completed City of Edgewater Fire Station 55 on US Highway 1 and other properties in that area of the US1 corridor. The reclaimed main will also provide water to irrigate the medians along US Highway 1 as part of the upcoming FDOT/City of Edgewater US1 Median Improvement Project: The public will benefit from the granting of the easement and construction of the reclaimed water main in ce,,e^_9? i nt-c• • Utilizing reclaimed water to irrigate the Fire Station, US1 corridor & US1 Medians will reduce the amount of ground water withdrawn from the aquifer for that purpose. • Construction of the reclaimed main will provide the potential for the future expansion of the reclaimed water distribution system enabling other municipal, . commercial and residential properties to utilize req,aimed water for irrigation. The requested term for the proposed easement is for perpetuity. 2. The City of Edgewater needs the proposed easement to construct a reclaimed water line to serve the City's new fire station and the medians within the U.S. #1 corridor with reclaimed water. This is the only place this water line can be installed to connect to existing reclaimed water lines. 3. The reclaimed water line is intended to be used for the new fire station and to irrigate the medians in U.S. #1. Potential customers cannot be determined at this time,thus no projected revenue is known. 4. The use of this easement will be for public purposes. 5.
